To whom it may concern;
I have approached the city on several past occasions concerning the
ongoing water problem on my property at 1400 Park Drive� Though I
have received no gratification for my problem, I have l�arned so�r!e
i►nportant infor;��ation that implicates the city as negligent, thus
creatir�ig a problem that has steadily gotten worse in past years .
My side property ( see enclosed survey sketch) is t:�,r• drainage holding
area, I have learned, for allrainwater, excess moisture, runoff etc.
for all surrounding home owners . In fact the very slope af Park Drive
was desiyned to carry water to my yard. To be a�le to accomndate thie
much drainage, a culvert was built ; to carry this flow of water from
my side yard, under the road to empty at a public access across the
street and then to the lake.
Because the ci�lvert drained properly, for several years my yard was
dry, and when the home was purchased in 1976, it was secure with no .
signir"_i�.ant structural problems. However, as time went by, I noticed
water b�:ginning to accumu�ate and settle in my yard. I called the
city. I had a suspicion that the pipe under the road had been
crushed as there was a sunken area in my front yard and in the road.
With high pressurehoses being blown into the pipe� they found
that indeed it was not operating. I was informed that in order for �±�
the city to repair the pipe to be functional once again� I would
have to obtain permission from the two bordering home owners on
either side of the access. This is when I learned that the city
had chosen to vacate the public acess at the home owners request.
The once public acess was now privately owned� and of course,
2PrmiGsion to apen the pipe was denied.
Frustration has built steadily year after year� as I misunderstood
the cities responsibility in vacating the access�with�no:�eQ�r���to
the drainage from my property.
My yard has continually gotten worse and my foundation severly
damaged. My front porch has broken away fromn the house and began
to sink into the ground. The whole area is over saturated with no
where for the water to go. My home will not be able to withstand
much more pressure.
It is my feeling that the city cannot put me off any longer. I am
asking the city to correct the drainage problem, fix my property,
and make restitution to me for my foundation and porch.
I am a single parent and pay taxes as the people living across
from me on the lake and own the public access property. The city
has been taxing me on property that is virtually worthless, as it
is unsaleable. �
I contacted John Schoening of Maple Plain at the cities referral,
and after consultation, John advised me that repair of my property

would be to complicated to be repaired at my own expense.
John was the excavater that broke ground for my foundation when it
was built, which at that time the ground was dry.
I will await with interest for your reply or a chance to approach
the city on this matter.
