Sec.13.04 RIGHTS OF STJB,TECTS OF DATA
Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this secdon.
Subd.2. Information required to be givea individual. An individual asked to supply private or confidencial data concerning himself
shall be informed of: (a)the purpose and intended use of the requested data within the collecting sta[e agency,polirical subdivision, or statewide
rystem;(b)whe[her he may refuse or is legally required to supply the requested data;(c)any Imown consequence arising from his supplying or
refusing to supply private or confidenaa]dara;and(d)the identity of other persons or endaes authorized by srate or federal law to receive the data.
This requiremznt shall not apply when an individual is asked to supply investi;ative data, pursuant to secdon 13.82, subdivision 5, to a law
enforcement officer.
The commissioner of revenue ma lace the notice re uired under this subdivision in the individual income taz or ro e tax refund
instrucdons instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsibie authority,an individual shall be informed whether he is the
subject of stored daca on individuals,and whether it is classified as public,private or co�denrial. Upon his further request,an individua]who
is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires,shall be informed
of rhe content and meaning of that data. Aher an individual has been shown the private data and informed of its meaning, the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this secdon is pending or addicional data on the individual has been
collected or created. The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data.
The responsible authority may require the requesdng person to pay the actual cosu of making,certifyin„and compiling the copies.
The responsible authoriry shall comply'vnmediately,if possible,with any request made pursuant to this subdivision,or within five days
of the date of the request,excluding Saturdays,Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with
the request wirhin that time, he shall so inform the individual,and may have an addidonal five days within which to comply with the request,
excluding San:rdays,Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or
private da[a conceming himself. To exer�ise this right,an individua]shail notify in writing the responsible authoriry describing the nature of the
disagreement. The responsible authoriry shail within 30 days either: (a)correct the dara found to be inaccurate or incomplete and attempt to notify
past recipients of inaccurate or incomplece data,including recipienis named by the individual;or(b)notify the individual that he believes the data
ro be correct. Data in dispute shall be disclosed oniy if the individual's statemen[of disagreement is included with the disclosed data.
The determinadon of the responsible authoriry may be appealed pursuant to the provisions of the administradve procedure act relaang
to contested cases.

Decks
Buildin�Permits are required for any deck or patio.
Frost Footin�s are required for any deck that is attached to a dewelling or gazage that has a frost
footings.
Guardrails-All decks that are 30" or more above grade must be protected by a guardrail. Such rail
sha11 be 36" minimum in height. Open guardrails and stair railings shall have intermediate rails or
an omamental pattern such that a 4" diameter sphere cannot pass through.
Overhangin�Decks -Joists should not overhang beams by more than two feet, nor should beams
overhang posts by more than one foot unless a special design is approved.
Stairwav-If a stairway is to be provided, it shall be not less than 36 inches in width. 8"maximum
rise- 9" minim�m run- 6'8" minimum headroom.
Handrails-Handrails shall be provided to all stairways having 4 or more risers(private residential
only). See page 5 for more information.
Live Load-All decks shall be designed to support a live load of 60 pounds per square foot.
Flashins -All connections between deck and dwelling shall be weatherproof. Any cuts in exterior
finish shall be flashed or caulked.
Joist Hangers - Header joists more than six feet long and tail joists over 12 feet long shall be
supported by approved framing anchors such as joist hangers.
Wood Required-.All exposed wood used in the construction of decks is required to be of approved
wood of natural resistance to decay(redwood,cedar,ect.)or approved treated wood.This includes
posts,beams,joists, and decking.
Special Desi n Note-Some deck designs may not be appropriate should the placement of a screen
porch or 3-season porch on the deck platform be a future consideration.Porch setback requirements
are not the same as deck setbacks.

1. Footin�s -After holes are dug,but prior to pouring of concrete.
2. Framin - Prior to laying decking. Framing inspection may be done when
deck is complete if deck is not enclosed underneath.
3. Final - When deck is completed.
