Dear Ms. Raiche:
This is a reminder that a recent inspection revealed that your
septic system is failing and must be repaired.
Please contact me as soon as possible to discuss your options.
You have until August 3, 1992 in which to make repairs to the
system. Enclosed is a copy of your most recent septic report.
The procedure for initiating septic system repairs is as follows:
1. Hire a Soil/Site Evaluator to do the necessary testing
and design.
2. Submit the design to the City for approval.
3 . Once the design is approved, have one or more
contractors bid on the approved design.
4. The contractor you choose should then obtain a permit
from the City before starting work, and he will call
for the required inspections.
If you have any questions please contact me at the City offices.

to treat waste properly and must be repaired.
On at least two separate occasions you have been sent
notifications of the required septic system repair and a August 3
deadline has been established. We still have not received any
indication that repairs have begun. Unless a repair permit is
issued or a repair schedule approved by August 3, 1992, we will
turn this matter over to the City Attorney.

Re: Septic System Repairs
Dear Ms. Raiche:
As you know the City of Orono has an inspection program for on-site
septic systems. Each septic system is inspected every other year in
order to determine system conformity, tank condition, drainfield
condition, limiting site factors, and potential for system failure.
The inspection report will include a determination of the system's
conformity based on current Minnesota Pollution Control Agency
regulations and City of Orono Municipal Codes, request maintenance, if
necessary, or require septic system repair or replacement when the
system is not functioning properly.
Your septic system was inspected April 3, 1992 at which time the
drainfield was observed discharging effluent to the surface and a
notice was sent requiring septic system repair or replacement within
ninety days of this inspection. Since then, two additional notices
dated June 5 and July 2, 1992 have been sent as a reminder of the
required septic system repair. Several telephone contacts have also
been made to clarify any questions regarding the procedure for the
septic system repair.
At this time, the deadline for the required septic system repair has
been extended one month in order to give you adequate time to initiate
septic system repair. We still have not received a site
evaluation/system design for the septic system repair/replacement.
Surface discharge from the septic system poses health risks and must
be remedied as soon as possible. We have been very patient in
allowing an extension and no progress has been made yet to repair the
system. An additional fifteen days will be provided for you to retain
a licensed site evaluator system designer so that the septic repair
replacement can be made.

The site evaluator/system designer may be any person of your choice
who is in the business of site evaluation and septic system design and
can meet the following requirements: Site evaluators/system designers
must be licensed by the City of Orono according to Municipal Code
Section 5.38. Licensure requires a license fee be paid to the City, a
current Individual Sewage Treatment Systems Site Evaluator and Systems
Design Certificate issued by the Minnesota Pollution Control Agency
and approval by the City Council.
A formal complaint will be filed on September 23rd if a licensed site
evaluator/system designer is not retained by the owner on or before
September 22, 1992. Confirmation may be made in writing or verbally
from the contractor.
We will continue to work with you and assist in any way possible.

Dear Mr. Raiche :
The purpose of this letter is to explain the necessary steps to
repair your septic system and establish a time table for the
completion of the required repair.
Your septic system was observed discharging effluent to the surface
in April of 1992 at which time repairs were requested. Since then
we have had several communications to discuss your options and the
steps required for the repair of your septic system. A report
submitted to us on December 21, 1992 from S-P Testing, Inc.
indicates that a pressurized mound system may be possible but
several limitations exist. Some mottling is present at a depth of
12" in a portion of the proposed mound site, which is the minimum
acceptable by City and State of Minnesota codes . A wetland is also
present approximately 60' from the proposed site which, based on
City topographic information, has potential for flooding. This
site does, however, meet the Minnesota Pollution Control Agency
Standards Chapter 7080 . The City would require a variance to the
75' setback required for wetlands, but staff would likely approve
such a variance if the potential flooding can be addressed and no
other significant limitations exist .
At the time the soil testing information was submitted to the City,
you indicated your interest in requesting the City Council to grant
a Comprehensive Plan Amendment for hookup to the City sewer. In
order to present this request to the City Council, staff would ask
that we arrange an additional meeting with you and your site
evaluator to address the limitations of this proposed drainfield
site as well as investigate any other possible drainfield sites on
your property. More complete soil boring and percolation test
information will be required for the installation of an on-site
system or for use as evidence that a hookup to City sewer is
necessary.
In order to assure timely repair of the failing septic system, the
following time table has been established:

