Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 January 18, 1994 Mr. Alan McDowell Hand Delivered to John McDowell Re: 385 Orono Orchard Road South Dear Mr. McDowell: In regard to your questions on the current and future buildability of Lot 1, Block 1, Smith Dettloff Addition (385 South Orono Orchard Road), I would make the following comments: 1. The property according to City records is approximately 2.7 acres in total area, of which approximately 2.6 acres is dry buildable land, meeting the 2 acre minimum dry buildable requirement for a single family residence building site in the RR-1B Single Family Rural Residential Zoning District. 2. Primary and alternate drainfield sites sufficient to support a four bedroom house have been tested and shown to be acceptable to the City for mound sewage treatment systems under the current City codes. 3. The property appears to be of sufficient shape and size such that the existing residence on the property could be removed and a new four bedroom residence constructed meeting the 50' front and rear and 30' side setback requirements of the zoning code. 4. No municipal sewer or water utilities are currently planned or proposed for the site. 5. I assume you are aware of the driveway easement crossing the property to provide access to Lot 2. 6. Given the above information, and absent any information suggesting to the contrary, this appears to be a buildable site under the current zoning code. The City cannot and will not guarantee that a specific piece of property will henceforth be "buildable" under all future zoning codes. While no changes to minimum required lot area, for instance, are currently proposed nor anticipated, if such did occur the property owner would likely be allowed to formally request a variance. However, in answer to your question "can the buyer of this property be assured that if, five years from now, he wishes to tear down the existing house and put up another one, that the lot will be buildable?", there is no absolute guarantee.
