Exhibit A is a 1992 aerial photograph with property lines and contours overlain. A review of the 2' elevation contours shows a natural drainage way flowing northeast across the two properties. This inap clearly indicates that water from the southern half of the 1423 Park Drive property has historically drained to the northeast across your property at 1415 Park Drive. Exhibit B is a survey for the new house at 1423 Park The dashed contour lines are exisiting conditions and the solid contour lines are proposed contours A review of the proposed contours shows that minimal grading was completed for the new house construction, and the grading was limited to the southern half of the lot. The proposed contours show drainage swales on both the east and west sides of the new house to convey the water past the house. The grading on the lake side of the house did not change the water flow direction, so the water from the swales continues to drain towards the northeast which is consistent with the historic drainage pattern. A recent site inspection by Bruce Vang, Orono Building Inspector, confirmed that the drainage swales are inplace. Exhibit C is the survey for the new house at 1423 Park overlain on the 1992 aerial photography contours. The contours on the building survey correspond closely to the 1992 aerial photography contours and confirm that there was minimal grading completed for the new house construction. A review of the two sets of contours confirms the water from the new house clearly follows the historic drainage pattern to the northeast. Telephone(952)249-4600 • Fax(952)249-461b www.ci.orono.mn.us . The new house at 1423 Park Drive was constructed to comply with the City of Orono hardcover regulations. These regulations are inplace to limit the amount of stormwater runoff from building projects. Drainage swales were constructed on this property to drain the water past the new house, and your house, at which point the water follows the exisiting historic drainage pattern to the northeast. A recent field inspection confirms that there is a draintile system that drains water from the new house to the lakeshore yard with an outlet 10' foot from the property line where the water then continues to drain downhill to the northeast. In your letter you requested that the draintile outlet be directed down the steeper hill towards the lake that is located on the subject property, so as to keep the water on this property. This solution is not desirable because of the steeper slope is more subject to erosion,and it is also a change from the historic drainage pattern. The contours on the attached maps show a historic drainage pattern to the northeast across your property with a relatively flat area at the bottom of the hill, adjacent to the lake, on the northeast corner of your property. It is quite possible that during heavy rainfall events, or wet periods when the elevation of Lake Minnetonka is higher that the lower are of your property could be wet at times. In summary, our position is that the City has taken adequate and reasonable steps to limit drainage impacts related to the new house construction at 1423 Park Drive and has no further legal responsibility in regards to this issue. The intent of the City code is to minimize adverse drainage impacts from projects, and this has been accomplished by conveying the water past the houses to minimize the potential for building property damage. Once the water is past the houses,the existing drainage pattern to the northeast is maintained. The City code does not require altering existing drainage patterns in order to unnaturally force all of the water to stay on a certain property in order to prevent wet areas on adjacent properties. The intent of the code is to protect structures from water damage while maintaining existing drainage patterns. Thank you for your assistance in this matter. Attached is some factual background regarding this issue, together�vith a drawin�which depicts some aspects of the ��vater drainabe issue. As you can see from the enclosed, the Howells recently coi�structed a private drainage system which has the effect of discharging inost of the runoff from their property onto our property. It is our understancling that this �vorl<required a pei-niit pui•suant to City of Orono ordinance Section 53-2, SuUd. 1(b). We also understand that the actions of the Howells canstitutes a misdemeanor puz•suant to City of Orono ordinance Section 58-2, Subd. 1(d) and (e). The purpose of this letter is to request that the City of Orono enforce its ordinance and require that the Howells direct the outlet for their drain tile systern so that it runs do�vn their own hill, lceeping the drainage on thcir own property ratlzer than allo�ving it to dischar�e onto our property. VVe ��vould appreciate a written response from you within the next seven (7) days. Please advise if we should be spealcing to another City official about this matter instead of your office. MN On Friday, June 25`h. 2004, a landscape contractor completed a project, which included chanQinQ the grade in the rear of the house, installina a sizeable cement patio, and i�lstalling drain tile fi•om the fi•ont of the house; around the south end of the house, across the lot, coiu�ectin5 several downspouts around the l�ouse and fiizally exitina near our property line. Every aspect of the proj ect causes additional volume and velocity of water to be directed to our property. This project, combined with greater hardcover fi•om the new (2002) house and several other downspouts on the north side of the house, resulted ii1 nearly 100% of the nuloff directed onto our property. On the 25`�', we spol:e to the landscape contractor and one of the homeowners; we explained that we didn't want the additioizal water drainina onto our property. We asked thenz to extend the drain tile approx. 30 feet and exit down their hill onto their lakeshore—they refiise_d saying that it would cost more money, that"�vater nins dowi�lzill", �nd that we're lucky it's not rnore water. We offered to dig the trench appro�. 30 feet to save them money. Th�y refused. They said they would move the exit so that it would be 5 feet f.rom the property line rather than on the property linc itself. We said we would contact the City of Orono aiter the weel:end. During the week of June 28`�', Jon talked to the Building Inspector, Lyl� Oman. Lyle said "it didn't sound right", that he would check t11e file, and af-ter the Independence Day holiday, that he would checic the site. Shortly after that,�ve received a two inch rainfall. The water drainage was noticeably different than prior to the drain tile installation, and our lakeshore area had standing water for several days, making it unusable for a week. During the week of July 12`�', Jon talked to Lyle. Lyle said that the previous weelc, he sent another inspector to the site, and he did not indicate that anythina was wrong. During the weeks of Suly 19`�'-26°', we sought legal counsel. The conclusion is tliat the landscape project clearly needed a permit, and that the water drainage clearly violates the volume &velocity [58.2(e}]. Durin�the weelc of July 26`", Jon called the Gity to validate if a permit was obtaii�ed for the project—one of the Administrative Support personnel said there was none in the file. The call was transfened to Lyle Oman, he said he remembered the conversation with Jon a couple of weelcs earlier, and that he would checic on the situation.
