Dear Mr. & Mrs. Lowe:
This letter is in regards to my discussion with Brad Hayes, of Hayes and Son's Excavating, on
your behalf, regarding the septic system and proposed house remodel. Brad informed me that
you would like to divide the one large bedroom shared currently by your boys into two
bedrooms. This would bring the total number of bedrooms to four (4) with a septic system sized
for a three bedroom house. This is in violation of state and city code.
I will allow the bedroom conversion without adding on to the septic system at this time due to
the fact that the number of members of the household is not expanding. It is a separation of
existing space to accommodate current family members only. The bedroom conversion is also
being allowed at this time with an understanding that the septic system issue will be resolved in
the future in one of two ways.
1) The septic system will be upgraded to the total number of bedrooms in the house at the
time of sale of the property or;
2) The bedroom is converted back to the original configuration of the 2006
remodel/expansion.
Upon signing of this agreement, James and Kelly Lowe agree to the above conditions for
allowing the alteration of the number of bedrooms in the house located at 105 Orono Orchard
Road N, Orono, MN. This agreement remains in effect until such time as the existing system
fails to continue to treat sewage properly and needs to be upgraded at that time.

Dear Mr. Ripley:
I am writing in regards o the house addition/remodeling project at 105 Orono Orchard
Road that you are the c o ntact person for. I stopped out to the property on Friday May 12,
2006 and noticed that e excavated soil from the basement dig out has been placed on
the area designated for he secondary septic site. Streeter and Associates was required to
identify a secondary sestic site and to certify the existing system as part of obtaining the
building permit for the ;ddition/remodel. The secondary site was to have been protected
from disturbance or co paction of the soil.
The currently identifies secondary septic site has been severely compromised and will
not be allowed as a pro posed site. You must contact the site evaluator/designer of the
project immediately an' have an additional septic site identified. The City of Orono can
shut the project down til an acceptable secondary site is identified and protected. I will
expect a new design anii site plan by June 1, 2006 or a Stop Work Order will be posted
on the property.
