Violation of: Orono Municipal Code 10.22, Subdivision 3 and 10.56, Subdivision 16 I 2
Description of Violation: The defendant removed live trees greater than 6" in diameter
and cleared intensive vegetation in a protected 75' setback
zone from the lake.
The defendant pled guilty on September 12, 1990 to charges
of excavating within a flood plain, excavating within the
protected 75' setback zone and excavating in the lake shore
without City Council approval at his previous residence_
Inspector: Lyle Oman, Building Official
The City's objective is to fine the defendant and bring hi.m before the City Council and
require him to conform to an approved replanting schedule.

2. Intensive vegetation clearing within 75 ,�,
�_"�' � feet of the shoreline and on steep slopes within the Shoreland ��>
�`r Overlay District is prohibited. Limited clearing of shrubs and
� trees less than 6 inches in diameter and cutting, pruning and
trimming of trees of any size is allowed to provide a view to the
water from the principal dwelling site and to accomodate the
placement of permitted: s;tairways and landings, picnic areas, access
paths, beach and watercraft access areas, and permitted lock boxes,
provided that the screening of. structures, vehicles or other
facilities as viewed f rom the water, assuming summer, leaf-on
conditions, is not substantial ly reduced. �
J. Topographic Altera io
1. -Grading and filling and ex avations
necessary f or he construction of structures, sewag treatment
systems, and dri ways under validly issued constru tion permits
for these f acilit ' es do not require the issuance of a separate
grading and fill.in permit. However, all gra 'ng and filling
activity approved pe 'ts fnr construction of ructures, sewage
treatment systems, and • riveways shal 1 adher �to the grading and
filling standards of this ection. �
2. G��ding, filli�ng and excavating is
prohibited within 75' of th Ordinary ,,High Water Level of the
public waters enumerated in Su ivision of this section. -�,

3. Public n private roads, driveways, `'"
parking areas, and public or priva� watercraft access ramps shall
not be constructed within 75' of t Ordinary High Water Level of
the public waters enumerated in bdi ision 7 of this section. If
no alternatives exist, such im ovem ts shall be subject to the
standard zoning variance revi proced e, and such review shal 1
take into account the followi�g' considera 'ons:
a. Such improvem ts shall be designed
to take advantage of natu al vegetation and pography to achieve
maximum screening from v' w from public waters.
b. Al1 roads and parkin areas shall be
designed and constru ted to minimize and control er ion to public
waters consistent with the reguirements of all a ncies with
jurisdiction. �

SEC. 10.23. LR-lA ONE FAI�LZLY I,ARESHORE RESIDENTIAI, DISZ'RICT.
Subd. I. Purpose. The "LR-IA" One Family Lakeshore
Residential District is intended to provide a district which will
allow a combination of Iow density residential development and
limited agricultural activity. Planned residential developments
may be all.owed by conditional use permits. The propased land use
may not endanger the quality of storm water runoff into Lake
biinnetonka or Long Lake. Because of the location of the district
near Lake Minnetonka or Long Lake, special regulations are
� necessary to pratect those natural resources from the effects of
dense devel.opment. � -
