I have not heard from you and hope that you are working on the list of outstanding items which you agreed to provide as part of your Certificate of Occupancy, listed below: 1. Finalization and maintenance of the required wetland buffer according to the approved plan and permit; 2. Finalize(sign and execute)the Minnehaha Creek Watershed District's(MCWD)declaration and covenants for the wetland buffer on the property;and 3. Grant an easement to the City of Orono for access to and maintenance of the drainage structure and pipe on your property. Please find the following attached for your convenience: • The signed agreement dated 09/22/16 regarding the above outstanding items containing your authenticated digital signatures. • The MCWD Declaration requiring your signatures. Note:There are instructions to assist you in completing the form. Please reference the attached survey,submitted by the applicant(your builder)which depicts the wetland buffer to be declared. Also attached is the MCWD permit which contains the conditions for the permit issuance.According to MCWD's Wetland Protection Rule Section 5(c),which this project is subject to,wetland buffers must be declared to the property through the county. This requirement was also detailed as a condition for the issuance of your MCWD permit. By signing the MCWD permit application form,you via your builder,agreed to follow all conditions of the rules your project triggered including declaring the wetland buffer. • The Easement granting the City access to the stormwater structures on your property. All that is required is your signatures on the attached documents,and proper seeding of the wetland buffer area.The City and the MCWD will record the documents and properly close out your open files. Please sign the attached documents before a notary and return the originals to the City for recording by or before June 30, 2017. For your convenience the City has a notary on staff. Please be advised,failure to comply with the agreed-upon conditions is a violation of the Certificate of Occupancy and the City will begin the process with the City Attorney to revoke the Certificate of Occupancy. This CO was issued at the request of your builder despite the fact that there were still three outstanding issues.At that time you agreed to complete the three outstanding issues listed below: 1. Finalization and maintenance of the required wetland buffer according to the approved plan and permit; 2. Finalize(sign and execute)the Minnehaha Creek Watershed District's(MCWD)declaration and covenants for the wetland buffer on the property;and 3. In reviewing the file, it appears that to date none of the above agreed upon items have been completed. Attached please find the following: a.
