As of this date the permit h s not been issued. A variance to th zoning code was granted on November 13 , 1990. Conditions of he variance were that a building permit be issued, deck located ess than 10' from the lot line was required to be removed, and 66 square feet of hardcover was required to be replaced with sod. Violation of this approval is punishable as a misdemeaner. Therefore the City must require you to do the following: 1. Obtain the blilding permit. 2. Remove decki g within 10' of the property line. 3. Remove hard over as required by approval resolution (attached) . I 4. Arrange an inspection and make any required inspections. If these items ave not been completed by July 15, 1991 citations will be is ued and you will be required to make a court appearance. I knocked on the •oor and met with Mrs. Everson and explained to her by I was there and she stated that her husband Garry was out of town and she inquired if the warrant was a war ant for a permit violation and I explained that it was. In -peaking with her, it was determined that the citation had • -en issued with the wrong spelling of the last name (Iverso' , Gary) . The correct name was Garry Richard Everson. ,he stated that her husband had been up to Ridgedale on 5 or 6 different occasions in an attempt to satisfy the citati.n, however, each time Ridgedale court indicated that the, had no record of him. Mrs. Everson stated that the or. ginal citation probably had not been reduced at Ridgedale court at this time. The citation would have had a number •n it, which would have enabled the courts to obtain the diff-rent spelling of the last name and the first name . I would make the following specific comments regarding information shown on that survey: 1. The survey v- rifies that the wood deck for which the applicant was cit-d, is not in the 0-75' protected lakeshore setback zone. • 2. It is unclea from the survey whether the deck extends into the average lakeshore setback zone. No new construction is allowed to encroach toward the lake past a line drawn betw=en the lake sides of existing residence structures on ei .her adjacent property. (Reference Zoning Code Section 10.2 ' , Subdivision 1 (B), attached.) 3. The wood deck has been constructed over the lot line and onto the neighbo' ing Walter Krahl property to the west. Zoning Code Sec .ion 10.03, Subdivision 15 (C) , the non- encroachment sectCon, notes that a grade level deck cannot extend closer ' han 2 ' from any lot line, and a deck structure that i above grade level so as to not meet the criteria for a g . ade level deck, would have to meet a 10' side setback in he LR-1B zoning district in which this property is locat-d. 4. The final cri ical issue with this wood deck is that it increases the al .eady excessive hardcover on the property. Municipal Zoning Code Section 10.22, Subdivision 2, limits hardcover in the 5-250' setback zone to 25%. This property is currently at 5 . % in that zone, and the contruction of the wood deck certai ly exacerbated the pre-existing hardcover excesses. To summarize, potions of the currently existing wood deck which were newly const ucted in 1988, and which resulted in this action, do not conform to the Code because they are: A) Too close to he lot line (in fact over it) ; and B ) Contributing to and increasing the pre-existing hardcover excesse - on the property. Applicant c•uld make the appropriate after-the-fact application for a hardcover variance, with the knowledge that the City wi 1 expect portions of the deck encroaching on the required s-tbacks would have to be removed. There is no guarantee tha . a variance would be granted, and in a case where the hardco er on the property is so excessive, it is doubtful applic= nt would be granted approval to keep anything more tha the original deck in that location. That Garry Everson went to Ridgedale Court .thre- times to try to take care of the ticket and was told that 'there as no record of said ticket. We then assumed that the matter had •een dropped. 14. Police fficer determined the reason Ridgedale couldn't find the tic et was because the City had spelled Mr. Everson' s name as Gar y Iverson instead of Everson. That on 2/2 /90, Garry Everson received a letter from the City of Orono sta. ing •they still wanted application now claiming that they di. n't have the application and giving a deadline of March 6, 990. (Note: This was seven days after date of letter typed which was received on March 3, 1990. ) Marie Everson contacted Lyl = Oman and he agreed to meeting at City of Orono on 3/16/90. 16. That on 3/1 •/90, ameeting was held with Mr . and Mrs. Everson, Lyle Oman an. Jeanne Mabusth at City Hall. Mr. Oman and Ms. Mabusth indicated that they never received the permit application. They lo.ked further and found permit application dated November, 1988. Mr . and Mrs. Everson argued that they did not feel they should .e required to bear the expense of a survey but reluctantly agre=• to have it done. 11 . That on 3/16/90, Marie Everson called All Metro Survey. They indicated that hey would do an estimate on cost of survey. Called Gronseth in L•ng Lake who agreed to look at property and call back. They needed further idformation of legal description, etc. , (provided) and agreed to go ahead with survey in next couple of weeks. 19. That on 4/1 /90 Marie Everson contacted City Inspector Oman. He was on vaca,. ion until near the end of the month. Asked . receptionist to pull •he file and advise if there was any required compliance date. She couldn't find the file. Marie Everson advised that survey w= s underway and asked the receptionist to please note complianc,= for their records and to have the person in charge during Mr. Oma ' s absense call back that afternoon, since he was busy. No retu n call was received from the City that afternoon or any subs=quent time. 20 . That on 4/18 90, Mr. and Mrs. Everson received a Complaint from Ridged-le Court for building without a permit with a court date scheduled 5/8/90. 21 . On 5/1/90, •M= rie Everson called All Metro Survey - they had been delayed becau=e of rain and will complete by seven days and the paperwork will be completed in 10 days. 22.
