A RESGLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 78-1288
AND
REVISiNG R�SOLUTION NO. 4764

WHE�AS, Matthew A. and Kathleen M. T)olliff', husband aud �vife,
(hereinafter "Owners") are the owners of the property located at 2680 Pheasant Road within
the City of Orono (hereinafler "City") and legally described as Lot 20, Pheasant La�vi�,
Hennepin County, Mirulesota (hereinafter "the property"); and
WHER�AS, the Owners have made application to the City for a variance to
Municipal Zoning Code Section 78-1288 to revise the hardcover variance granted in zoning
file #02-2754 so they may constnict a third garage stall while maintaining the approved
amount of hardcover, 34.19% in the 75 to 250 foot zone, when the maximum is 25 percent;
and

l. This application was revie�ved as Zoning File #07-3256.
?. The property is located in the LR-lB zoning district, where 1 acre is the

appro�imately 0,79 acre in area and 99 feet in width.
�. The Fiannin� Conu��ission reviewed this applicaiion on Januarv 16, 20C17 and
oi1 a ��ote of 7 - 0 recommended approval of the variailce, based oiz the

a. The hardcover being removed is farther fiom the lalce than the hardcover
being added.
b. The Owners have agreed to the additional reductioii in hardcover
recommended by Staff so the amount of hardcover would actually be
reduced.
4. The City Council has considered this application including the findings and
recominendation of tl�e Planning Commission, reports by City staff, coinments
by the applicants and the public, and the effect of the proposed variance on tl�e
health, safety and welfare of the comm�inity.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting tlre variance would not adversely affect traffic conditions, liglit, air
nor pose a fire hazard or other danger to neighboring property; would not
merety sen�e as a conveniei�ce to t1_ze Owners, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preseive a substantial
property right of the Owners; and would be in lceeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.

Based upon the above f ndings, the �rono �ity Council hereby grants a variance to Oroilo
Mtinicipal Zoiiin� Code Section 78-1288 revising the hardcover variance granted by
Resolution No. 4764 to allow a garage addition, suUject to the following conditions:
1. Council approval is based on the site and house plans submitted by the Owners
and annotated by City staff, attached to this Resolution as Exhibits A. and B,
Any amendments to these plans may require fiii-lher Planning Conui�issi�n and
City Council review.
2. Hardcover ii1 the 0-7�' zone shall be limited to 0 s.f. or 0°'0. Hardcover in the
75-250' zone shall be limited to 6,3?4 s.f. oi• 34.02°0. Hardcover in the ?50-
S00' zone shall be limited to 9S4 s.f. or 12°�o p�r the propose.d site plan. The

Owners are advised that any fiiture requests to increase hardcover or change
the nature of existiug/a�proved hardcover shall require City approval, and
increases in hardcover will not likely be approved without concui-rent
reduction ii1 existing hardcover.
3. The Owners shall not place any plastic or fabric liner material under any
landscaping areas on the property to ensure their permeability as non-
hardcover surfaces.
4. Authorities granted by this resolution run with the property ilot with the
owners, but are perniissive only and must be exercised by obtaining a building
permit for the iiew constniction before January 22, 2008 or the vasiance will
expire on that date.
5. � Violation of or izon-compliance with any of the terms and coi�ditions af this
resolution sliall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
6. The undersigned Owi�ers l�ave read, understand and hereby agree to the teims
of this resolution and on behalf of their heirs, successors and assimis, llereby
agree to the recording of this resolution in the chain of title of the property.
Adopted by the Orono City Council on this 22nd day of January, 2007.
