The proposed hardcover regulations have not yet been adopted, as you are aware. They will be the
subject of a public hearing at the June 18 Planning Commission meeting. Assuming a favorable reaction,
they would then go to the City Council for action on July 9. If adopted they would become effective
upon publication, probably near the end of July at best.
You should be forewarned that the property at 2789 Pheasant Road would appear to require a lot width
variance in order for a rebuild to occur. Zoning Code Section 78-72(b)(1)establishes buildability for a
record lot meeting 80%of the lot area and width standards of the zoning district,which in the case of
2789 Pheasant is LR-1B requiring 80%of 1.00 acres and 140' width. According to Hennepin County tax
records the lot area is 1.06 acres but per the attached plat map, is only 100 feet in width or 71%of the
required 140'. As you can see, it is the narrowest lakeshore lot in the neighborhood.
I see no reason why a width variance would not be granted. The next deadline for zoning applications is
noon on Wednesday June 20 for the July 16 Planning Commission meeting, with potential action by
Council on August 13. It might be safest to apply for the width variance and hardcover variance, then
withdraw the hardcover variance if the new regulations making it unnecessary become effective in time.

Mike&Melanie,
Stonewood & I have a client at 2789 Pleasant Road that is going to tear down and build new this coming
luly/August.According to the current hardcover rules we would need a variance for hardcover. According to
the new 25%for total hardcover that is on the agenda for city council to be adopted we would not need a
variance. What do you suggest we do?
