General Instructions:
1. You may be required to obtain other permits, i.e.: well abandonment, sewer, etc.
2. Work must not begin unless the permit card is available on the job site.
3. A 24-48 hour notice is required for all inspections. Call (952) 249-4600.
4. Sewer must be discontinued at the City service by qualified contractor before demo permit is issued.

In return for issuance of said Demolition Permit, the undersigned owner hereby agrees to:
1. Submit a survey, aerial photo or sketch showing all structures on the property. Note which
structures are to be demolished.
2. Submit a survey, aerial photo or sketch showing proposed erosion control measures in
accordance with Chapter 79, Construction Site Runoff Control.
3. Submit a $2,000 escrow and an escrow agreement signed by the property owner.
4. Keep all structure(s) enclosed and/or secured until such time as demolition is complete.

5. Keep all demolition debris off adjoining properly and/or the public rights-of way unless specific
prior approval is obtained in writing for temporary use thereof.
6. Completely remove foundation(s) from the ground.
7. Completely dispose of all demolition debris off site in accordance with all applicable PCA
requirements.
8. Abandon water wells in accordance with State Health Department regulations.
9. Call for an inspection when all debris has been removed, before backfilling.
10. Within 5 working da.ys of superstructure removal, a fmal inspection shall be requested. The site
shall be left clean and clear of all debris, with any excavation filled with earth level with the
adjacent ground elevation (except when such excavation is to be used as part of a new building
and such new building is actually under construction).
11. Abandon septic systems per Minnesota Rules Chapter 7080. All septic tanks must be pumped,
crushed and filled with native soils. An inspection is required after the tanks are pumped and
before the tanks are crushed and filled.
12. The undersigned owner shall and hereby does indemnify and hold harmless the City of Orono, its
agents, employees and assigns from and against all claims, damages, losses or expenses,
including attorney fees, against the City, its agents, employees and assigns arising out of or
resulting from the demolition described herein as performed by the property owner, his
employees, agents, subcontractors or assigns.

Principal Dweiling Demol[tion Permit
��� ZONING DISCLOSURE & DECLARATION
To the property owner: Demolition of the principal dwelling structure on a property may automatically terminate certain
rights which rnay have accrued to the property by virtue of the continued existence of that building.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot area or width
standards) will, with few exceptions, require variance approval by the City Council, and such approval is neither
automatic nor guaranteed but requires that a hardship be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including setbacks, lot
coverage by structures, hardcover(impervious surtace), height limits, etc.
• Where municipal sewer is not available, provision of two(2}sites for a conforming on-site sewage treatment system is
mandatory.
• Unless speci�ically approved by the City, all accessory structures must be removed at the time of principai dwelling
demolition. This also applies to seasonal and permanent docks, which may not be re-installed until a new principal
dwelling has reached the framing stage.

Demolition Permit #2012-00527 pertaining to 495 Oxford Road is complete. The applicant
submitted a new escrow and signed escrow agreement in conjunction with the construction of
a new home (2013-00007), therefore the demolition permit escrow can be refunded. Please
refund $2,000 to Michael &Anne Sample.

ESCROW AGREEMENT

AGREEMENT made this /7 day of �UNr , 20 �� by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City")and Michael &Anne Sampls("Owners").
Recitals
9. An app(ication for a demolition permit has been filed for an accessory structure located at
495 Oxford Road ("Subject Property"}legally described on attached Exhlbit"A".
2. In con}unction with the demolition erosion control measures are required as shown on attached
Exhibit"B°.
NOW,THEREOFRE�THE PARTIES AGREE AS FOLL�WS:
1. DEPOSt7'OF E3CRt3W FIfNDS. Contemporaneously with the execution of this Escraw P`qresment,
the Owners shali deposit$2,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
C1ty for its cost in administerfng the escrow accounf.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for
all out-of-pocket costs (including planning,eng9neering, or legal consultant review)the Ciry has incurred to assure that
the erosion control measures are instailed and mair�tained so the property complies with the provisions of Orono City
Code Chapter 79. The financial securlty may also be used by the City to eliminate any hazardous conditlons
associated with the work and to repair any damage to public property or infrastructure that is caused by the work. if
compliancs with the approved Land Dlsturbance Permlt is not accomplished within the allowable time period, the Clty
may bring the project into compliance by use of the securiry.
3. RIGIfT OF ENTRY. The Owners hereby grant the City, its ageMs, empioyees, officers and
contractors the right to enter the property to perform all work and inspections deemed appropriate by the Clty in
conjunction with the required erosion control measures, including but not limited to constructing or completing any and
all of the agraed upan improvements should the Owners' contractor not complete those improvements by the date
specified herein.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City wifl in tum
send a biil to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'receipt
of bill.
4. DISBURSEMENT FRC?M ESCROW ACCOUNT. In the event that the Owners do nof make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. Any remaining amount of the �nancial security deposited with the City for
faithful performance af the plans and speciflcations and any related remedial work will be released af#er the
completion and inspectivn of all such measures and the establishment of finai stabilization for the Subject Property.
6. CER'FIFY UNPAID CHARGES. If the projsct is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

The City is in receipt of your.demolition permit application which was received by this office on
June 13, 2012. The following items must be submitted in order for your application to be considered
complete and for the review to continue:
1. Zoning Disclosure 8 Declaration. Attached is a Zoning Disclosure and Declaration form.
This form must be signed by the property owners and retumed.
2. Demolition Permit. Please submit required items 1 and 2 as listed on the demolition permit
application.

3. Demolition Escrow 8� Escrow Agreement Demolition permits require submittal of an escrow
and an escrow agreement. The purpose of the escrow is to guarantee conformance with City
Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for
this project is $2,000. The escrow agreement is enclosed. The property owner must sign the
escrow agreement and submit a check for$2,000.

AGREEMENT made this 1� day of�P*��t+-�1 , 20 i 3, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Michael &Anne Sample ("Owners").
Recitals
1. A building permit application has been filed for a new sinale family residence and detached
ar4 aQe located at 495 Oxford Road the ("Subject Property"), legally described as Lot 3. Block 1. Stielows
Addition. Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with bullding permit #2013-00007 if compliance with the
approved building permit is not accomplished. ,
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
