Chief Farniok suggested that we send by mail the enclosed notice and that he would put it in their file for future reference, since "no trespassing" signs have previously been torn down. When I discussed this with Mr. Gaffron at the Village Hall he indicated that the city also had a file concerning this issue. Would you please add the enclosed copy of the notice we sent to your file. The use of your property by residents of Eastlake Street is a problem that apparently goes back many years, and it may be difficult for you to ultimately resolve. I understand that you have discussed trespass laws and their enforcement with Police Chief Melvin Kilbo. I have incorporated his comments regarding trespass below. Regarding the possibility of construction of a fence, a number of criteria apply: 1. No fence is al lowed to be constructed within the City's Conservation and Flowage Easement, described as the drainage easement in the western triangular area of your property (see attached plat) . 2. No fence can be constructed within 75' of the normal shoreline of the lake (elevation 929. 4 ' ) . 3. The flood plain and wetlands ordinance also technical ly requires a 26' setback from the creek for any fence or other construction (see code sections attached). 4. The fence must be within your property boundaries. 5. The fence may not extend past the "average lakeshore setback line" which is defined as a line between the adjacent lakeshore properties on either side of you. 6. Dennis Shaw, 405 Oxford Road April 19, 1990 Page 2 of 3 7. A fence that meets the above requirements would not need a permit. Given the above code requirements, I have sketched on a copy of your survey the possible location for a fence along your north property boundary that would meet code requirements. Obviously, that fence only extends to the end of the second house from the east end of Eastlake Street, and it appears that most of the activity is taking place on the west end. Since no fence would normally be allowed in that area, you might consider making a variance application to the Planning Commission and City Council, and attempt to convince those bodies that a fence along the creek would be appropriate. In reference to the bridge on your property, Chief Kilbo suggests after checking with your attorney, that you send a letter to the owner of the bridge that is encroaching on your property, giving him or her a reasonable time to move it. If it has not been moved in that time period, you could then remove it from your property. It certainly appears to be within the City's authority to require the removal of any new bridges placed across the creek, merely on the basis that we wouldn't allow any new such structures in a protected f lood plain/wetlands area. However, for the City to require removal of any pre-existing bridges of unknown age might be technically a little more difficult, such bridges coming under the definition of non-conforming structures. From a Zoning Department standpoint, un less we see dumping activity actually occurring, upon complaint we are generally required to deal with the owner of the property on which the dumping is taking place. Hence if you were to complain to us about junk being placed on your property, we probably would have to request that you clean it up, which doesn't solve the underlying problem. Regarding littering, however, Chief Rilbo indicates you should post your property "No Dumping" so that people are aware of it. Further, you must post your property with signed notices of "No Trespassing" at least on both ends and the middle of your property line. If there are names on the debris on your property or violator can be identified, a charge can be brought against the person responsible. �• 'r -. As you discussed with the Chief, certain persons enter our property daily such as newspaper delivery, mailmen, other delivery persons and they are not trespassing until signs are posted and the property owner or his or her agent is there to tell them to leave.
