OS-3146 WHEREAS, Marlc R. Palm and Pamela J. Palm, (hereinafter "the applicants") are owners of the property located at 1447 Parl: Drive within the City of Orono (hereinafter "the City") and legally described as follows: Lot 8, Block 15, Saga Hill Revised, Heiuiepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicants llave submitted an application requesting variances to Municipal Zoning Code Section 78-1288 to pennit 3,372 s.£ (33.6%) hardcover in the 75-250' lal:eshore setback zone where 3,812 s.f. (37.9%) exists and 2,512.5 s.f. (25%) is allowed; to pennit 1,534 s.f. (48.6%) hardcover in the 250-500' lalceshore setbacic where 1,607 s.f. (50.9%) exists and 946.5 s.£ (30%) is allowed; and a variance to Section 78-1436 to permit a 5' setbacic where 15' is required for constntction of a new 25' x 30' (748 s.f.) detached gara�e to replace an existinQ detached garage; and VVHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Plaiuzin� Codes, the Orono Plai�i�ing Commission held a public hearing on October 17, 2005, at which time the PlatuliilQ Commission on a vote of 5-0 tabled the application and directed the applicants to draft a revised plan tl�at would reduce the aarage to 750 s.f. or less, relocate it at a 15' setbacl: fi•om the street and 10' from the side lot line, orient it as side-loading, and provide a ��ading plan for City Engineer revie�v; and VVHER�AS, applicailts submitted a revised plan for an 800 s.f. (25x3?j ;arage 18' from the street lot line and 5' from the side lot line. Planning Commission reviewed the revised plan in Januaiy 2006 and on a vote of 5-0 recommended approval only to the extent of the ?002 approval, i.e. ;araae size less than 750 s.f., �' setback, and hardcover as appro��ed in 2002. The Council reviewed the revised plan on Febniary 13, 20�6 and tabled the application peildinQ submittal of a ne�v plan me-etin� the Plaiuling Coi�lmission recomtnendation; and. This application was reviewed as Zoning File#OS-3146. 2. The property is located in the LR-1B, Single Family Lakeshore Residential Zoning District where 1 acre is the minimum lot size and 140 feet is the minirnum lot width. The lot is 0.39 acre in area and is 47.5' wide at the shoreline, 52' wide at the 75' setback, and 61' wide at the proposed garaQe location. 3. The Plamling Commission reviewed the application for variances and recommended approval by a vote of 5 to 0 based on the following findings and hardships: A. Tlie lot was platted prior to current zoning standards, B, Property factors that malce constniction of a new garage conforming in location difficult include the topography, with a continuous downgrade from the street to the house, with drainage that naturally runs to the property to the west; the narrow lot widlh; ancl the location of an existing boulder retaiiiing wall. A side loading garage will leave a relatively flat area to maneuver vehicles and allow draina�e froin the street to bypass the buildings and house, C. The total distance between tlie new garage and the existing retaining wall will be 22'. A garage meeting the reqt�ired setbacic would only leave 17' which is not adequate for safe backin� of vehicles. D. A garage with direct access t� the street �vould require fill to be brought in to raise the ground elevation and create a flat approach in front of the garage. It �vould not Le feasible to have the driveway continue to s?ope down to the gara�e as winter conditions may cause a vehicle to slide into the building. Additionally, the driveway desi�l needs to be done to ensure that any water would be diverted away froin the buildinQ. Accardiizg to Heiuiepin County plat maps and the survey submitted with the application, there is a portion of Forest Lane (undeveloped) located between this property aizd the lakeshore. It is assumed that this poi-tion of Forest Lane will be combined witli tl�.e applicants' property at soine time in the future. It has served as the lakeshore access for this lot. Other lots in the neighborhood have had Forest Lane vacated and a few lots have comUined that portion of property with the residential site. For current zoning purposes, this lot is Ueing considered a lalceshore lot for setback purposes even though the legal description and property records do not include the vacated portion of the road, This is an importaut distinction for this property because a non-lakeshore lot would not permit an accessory building to be located closer to the street than the house, 4. The City Council finds that the conditions existing on this property are peculiar to it aild do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicauts; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Cotulcil has considered this application including the findings and recorruzlendations of the Plamling Commission, reports by City Staff, comments by the applicants and th� effect of the proposed variance on the health, safety and rvelfare of the conununity. CONCILUSIONS, O1�ER, ANI) CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby �rants variances to Municipal Zoning Code Section 78-1288 to pennit 3,372 s.f. (33.6%) hardcover in the 75-250' lakeshore setback zone tivhere 3,812 s.f. (37.9%) exists and 2,512.5 s.f, (25%) is allowed; to perniit 1,534 s.f. Council approval is based on the site pla�i and building plans submitted by the applicants aiid a►uiotated by City staff, attached to this Resolution as E:chibit A. Any amendments to said plans which are not in conformity with City codes or with this approval will require fitrther Plamiing Commission and City Council review. 2. Hardcover in the 0-75' zone shall not be increased above the current level of 153 s.f. or 4.2%. Hardcover in the 75'-250' zone shall be reduced to and remain no greater than 3,372 s.f. or 33.6%, and hardcover in the 250-500' zone shall be reduced to and remain no greater than 1,534 s.f. or 48.6%, per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are a�lvised that any future requests to increase hardcover or change the nature of approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concunent reduction in existinJ hardcover. 3. Applicants shall remove all plastic or fabric liner material, if any, from the decorative landscape beds on the property to ensure their permeability as non- hardcover surfaces. 4. Required removals of hardcover shall be completed prior to the first inspection for the proposed addition. S. The applicants shall be subject to the recommendations of the City Engineer as noted in Tom Kellogg's letter of October 16, 2006. The �vest or rear foundation wall of the garage shall be extended downward to a depth that eliminates any need for a retaining wall along that 5' setback which �vill allow for the approved grading plan to be accomplished. 6. Authorities granted by this variance approval run �vith the property not with the applicants, but are pemlissive only and must be exercised by application for a building pern�it �vithin one year of the date of Council approval, or these variances � will expire on that date (October 23, 2007). 7. Violation of or non-compliance with any of the tenns and conditions of this a�proval shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
