NO. 4 5 R' A RESOLUTION GRANTING VARIANCE (%' '"' '' TO MUNICIPAL ZONING CODE +..-- I SECTION 10.03, SUBDIVISION 15 (C), FILE NO. 03-2878 WHEREAS, Edward H. Hamm*, (hereinafter "the applicant") is the owner of the property located at 485 Orono Orchard Road South within the City of Orono(hereinafter"the City") and legally described as follows: Exhibit A attached,Hennepin County, Minnesota(hereinafter"property"); and WHEREAS,the applicant has applied to the City for a variance to Municipal Zoning Code Section 10.03,Subdivision 15 (C)to permit a 7' monument and gate at the driveway entrance to be constructed within the 50' front yard street setback where a monument and gate of 3 '/2 feet is allowed; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on March 17,2003,at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#03-2878. 2. The property is located in the RR-1B Zoning District, where 2.0 acres is the minimum required lot area. The property consists of approximately 21+ acres. 3. The Orono Planning Commission reviewed this application on March 17, 2003 and recommended approval by a vote of 5 to 0. Page 1 of 5 0 0 CITY of ORONO 6 RESOLUTION OF THE CITY COUNCIL 4. The Planning Commission made the following findings of fact: A. The proposed structure includes entry monument and gate on either side of the driveway entrance to the property. B. The proposed monument and gate structure at the drive entrance will allow adequate width for emergency vehicles access. C. The entrance monuments and gates are in character with the neighborhood. D. The property is in an area where the general development is consistent with other properties in the locality. The relationship of the property is unique because of the property being 21.4 acres in size. E. The hardship that supports the variance includes the need for security and limitation of foot and automobile traffic onto the private property. The height variance is necessary to allow construction of a structure of a size and scale to be a deterrent in itself. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions,light,air,nor pose a fire hazard or other danger to neighboring property;would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicant and the effect of the proposed variances on the health, safety and welfare of the community. NO. 4 9 11.i: ?°d variance to Municipal Zoning Code Section 10.03,Subdivision 15(C)to permit a 7'monument and gate at the driveway entrance to be constructed within the 50' front yard street setback where a monument and gate of 3 V2 feet is allowed. Approval is subject to the following conditions: 1. Maximum height of the entrance monuments shall be 7', per the proposed plan shown in Exhibit B. Any changes will require further Council review. 2. Any lighting associated with the structure shall be directed downward so that the source of light is not directly visible from neighboring properties. 3. Authorities granted by this variance run with the property not with the applicant,but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (April 14, 2004). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understands and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property.
