Brent Teele&Amy Sullivan-Teele have complied with the remova� of the accessory structure
in violation of the setback requirement. The $1,000 the Teele's deposited with the City to
ensure compliance can be refunded to them. I verified there are no other outstanding issues.

Agreement for Removal of an Accessory Structure
Right-of-Entry
THIS AGREEMENT, made and entered into this �� day of ,
2010, by Brent Teele and Amy Sullivan-Teele (hereinafter referred to as "Property Owners")
and the City of Orono, a Minnesota municipal corporation(hereinafter referred to as the"City").
WITNESSETH:
WHEREAS, the Properry Owners have an accessory structure that is located within the
setback area and on their property located at 577 Park Lane, within the City of Orono, Hennepin
County,Minnesota, (hereinafter refened to as the "Subject Property"); and
WHEREAS,the Property Owners are the owners of the Subject Property; and
WHEREAS, Property Owners are aware that according to Orono Municipal Zoning
Code Section 78-1279, the setback requirement from the Ordinary High Water Level is seventy-
five feet; and
WHEREAS, the City intends to allow this accessory structure to remain on the properly
until the beginning of the winter season, when the ice makes it reasonably safe to use the
structure for its intended purpose, with the expecta.tion that the structure will not be returned to
the required setback area at the end of the winter season; and
WHEREAS, the Property Owners agree to a11ow City personnel to remove a11 personal
items from the accessory structure and allow the City to demolish the accessory structure and
remove the debris from the accessory structure if it is not moved from the required setback area
at the beginning of the winter season, if the structure is placed within the required setback area at
the end of the 2010-2011 winter season without receiving proper permits, or if the structure is
within the required setback area after January 1, 2011.
NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE TO THE
FOLLOWING:
1. The accessory structure may remain where it currently sits until the winter season,
when the condition of the ice makes it reasonably safe to move the structure onto the ice for its
intended purpose.
2. The accessory structure may not be placed within the seventy-five foot setback
area at the end of the winter season if the Property Owners have not obtained proper permits to
do so.
3. The City may enter the accessory structure and remove all of the Property
Owners' personal property from the accessory structure and demolish the accessory structure
after the personal property has been removed at the earliest of the following:

A. the structure remains within the required shore setback area after
reasonably safe conditions to move the structure onto the ice develop and
the structure is not moved from the required setback area; or
B. the structure is within the required setback area at the end of the winter
season; or
C. the structure is within the required setback area any later than January 1,
2011.
4. The Property Owners agree to deposit One Thousand and no/100ths Dollars
($1000.00) with the City which may be used by the City to secure the demolition of and removal
of debris from the accessory structure.
5. � The Property Owner shall hold hatmless the City, the City Council, and its agents
and employees of the City from and against a11 claixns for damages that occur to the personal
property during the move that was not caused by the City's negligence.
6. Applicant shall indemnify and hold harmless the City, the City Council, and the
agents and employees of the City from and against a11 claims, damages, losses or expenses,
including attorney fees, which the City, City Council and agents and employees of the City may
suffer or for which it may be held liable, arising out of or r.esulting from the assertion against
them of any claims, debts or obligations in consequence of the performance of the terms of this
agreement.

Due to the ice conditions (not thick enough and lots of snow, slush on top), we have not been able to remove
the fish house from our property as of yet. Per our agreement, we intended to have this removed by January
1 st.
We are requesting and extension until February 1, 2011 or until the ice allows us to get a vehicle out there to
remove the structure.
Please confirm if this will be a problem.

If you choose not to sign the attached agreement, we will notify our attorney and direct him to proceed with
criminal prosecution.

Upon further review with our Attorney, we are requesting that points #4 and #6 be REMOVED entirely from the
attached agreement. If this can be accomplished we can meet at your office this Friday and sign. Please
advise.
Reasoning behind requested changes:
Point#4 -We don't have $1,000 dollars to have you hold until the end of the year, we are agreeing to remove
the structure or get a permit, we have given the City permission to enter on the land and remove the structure
and charge us for it, the City has the ability to assess our taxes for the removal, the City has the ability to
criminally charge us and fine us if we don't comply. It's just plain unnecessary.
Point#6 - This may cause a future cloud on our title that has to be cleared every time we refinance or the
property is sold, it could place a restriction on the property that could conceivably be more restrictive than
future restrictions, the language might prevent a future purchaser from even applying for a permit, our
mortgage companies have to consent to any voluntary encumbrance on the property pursuant to the terms of
our mortgages and requiring us to sign #6 requires us to violate our mortgage terms and could call for the
acceleration of our mortgage, and the city ordinances are claimed to prohibit the placing of this or a similar
structure on the described area so encumbering our title to the property is requiring of us something that is not
required of any other landowner.

deposit to guarantee compliance. We did not discuss this but it was our attorney's recommendation it be
included.
You may print the document and sign it before a notary or both of you can come to the City offices and we can
notarize it. Please submit the signed document and the deposit to me by your deadline (June 21st) and we will
consider the matter resolved for the time being.

Dear Ms. Sullivan-Teele and Mr. Teele:
This office represents the City of Orono ("City"). The City has sent this matter to our
office for criminal prosecution of violations of the Orono City Code and Zoning
Ordinance.
It has been brought to our attention from Melanie Curtis, Planning and Zoning
Coordinator, that you have failed to maintain the property in compliance with the Orono
City Codes and Zoning Ordinances.
You have until June 21,2010 to correct the violations on the above-referenced
property. Your failure to comply by June 21, ZO10 will result in criminal
prosecution. Each violation is punishable by 90 days in jail and a $1,000 fine for
each day the violation continues to exist.
If you choose to avoid prosecution by correcting the violations, you must first correct
the violations and only then contact Melanie Curtis, Planning and Zoning Coordinator,
at (952) 249-4600 to inspect the subject property. A follow-up inspection must be
completed to verify compliance and eliminate any type of prosecution.
Please make further enforcement action unnecessary by complying with this letter "
immediately.
