The plans are dated 1-20-10. We have the following comments with regards to engineering matters: • The proposed tiered retaining walis on the west side of the proposed driveway are eight feet high. Engineered design and details should be submitted for review and approval for all retaining walls over four in height, and for all tiered walls with a separation of less than two times the wall height. • A wetland is has been conservatively located in the southwest corner of the properry by John Smyth at the City's request. The project grading will not impact the wetland buffer areas. . Please see the attached memo from dated 12-8-09 from John Smyth for additional wetland buffer information and requirements. • This project will disturb more than 100 CY of material. Sediment and erosion control information meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000 sediment and erosion control financial security should be required of the owner for this permit. The site investigation took place on 12-8-09. Frozen soil conditions required a wetland boundary estimate rather then a formal delineation. A formal delineation will likely be required by the City prior to issuance of the certificate of occupancy. The wetland boundary was marked in the field with pink ribbon tied to shrubs and trees. The boundary is marked at a tlistinct topographic and vegetative break.There is one wetland located on the lot and it has a Manage 3 classification. This classification requires a 16.5 foot buffer and 20 foot setback from the buffer. Buffer Condition and Requirements The buffer is predominately oak woodlantl and has a significant amount of buckthorn in the understory. According to Division 3 sec. 78-1605 buckthorn is considered to be an undesirable plant species and should be removed from the buffer area. Due to the density of the buckthorn within the buffer the area will need to be seeded or planted with native species once the buckthorn is removetl. The applicant will need to provitle a Management/Landscaping plan that includes the following: 1. Method proposed to be used to control buckthorn (MN DNR website source for options). All buckthorn removal should be done using hand tools as large equipment can further disrupt the wetland buffer. At a minimum buckthorn should be cut and the remaining stems should be treated with an approved herbicide following label instructions. Treating the cut stumps will help prevent regrowth of the buckthorn. 2. Method of establishing native vegetation in buffer for areas. (MN BWSR Web Site— Publication: "Restoring & Managing Native Wetland and Upland Vegetation" source for options). 3. Species proposed to be seeded or planted. According to the ordinance Div. 3 Sec. 78- 1605 (3)the seed mix must contain at least 12 pounds(PLS) per acre of native prairie grass seed and 5 pounds (PLS) per acre of native wildflower seed. The grass mixture must contain a minimum of four species while the wildflower mixture must contain a minimum of five species. (MN BWSR Web Site—Publication: "Restoring& Managing Native Wetlantl and Upland Vegetation" source for options). 4. A schedule of activities that are part of the management antl maintenance for the removal of buckthorn and the establishment of vegetation in the buffer shall be provided. Survey Requirements A legal description for the upslope edge of the buffer will need to be submitted with the Restrictions and Covenants (see below). Restriction and Covenant for Wetland and Buffer Per Section 78-1611 of the wetland ordinance the owner shall record Restriction antl Covenants over the wetland and buffer with the property chain of title. A form with the language for the Restriction and Covenants is available from the City. Wetland Buffer Markers Formal buffer markers are not required for the proposed activity under the Ordinance, however it is recommended that the buffer is marketl by the applicant so they can be avoided during native vegetation development and for review during the vegetation establishment period (approx. 2 years). Wetland Water Quality Treatment Requirements The buffer will provide adequate treatment for the proposed use of the properry. Recommendations If the requirements of this memo are complied with the application can be approved. It is recommendetl that a cash escrow of$4,000 is provided by the owner. It will be used for future compliance checks and restoration work, if necessary, to bring the buffer into vegetative compliance.
