A RESOLDTION VACATING AN
UNUS$D PORTION OF FOREST BOOI.EVARD
WITHIN THB PI,AT OF SAGA HII,L REVISED,
SECTION 7, TOWNSHIP 117, RANGB 23
IN THB CITY OF ORONO, MINNSSOTA
WHBR$AS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, on February 26, 1988, Ronald W. Bertagnoli and Sylvia
Bertagnoli filed a petition with the City of Orono requesting the vacation
of a portion of Forest Boulevard originally dedicated in the Plat of Saga
Hill Revised legally described as follows:
That part of vacated Forest Boulevard as dedicated in
the plat of "Saga Hill Revised, Hennepin County,
Minnesota" which lies between the Northwesterly
extensions across it of the Southwesterly line of Lot
3, Block 15, "Saga Hill Revised, Hennepin County, ;
Minnesota" and the Northeasterly line of Lot 2, said
Block 15; and
WHERBAS, after due published and posted notice, a public hearing
was held before the City Planning Commission on March 21, 1988, regarding
said vacation and all interested persons were given an opportunity to be
heard; and
WHER$AS, after due standing and consideration, the Planning
Commission recommended approval of the requested vacation and the Council
of the City of Orono finds that said vacation as proposed, is in keeping
with the public interest in consideration of the followinq findings:
l. The vacation does not affect the access or the use of adjoining
properties.
2. The City has not and does not intend to develop, improve, or use
the dedicated right-of-way of Forest Boulevard for road purposes.
3. The City has not and does not intend to maintain or insta 11
utilities within the dedicated right-of-way of Forest Boulevard.
4. The unimproved dedicated right-of-way as it exists serves no public
purpose.

NOW, THBRBFOR$ B$ IT RESOLVBD, that the petition of Ronald W.
Bertaqnoli and Sylvia Bertagnoli is hereby granted and that the portion of
Forest Boulevard legal ly described above is hereby vacated. The granting
of the petition is subject to the condition that upon vacation, applicants
must combine vacated adjacent portion of Forest Boulevard with their
property (Already combined Lot 3, Block 15 and a portion of vacated Park
Drive, Saga Hil 1 Revised, Hennepin County, Minnesota).
Adopted by the City Council of the City of Orono, Minnesota, at a
regu r meeting held on March 28 , 1988.
