§ 10.03
Subd. 15. Non-Encroachments. The following shall not be considered to be
encroachments on yard requirements:
A. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental
features,mechanical devices,cornices,eaves,gutters and the like,provided they do not extend more
than 1-1/2 feet, off-street parking except as hereinafter regulated.
B.Name plate signs for one family dwellings;lights for illuminating parking
areas, loading areas or yards for safety and security purposes,provided the direct source of light is
not visible from the public right-of-way or adjacent residential property may be located to within five
feet of the front lot line.
C. Fences which do not exceed 3-1/2 feet in height, fences not over 6 feet in
height along the street lot line of lake frontage lots which front on a major thoroughfare, if fill is
required,the total combined height of both fence and fill shall not exceed 6 feet above the height of
the crown of the road,terraces, steps,uncovered porches,stoops or similar structures,which do not
extend above the height of the ground floor level of the principal building and extend to a distance
of not less than 2 feet from any lot line.
D. In side or rear yards only, bays not to exceed a depth of 2 feet nor to
contain an area of more than 20 square feet,fire escapes not to exceed a width of 3 feet, fences and
walls not to exceed a height of 6 feet above original grade and open off- street parking except for
lakeshore lots,no fence or wall over 42 inches but not in excess of 72 inches in height above original
grade may be located closer to the shoreline than the average distance from the shoreline of existing
residence buildings on adjacent lots, such fences shall not be constructed within 75 feet of the
shoreline.
E. Rear yard only; balconies, breezeways, detached outdoor picnic shelters
and recreational equipment except as regulated hereinafter; no accessory structure shall be closer
than 5 feet from a rear lot line nor shall a fence or wall constructed within a rear yard exceed a height
of 6 feet above original grade.
F.Side yards only;no accessory structure shall be closer than 10 feet from any
side lot line nor shall a fence or wall constructed within a side yard exceed a height of 6 feet above
original grade.

§ 10.02
75. "Use-Principal" - The main use of land or buildings as distinguished from
subordinate or accessory uses. A "principal use" may be either permitted or conditional.

76. "Yard" - A required open space on a lot, which is unoccupied and unobstructed
by a structure from its lowest ground level to the sky except as expressly permitted in the Zoning
Chapter. A yard shall extend along a lot line and at right angles to such lot line to a depth or width
specified in the yard regulations for the district in which such lot is located.

76(a). "Yard Requirements" -Those requirements which relate exclusively to the size
of yard areas when such are required within specific zoning districts.

77. "Yard,Front" - A yard extending across the front of a lot between the side yard
lines and lying between the front street line of the lot and the required front yard setback line,which
front yard shall be provided on both street frontages of corner lots and double frontage lots. A
lakeshore lot shall not be considered as having a front yard,but rather shall be considered as having
a lakeshore yard on one side of the building and a rear yard on the other side of the building.
78. "Yard,Lakeshore" -A yard lying between the natural ordinary highwater mark on
the lakeshore and the required lakeshore setback line, for the full width of the lot.
79. "Yard, Rear" -A yard lying between the required rear yard setback line and rear
line of the lot, for the full width of the lot. On a lakeshore lot,the rear yard shall be the yard which
fronts on the street lying between the street line of the lot and the required rear yard setback line.

80. "Yard-Side" -A yard extending along the side lot line between the front and rear
yards,having a width as specified in the yard regulations for the district in which such lot is located.
81. "Yard-Side Street" - A side yard abutting a side street.

§ 10.28
A. Uses. Any conditional use as regulated in the "R-1A"District except for
"Duplex Credit" and "Animals".
B. Farms (Stock). Provided that the area is ten or more acres.
C. Hospitals,Etc. Hospitals for human care,sanitariums,rest homes,nursing
homes,provided that all buildings are located 100 feet or more from the lot line of any abutting lot
in an"R" District. The site shall contain not less than 600 square feet of lot area for each person to
be accommodated.

D. Libraries. Non-profit libraries provided that all buildings are located 50
feet or more from the lot line of any abutting lot in an "R" District. Screening and signage
requirements shall be determined with each individual conditional use permit.

Subd.4.Accessory Uses.Within any"RR-1B"One Family Rural Residential District,
the following uses shall be a permitted accessory use:
A. Any accessory use as regulated in the "R-1A" District and "Animals" as
regulated in Section 10.20, Subdivision 3, Subparagraphs M and N.

Subd. 5. Area, Height, Lot Width and Yard Requirements.
A.Height.No structure or building shall exceed 2-1/2 stories or thirty feet in
height except as provided in Section 10.75.