- Completed soil testing information submitted to the City by
July 1, 1993 .
- A septic system repair permit application or Comprehensive
Plan amendment application must be submitted to the City
on or before August 1, 1993 .
- If a Comprehensive amendment is requested, a permit for
hookup to the City sewer or for the installation of an
on-site system must be issued by September 1, 1993
depending on the Council ruling.
As we have not spoken in a while, I would like to again explain the
City' s position on granting amendments to the Comprehensive Plan
for hookup to City sewer. The City will only consider an
application for such an amendment if there are no suitable options
for sewage treatment on the property. Financial considerations are
not a valid excuse nor is it likely that the connection to City
sewer will be less expensive than the cost of installing an on-site
system. The application for the Comprehensive Plan Amendment to
hookup to the City sewer system would require soil test information
showing the parcel unsuitable for an on-site system. In addition,
engineering would be required to show that hookup to the City sewer
is feasible . The cost of the application is $300 . 00 which is not
refundable if denied.

have been difficult to complete last summer. For this reason we did not send additional notices.

separate occasions, a June 15, 1994 repair deadline has been established. Unless the repair
permit is issued by this date, we will be forced to turn this matter over to the City Attorney.

Code violated: Chapter 12, Ordinance 199, Subd. 4, B, 1 c; "A failing ISTS that is discharging
sewage to the surface must be connected to municipal sewer within 90 days".
Background: We gave the individual until June 1, 2001 to get connected to city sewer. This
was a final attempt to get the property hooked up without taking any legal action. I inspected the
property on June 14, 2001 and the septic was still discharging to the surface of the ground. I
have not been contacted by the Raiches' and we do not have a permit to connect to city sewer
yet.
Action Requested: Please start legal action to get the Raiche's hooked up to city sewer.

Background: This property has had a failing septic system since 1992, (we have documented
pictures). At that time they wanted to know if city sewer was an available option. At that
time city sewer was not an option. The city gave property owner until the next year to
see if city sewer would ever be an option. The septic system was let to slide with several
deadlines for action but all of them and passed without any action taken. In 1998 city
sewer was available and a deadline of December 31, 1998 was set to get the property
hooked up to city sewer. Another letter was sent in February 2000 to get the property
hooked up to city sewer by September 1, 2000. The property still has not hooked up to
city sewer.
Action Requested: I would like you to send this individual a letter stating he has until June 1,
2001 to hook up to municipal sewer. If he is not hooked up by this date legal action will
be taken. This violation is an immediate health risk and must be dealt with as soon as
possible. Permits must be obtained and a SAC charge of$1150.00 must still be paid.

Dear Ms. Raische:
According to our files, the above described property was required to connect to the municipal
sewer system no later than December 31, 1998. Our files indicate that the Sewer Availability
Charge(SAC) fee has not been paid. The SAC fee must be paid the year of the connection and
prior to issuing a permit for the sewer hookup. The SAC fee for the year 2000 will be
$1100.00. A licensed plumber must then obtain a permit from the City at a cost of$35.00 to
make the connection from the residence to the actual sewer line.
Your residence is required to connect to the municipal sewer system no later than September 1,
2000.

Scott:
I just spoke with the owner of 280 Orono Orchard Road S. She wants to subdivide
her property. She says when they connected to sewer in 2001 their contractor
extended a public sewer line from Woodhill Avenue south to the middle of their
property and then ran a service into the house from there. This was done so they
could subdivide someday.
There is nothing in the street file on this. She said will get me the information from
her file.
