A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZOlVING CODE
SECTION 10.03, SUBDIVISION 6(A)(1)AND .
SECTION 10.24, SUBDIVISION 5(B) �
FILE NO. 03-2927
WHEREAS, James A. Martinson & Linda M. Martinson, husband �and wife,
(hereinafter"the applicants") are the owners of the property located at 1435 Park Drive within the
City of Orono (hereinafter the "City") and legally described as follows: � ,
Lots 6 & 7, Block 15, Saga Hill Revised, including adjoining vacated
Lafayette Avenue;ALSO that part of vacated Forest Boulevard as dedicated
in the plat of"Saga Hill Revised,Hennepin Co.Minn."Which lies between �
: the northwesterly extensions across it of the northeasterly line of Lot 6,
Block 15,"Saga Hill Revised,Hennepin Co.Minn."And the southwesterly _
line of Lot 7,said Block 15.,Hennepin County,Minnesota
(hereinafter the "properly"); and � ��'
W]HEREAS,the applicants have made application to the City of Orono for a variance
to Orono Municipal Zoning Code Section 10.03,.Subdivision 6(A) and Section 10.24, Subdivision '
5(B) to construct a 3,608 s.f. new residencP �» a lot 0.75 acres i^ :�e� «�here 1.0 acre in area is
required, and 95-100' in width where 140' width is required. •�
NOW, '�'gIEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota: �
FINDINGS �
1. This application was reviewed as Zoning File#03-2927.
2. The properly is located in the LR-1B Zoning District,which requires minimum lot area of 1 acre '
and minimum lot width of 140'. The area of the property is 0.75 acres(32,284 s.f.)and defined ' .
lot width is 95' at the lake and 100'at the 75' setback. ' � �

3. The Planning Commission reviewed this application at a public hearing held on August 18,2003
and recommended approval of the lot width and area variance,based on the following findings:
a) No additional land is available for acquisition by the applicants to make the property
conforming in area or width.
b)� The property is served with municipal sewer.
c) The combination of 2 lots with a total lot size of 0.75 acre is typical of lots in the
immediate neighborhood. '
d) A single family residence can be constructed on the properfy without the need for further
variances.
. 4. The City Council has considered this application including the findings and recommendations of
the Planning Cominission,reports by City staff,comments by the applicants and the public,and
• the effect of the proposed variances on the health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to it and do not
apply generally to other property in this zoning district; that granting the variances would not
adversely affect traffic conditions,light,air nor pose a fire hazard or other danger to neighboring
property;would not merely serve as a convenience to the applicants,but is necessary to alleviate
a demonstrable hardship or difficulty;is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensiye Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
. Based upon one or more of the above findings,the Orono City Council hereby grants
a variance to Orono Municipal Zoning Code Sections 10.03, Subdivision 6(A) and Section 10.24,
Subdivision 5(B) to allow construction of a new 3,608 s.f. residence, subject to the following
conditions: �
1. Council approval is based on the revised site plan submitted by the applicants, attached to
this Resolution as Exhibit A. Any amendments to the site plan which are not in �
conformity with City codes will require further Planning Commission and City Council

2. Hardcover in the 0-75' zone shall be limited to the levels allowed by City Code. Hardcover
in the 75'-250' zone shall be limited to 5418.6 s.f. or 25% per the proposed plan and
hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any
future requests to increase hardcover or change the nature of existing/approved hardcover
shall require City approval, and increases in hardcover will not likely be approved without
concurrent reduction in existing hardcover. � �
3. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds
� � on the property to ensure their permeability as non-hardcover surfaces. �
4. Authorities granted by this resolution run with the property not with the applicants,but are
permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire on
that date(August 25, 2004). � �
• 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall
constitute a violation of the zoning code,shall automatically terminate any authority granted
herein, and shall be punishable as a misdemeanor.
6. The undersigned applicants have read, understood and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and assigns,
hereby agree to the recording of this resolution in the chain of title of the property. .
Adopted by the Orono City Council on this 25th day of August, 2003.
