Johnson & Suzanne Johnson, husband and wife (hereinafter "the applicants") are the owners of the property located at 543 Park Lane within the City of Orono (hereinafter the "City") and legally described as follows: Lot 8, Blocic 6, Minnetonka Surrunit Park, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a new residence on a property 10,128 s.f. in area and 50' in width where 43,560 s.f. in area and 140' of width are nonnally required, and to allow an 8.5' side setbacic for a 7' wide cantilevered portion of the home where a 10' side setback is noi7naily required; and WHERE�S, the applicants have made application to the City of Orono far a variance to Orono Municipal Zoning Code Section 78-1279 to allow the proposed new residence to encroach 17' into the average lakeshore setbacic; and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-12�8 to allow 248 s.f. of hardcover within the 0 -75' zone where 0 s.f. is nonnally allowed, and 2,960 s.f. or 47.1% hardcover within the 75' — 250' zone ��here 1,570 s.f. or 25% is norn�ally allowed in conjunction with the construction of a new residence and to allo�v existing lake access stair and retaining wall to remain. 1�10��, �'HE�FO� BE I�' I�SOL,VED by the City Council of Orono, �✓�i:ir.esota: FINDINGS l. The property is located in the LR-1B One Family Lakeshore Residential Zoning District which requires a minimum lot area of 43,560 s.f or 1.0 acre and a minimuin lot width of 140 feet. 3. The Planning Commission reviewed this application at a public hearing held on April 17, 2006 and recominended denial of variances at the request of the applicants in order to move the application to the Council. 4. The City Council reviewed this application on May 22, August 28, and Decernber 1 l, 2006 and makes the following findings: a. The property contains 10,128 s.f. in area and has 50' in width. b. The lot is substandard in area and width and a residence has existed on the property for many years. c. There is no additional land available to bring the lot width or lot area into confonnity. d. Due to the condition of the existing water supply well, the applicants require a new water supply well. The specific locational constraints of the neighboring wells and sewer lines severely limit the location options for the new well, which impacts the desi�i and location of a replacement home for the site. e. The naiYowness of the lot supports the side setback variance as requested for the 1.5' encroachment into the 10' side setbacic for a length of 7' for the cantilevered bump out. f. The hardcover variances as requested are in line with the levels of hardcover variances approved on rebuild applications with similar lot conditions. The proposed residence meets the number of stories and the lieight requirements as well as the structural lot coverage limitation of 15%. 5. The City Council has considered this application including the findings and recommendation of the Planning �oi�uliission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on tlle health, safety and���elfare of the community. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely seive as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in lceeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-330 to allow construction of a new residence on a property 10,128 s.f. in area and 50' in width where 43,560 s.f. in area and 140' of width are normally required, and to allow a 8.5' side setbacic for a 7' wide cantilevered portion of the home where a 10' side setback is normally required; and a variance to Orono Municipal Zoning Code Section 78-1279 to allow the new home to encroach 1T into the average lakeshore setback and a variance to Orono Municipal Zoning Code Section 78-1288 to allow 248 s.f. of hardcover within the 0 - 75' zone where 0 s.f. is normally allowed, and 2,960 s.f. or 47.1% hardcover within the 75' - 250' zone where 1,570 s.f. or ZS% is normally allowed in conjunction with the construction of a new residence and to allow existing lake yard retaining walls to remain, subject to the following conditions: l. Council approval is based on the site plan submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any ��nendments to the site plan which are not in conformity with City codes will require further Planning Com�nission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 248 s.f. or 6.4%. Hardcover in the 75-250' zone shall be limited to 2,960 s.f. or 47.1% per the proposed building plan, site plan and hardcover allowance suinmary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. The applicants shall subznit an as-built suivey prior to the issuance of a Certificate of Occupancy in order to verify compliance with the approved gradin� and drainage plan attached as Exhibit A. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their penneability as non-hardcover surfaces. 5. Required removals of sti-ucture and hardcover shall be completed by the footing inspection for the new residence. 6. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building pennit for the new construction within one year of the date of Council approval, or the variance will expire on that date (December 11, 2007). 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terniinate any authority granted herein, and shall be punishable as a misdemeanor. 8. The undersigned applicants have read, understand and hereby agree to the tenns of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
