I left you a message on this as well but thought I would put something in e-mail. This is the description of our property
from the Registrar of Titles:
That part of Lots 22 and 23, "Pheasant Lawn", lying Northerly of a straight line drawn from a point in the Southeasterly line
of said Lot 22, distant 27 feet Southwesterly of, measured along said Southeasterly line of said Lot 22 from the
Northeasterly corner of said Lot 22, to a point in the Northwesterly line of Lot 23, "Pheasant Lawn", distant 30 feet
Northeasterly of, measured along said Northwesterly line of said Lot 23 from the most Westerly corner of said Lot 23.
Subject to an easement over the Southerly 10 feet of the above described land for the use of the owners and occupants of
Lots 1 and 2 "Pheasant Lawn" for the purpose of ingress and egress to the lagoon at the East end of said 10 foot strip of
lan, as contained in Deed Doc No 416399.
In looking at the Hennepin County Information for"Pheasant Lawn" the owners of Lots 1 and 2 are our Neighbors James
and Cheryl Johnson. 2655 Pheasant Rd Excelsior MN 55331. Their Metes and Bounds states: Lots 1 2 and ELV 1/2
front and rear of lot 3.

I apologize for not following up with this earlier. I received the attached legal description and survey in March; however
I anticipated receiving additional information regarding the extinguishment of the existing easement or being provided
with the names of the parties to be included in the new easement. We need one of the two options to be addressed. I
should have followed up with you on this sooner. Thanks for the reminder. Let me know if you have any questions.

I am following up on open files and came across the un-issued C.O. for the Haddens.
Per the attached variance resolution an easement was to be granted to the City for drainage and utility purposes over
the drainage swale (Item 5 on page 4 of 5). This has yet to be completed.
Please submit a legal description for the easement area and our attorney will draft the easement document.
Additionally, if the parties who currently have an easement over the Haddens' property for ingress and egress to the
lake (as previously noted) haven't extinguished their easement they will need to sign the new easement to the City.
This is because some neighbors have rights over the Haddens' property which they must either remove or participate
in the granting of the new easement. Please either submit evidence of the extinguishment of the existing easement or
provide me with the names of the parties to be included in the new easement.
Once I receive the information our attorney will draft the easement document for signature(s). I will provide you with
the drafted easement document and all interested parties will have to sign. After that, you will need to submit it to me
and I can then issue the Haddens'C.O.
I apologize if this is at all confusing. Let me know if you or the Haddens have any questions. Once all of this is
resolved we can issue the escrow monies we have on file as well.
