' r � � � O� O O CITY of ORONO a �+ RESOLUTION OF THE CITY COUNCIL �' 6346 �� �, �,�' NO. �9k'Es8o4� A RESOLUTION APPROVING A SUBDIVlSION OF A LOT LINE REARRANCEMENT AND EXTINGUISHMENT OF THE CONDITIONAL USE PERMIT GRANTED WITH RESOLUTION NO.4836 FILE NO. 13-3640 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council°) has adopted subdivision regulations for the orde�ly, economic and safe development of land within the City; and WHEREAS, James Murphy and Sandra S. Smith, a married couple(hereinafter the "Applicants") are the owners of the property located at 20 Orono Orchard Road Id within the City of Orono (hereinafter"City") and legally described as follows: Lot 13, Block 1, Orono Oaks, Hennepin County, Minnesota (attached) (hereinafter "the 20 ParceP'); and WHEREAS, the Applicants are also the owners of the property located at 30 Orono Orchard Road N within the City and legally described as follows: Lot 10, Bfock 1, Orono Oaks, Hennepin County, Minnesota (hereinafter "the 30 Parcel"); and WHEREAS, the Appficants have submitted an application for a lot line rearrangement involving the 20 Parcel and the 30 Parcel which would relocate the lot boundary line between the properties; and WHEREAS, in July 2002, Resolution No. 4836 was adopted by the City Council and granted approval to the 30 Parcel for the keeping of 3 horses on the 30 Parcel where adequate pasture acreage to support 3 horses did not exist; and WHEREAS, after due published and maiied notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on the lot (ine rearrangement on November 18, 2013 at which time all persons desiring to be heard concerning this appfication were given the opportunity to speak thereon; and . Page 1 of 3 � � t � � O� O O CITY of ORONO � �,� � RESOLUTION OFLT�E�ITIf COUNCIL '� � � C,'�'� NO. v 6 � ��kEBH��'� WHEREAS, the Orono City Council reviewed the proposed lot line reaRangement at a regular meeting held on November 25, 2013 and makes the following findings with regards to the proposed lot line rearrangement: FINDINGS 1. This application was reviewed as Zoning File #13-3640. 2. The 20 Parcel contains 2.05 total acres of which 0.83 acres is dry buildabie land; and the 30 Parcel contains 3.69 total acres of which 3.56 acres is dry buildable land. 3. The 20 Parcel contains a smail home and detached garage. This property was recently connected to City sewer. 4. The 30 Parcel is served by a private septic system and contains an existing home and a bam. 5. This application contemplates a lot line rearrangement to move the common lot line between the 20 Parcel and the 30 Parcel east 98 feet resulting in transferring 0.56 acres of dry buiidable land and the barn from the 30 Parcel to the 20 Parcel. 6. Following the lot line rearrangement the 20 Parcel will have 1.39 acre in dry buildable area, and the 30 Parcel will have 3.0 acres in dry buildable area. 7. Resolution No. 4836 granted a CUP to the 30 Parcel to allow the keeping of 3 horses where there was insufficient dry acreage available for pasture base on City code requirements. 8. As a result of this application the legal description of the 30 Pa�cel will be modified. The 30 Parcel will no longer meet the conditions outlined within Resolution No. 4836. Therefore Resolution No. 4836 shall be extinguished. 9. Because this is a fot line rearrangement which results in no additional fots, no park fee or stormwater trunk fee will be required. 10. Dedication of drainage and utility easements along the new common lot fine are to be granted as shown on the survey dated 10/17/13 and revised 10/20/13. Page 2 of 3 . � O� 0.,,. ";{,r���;;_ �� RESOLUTION OF6T��1T6Y COUNCIL '� ���� G NO. ��� 6 �►�1���`g� �ESH� CONCLUSIONS, ORDER AND CONDITIONS NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot line rearrangement of the above referenced properties based on the lot line rearrangement survey dated 10/17/13 and revised 10/29/13 by Gronberg and Associates, Inc., attached as Exhibit A; and hereby extinguishes the CUP granted to the 30 Parcel via Resolution No. 4836, subject to the following conditions: - 1. The Applicants shall file the appropriate deeds reflecting the new legal descriptions (subject to City Attorney approval) with the Hennepin County Recorder's Office andlor Registrar of Titles Office on or before November 25, 2014, or the approval granted by this resolution shall expire. 2. The Appficants shall grant drainage and utility easements along the new common lot line are to be granted as shown on the survey dated 10/17/13 and revised 10/20/13.
