Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subd. 1. Type of data. T'he rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given indiridual. An individual asked ro supply privau or confidential dara concerning himself
shall be informed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subdivision,or statewide
system;(b)whether he may refuse or is legally required to supply the requested data;(c)any lmown consequence arising from his supplying or
refusing to supply private or confidential data;and(d)the identiry of other persons or en�ties authorized by srate or federal law to receive the data.
This requirement shall not apply when an i�ividual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law
enforcement officer.
The commissioner of revernre mav olace the notice rewired under this subdivision in the individual income tax or nrocerN tax refund
inst�ucaons instead of on those forms.
Subd. 3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he is the
subject of stored data on individuals,and whether it is classified as pubtic,private or confidential. Upon his further request,an individual who
is the subject of stored private or public data on individuals shall be shown the data without any charge to him and,if he desires,shall be informed
of the content ac�meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pe�ing or additional data on the individual has been
collected or created. The responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data.
The responsible authoriry may require the requesting person to pay the actual costs of making,certifying,and compiling the copies.
The responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days
of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with
the request within that dme,he shall so inform the individual,and may have an additional five days within which to comply with the request,
excluding Saturdays,Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or
privare data concerning himself. To exercise ttus right,an individual shall notify in writing the responsible authoriry describing the nature of the
disagreement. The responsible authoriry shall within 30 days eithet: (a)correct the data fourd to be inaccurate or incomplete and attempt to notify
past recipients of inaccurate or incomplete data,i�luding recipients named by the individuat;or(b)norify the individual that he believes the dara
to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
The determinaaon of the responsible authority may be appealed pursuant to the provisioas of the administradve procedure act relating
to contested cases.

Dear Mr. Vang:
I have been asked to validate the structural stability of the recently constructed boulder wall at
the Stewart & Gina Hansen residence in Orono. The residence is located at 583 Park Lane.
I have received photographs from the contractor along with a summary of the wall construction
(attached). Based on the provided information, the wall meetings all minimum safety factor
requirements for overturning, sliding, and bearing capacity. The wall appears to be well
constructed, with minimal vertical joints at any point along the wall. The contractor has properly
diverted water flow from the wall by extending the wall 4-6" above grade, and incorporating a
drain tile to divert runoff and the roof drainage from the wall. In my professional opinion, the
wall contractor has constructed the wall properly, and the wall should function safely.

Per your request, I'm encloaing a photo of the boulder watl project we discusaed
� Nov. 6'�. The walt is 6'2"abwe grade at the highes� ru�.s 37' along the lot line
(set back 2.8')ending in a planter tha�t steps into the neighbaring slope. The base
courae consists of 3-4' boulders set into the existing grade, tt�e second course is of
3'+boulciers, the wa]1 is backed with Fibeimat landscape fabric. There is a solid
4" draa►tite nuuring behind the top course of the wall set in 3/4"red rock exitu�g
8+feet beyond the wall with a boulder catch ba�sin to prevent slope erosion. The
top course of the wall is set 4-6" above the neighboring grade,back filled aad
sloped to limit overland runoff over the top of the wall.
