WHEREAS, Brent Teele and Amy Sullivan-Teele, husband and wife
{hereinafter "Ehe applicants'� are the owners of the property Iocated at 577 Parlc I,arie
within the City of Orono(hereinafter the"Cit}�')and legally described as follows:
Lot 12, Block 6, Miruzetonka Summit Park Addition, Fiennepin County,
Minnesota
(hereinafter the"propert��;and
WHEREAS, the applicants previously made application to the City of
Orono for a variance to Orono Municipal Zozung Code Section 78-282 and 78-1288 to
a11ow an increase in hardcover from 4.8% to 8.8%within the 0-75' setback zoue where
0%is normally allowed in order to constrnct a meandering lake access stair;and
WHEREAS, the applicants have made application to the City of Orono
for a conditional use permit pursuant to Orono Municipai Zoning Code Se�tion 78-1250
to allow grading within the 0-75' setback zone; and
WHEREAS, at the ti.me of the building pei7nit approval the applicants
revised their plans to reorient the proposed lake access stair resulting in a slight reduction
of approyed hardcover.
NOW, THEREFORE BE IT RESOLVED by tlie City Council of
Orano,Minnesota:

2. The property is located in the LR-1B, Single Family Lakeshore
Residential zoning district, which requires a minimum of 43,560 s.f. (1
acre) in lot area and 140' in width. The property is 9,440 square feet and
50' in width.
3. The Planning Commission reviewed this application at a public hearing
held on February 19, 2008 and recommended approval of the hardcover
variance and conditional use permit based on the following findings:
a. City Code 78-1282 allows for the installation of sta.irs, lifts and
landings in place of major topographic alterations on steep slopes.
b. The proposed changes to the stair system and wall result in an increase
in 0-75' zone hardcover frorn 4.8% to 8.8% but will be safer than the
existing stairs.
c. The existing railroad tie stairs and landings have a greater visual
impact from the lake than the proposed stair system.
d. The proposed walls will be 3' or less in height and screened from the
lake by vegetation for a more natural looking slope.
e. The applicants have provided a restoration plan meeting the goals and
intent of the Zoning Code and the Orono Community Management
Plan.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
5. At the time of the building permit review the applicants presented a
revised lake access stair design. On June 23, 2008, the City Council has
considered the revised plans received by the City on June 12, 2008 and the
survey submitted by the applicants as revised on June 12, 2008.
6. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic

conditions, light, air nor pose a fire hazazd or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings and with this Resolution, the
Orono City Council hereby replaces Resolution No. 5737 and grants a variance to Orono
Municipal Zoning Code Section 78-282 to allow hardcover within the 0-75' setback zone
consisting of 8.6%, and a conditional use permit for the construction of a new limestone
stair system, regrading of the slope and installation of low retaining walls subject to the
following conditions:
1. Council approval is based on the revised plans submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibits A, B & C. Any
amendments to the these plans which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75' zone shall not increase above the 8.6% or 317 s.f. per the
proposed revised plan and revised hardcover allowance summary as depicted on
Exhibit A. Applicants are advised that any future requests to increase hardcover
or change the nature of existing/approved hardcover shall require City approval,
and increases in hardcover will not likely be approved without concurrent
reduction in existing hardcover.
3. The crushed rock landing of the stairway must be unlined so it remains
permeable.
4. Walls are to be constructed in accordance with the plans and specifications
provided. The proposed walls must be screened year round with vegetation.
5. Landscape plan to be implemented in accordance with the plans and
specifications provided and City Engineer recommendations.
6. Double, heavy duty silt fence with steel t-posts must be installed along the
shoreline throughout the duration of the construction process and remain in place

until the slope is stabilized and vegetation is established. Protect trees during
construction to avoid tree damage.
7. The new stairway cannot be closer than 5' to the side property line.
8. Any proposed lighting must be low-level and pointed downward to light just the
path.
9. Authorities granted by this resolution run with the property not with the
applicants, but are permissive only and must be exercised by obtaining a building
permit for the new stairs within one year of the date of original Council approval,
or the variance will expire on that date (March 10, 2009).
10. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
temlinate any authority granted herein, and shall be punishable as a misdemeanor.
11. The undersigned Owners have read, understood and hereby agree to the terms of
� this resolution and on behalf of the Owners and the Owners' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.

The slope will be cleared of vegetation tMe first day in order to properly grade and lay the steps. All
ptant materiai will be removed,except for the existing large shade trees. Care will be taken around the
large trees so as not to damage the existing root system. After compfetion of the hardscape portion of
the project approximately 267 new plants will be planted on the slope. These plants will be native to
the area.
Before any work begins silt fence will be placed a{ong the shore(ine to prevent any debris from making
its way into the lake.The siit fence will remain until the newly pianted plants are estabiished. During
construction,sediment logs will be placed on areas that are not currently being worked on and they will
be reptaced/re-staked at the end of each working day at approximately halfway up the slope.
Upon compietion of the hardscape portion of the project an organic erosion control blanket will be
placed on the entire slope and staked in place. The plants will then be placed through the erosion
bfanket. All p{ants will have a hole cut into the blanket so the root systems are not damaged during
planting. An organic hardwood mulch will be placed over the top of the erosion control blanket to a �
depth of approx 2".
The railing being placed on the step system will be ptaced on the down slope side,and will be custom
built on site. If the grade at any point is greater than 30"from top of stairs to soil, a railing with vertical
slats no greater than 4"will then be installed.

The stacked stone retaining wall is set on a compacted limestone base no thinner �
than 6". Perforated drain tile and a loose gravel material is placed behind the wall to �:
