A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330, 78-1279 & 78-1288 FILE NO. 10-3443 �o� 0 0 CITY of ORONO ,� �, � ti ti RESOLUTION OF THE CITY COUNCIL ��`9k'ESH.�g'�G NO. � � 1 � A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-330, 78-1279 & 78-1288 FILE NO. 10-3443 WHEREAS, Timothy Hadden and Juliann Hadden, husband and wife (hereinafter "the applicants") are the owners of the property located at 2655 Shadywood Road within the City of Orono (hereinafter the"City") and legally described as follows: That part of Lots 22 and 23, "Pheasant Lawn" lying northerly of a straight line drawn from a point in the southeasterly line of said Lot 22, distant 27 feet southwesterly of, measured along said southeasterly line of said Lot 22 from the northeasterly corner of said Lot 22 to a point in the northwesterly line of Lot 23, "Pheasant Lawn", distant 30 feet northeasterly of, measured along said northwesterly line of said Lot 23 from the most westerly corner of said Lot 23, Hennepin County, Minnesota(hereinafter the"property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 to allow redevelopment of a property 58 feet in width at the ordinary high water level (OHWL) and 145 feet at the 75-foot setback where a 140 foot width is required for both; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new residence 48 feet from the OHWL for the house and 35 feet from the OHWL for an above grade deck where a 75-foot setback is normally required; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 to allow 25% hardcover within the 0-75 foot zone where 0% is normally allowed in conjunction with construction of the new residence; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on January 19, 2410, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Page 1 of 5 �o� 0 0 CITY of ORONO ,� , �, ti ��� �G~' RESOLUTION OF THE CITY COUNCIL `9kEgI30'g' No. 5 9 1 6 NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS l. This application was reviewed as Zoning File 10-3443. 2. The property is located in the LR-1B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 1.0 acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on January 19, 2010 and with a vote of 5 — 1 recommended approval of variances based on the following findings: a. The property contains 39,138 square feet in area or 0.89 acre and has 58 feet of width at the OHWL and 145 feet of width at the 75-foot setback. The property is situated at the northwest end of the inlet/lagoon which results in a narrow lakeshore. b. The property is consistent in size with the other properties in the immediate neighborhood. c. The proposed home is outside of the average lakeshore setback. d. Moving the house further out of the 75-foot setback would significantly limit lake views. e. The applicants will grant an easement to the City for the existing drainage swale which cuts through the property. f. The applicants have proposed vegetative buffers along the drainage swale and shoreline to mitigate for the requested excess hardcover. g. The proposed home complies with the building height and structural coverage limitations and will be compatible with the immediate neighborhood. h. The existing driveway access off of Shadywood Road will be abandoned and a new access from Pheasant Road will be created. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable haxdship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 to allow redevelopment of a property 58 feet in width at the ordinary high water level (OHWL) and 145 feet at the 75-foot setback where a 140 foot width is required for both; and a variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new house 48 feet from the OHWL for the house and 35 feet from the OHWL for an above grade deck where a 75-foot setback is normally required; and a variance to Orono Municipal Zoning Code Section 78-1288 to allow 24% hardcover within the 0-75 foot zone where 25% was requested and 0% is normally allowed in conjunction with construction of the new residence, subject to the following conditions: 1. Council approval is based on the site plan, building plans and landscape plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibits A, B & C. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 2,219 s.f. or 24%. Hardcover in the 75-250' zone shall be limited to 5,688 s.f. or 21.3% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. Per City Code Section 86-68, a foundation survey is required to be submitted prior to commencement of framing; and b. An as-built grading plan verifying compliance with the building permit, stormwater management, grading and drainage plans shall be submitted prior to the issuance of a Certificate of Occupancy for the residence. 4. With the issuance of the building permit for the new residence, the property address will be changed from 2655 Shadywood Road to 2600 Pheasant Road as the driveway is proposed to access off of Pheasant Road. 5. The applicants will grant to the City a drainage and utility easement over the existing drainage swale on their property. 6. The building plans submitted for building permit will be reviewed to ensure compliance with the City's building height and number of stories regulations. 7. Applicants shall remove and not replace all plastic or fabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 8. Required removals of structure and hardcover to be removed shall be completed prior to the footing inspection for the new residence. 9. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (February 22, 2011). 10. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 11. The undersigned applicants have read, understand and hereby a�ee to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
