Sec.13.04 RIGH'TS OF SUBJECTS OF DaTA
Subd. I. Type of data. The rights of individual on whom the data is s[ored or to be stored shall be as sec forth in this secrion.
Subd.2. Intormation reqirired to be given individual. An individuai asked W supply private or coafidential data conceraing himself shall
be informed of: (a)the purpose and iatended use of the requesced data within the collecdng state agency,polidcal subdivision,or statewide rystem;

privau or confidenaal data;and(d)che idendry of ocher persons or enrides authorized by state or federal law m�eceive the daa. This requirement shall
not apply when an individual is asked to supply invesdgadve data,punvant to section 13.82,subdivision S, to a law enforcement officer.

Subd.3. Access to data by individual. Upon request to a respoasible auchoriry,an individual shali be informed whether he is the subject
of stored data on individuals,and whecher ic is class�ed as public,private or confidrnaal. Upon his fureher request,an individual who is the subject
of stored private or public data on individuals shaU be shown the data without any charge w him and;if he desires,shall be informed of the contenc
and meaning of d�at data. After an individual has been showa[he private data and informed of itc meaning.the data need aot be disclosed to him for
six months thereafter unless a dispuu or acdon pu[ruant to[his secaoa is pending o�addiaoaal data on the individual has been collecced or creared.
The responsible authoriry shall provide copies of the priva[e'or public data upon request by the individual subject of the data. The responsible authoriry
may tequire the requesdng person W pay the actual cosu of making,certifying,and compiling the copies.
The responsible authoriry shall comply immcdia[ely,if possible,with any request made punuant to[his subdivision,or within five days of
the date of the request,excluding Satucdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot compty with the request
wi[hin that dme,he shall so inform the individual,and may have an addirional five days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private
data conceming himself. To exercise this righG an individual shall noafy in wridng the nsponsible authority describing rhe nature of the disagreement.
The responsible authoriry shall within 30 days either: (a)corrcct the data found ro be inaccucate or incomplete and attempt to noafy past recipienu of
inaccurate or incomplete data,inciuding recipients named by ehe individual;or(b)noafy the individual that he believes the data to be correct Data
in dispute shall be disclosed only if the individuai's statement of disagreement is included with the disclosed data.
The determinadon of the responsibte au[horiry may be appealed pursuant w the provisions of the administradve procedure act relating w
contested cases.
