One condition called for the replacement of your septic system with a proper system by June 15, 1995 . I have been informed by Steve Weckman, On-Site Systems Manager for the City, that you have neither obtained the necessary permit for system replacement nor have you replaced the system. Struyk Orono and St. Bonifa(ir(s 40 Orono Orchard Road North Wayzata, MN 55391 Re: Surface Discharge of Septic Effluent and Septic System Replacement Dear Mr. Struyk: As you know from our recent telephone conversation, this office has been authorized by the City of Orono to file a criminal complaint relating to recurring surface discharge of septic effluent at your residence. The City is willing to withhold taking this action if it can be satisfied that you are taking appropriate steps to prevent recurrence of this problem. The City will withhold any further enforcement action provided the you do all of the following: 1) Replace the septic system with a proper system by June 15, 1995; 2) Have the septic tanks pumped at least every 60 days, and more frequently if required to prevent surface discharge, until the system is replaced; 3) Submit to the City a pumping contract showing that you have contracted for the required pumping; and 4) Have no further surface discharges of septic effluent prior to replacement of the system. If you agree to these conditions, please sign in the space provided below and return a copy of this signed letter to me along with the pumping contract referenced above by no later than January 15, 1995. My last notice to you gat d July 18, 1994 required soil testing be submitted by August 1, 1994 with a permit issued to the contractor of your choice by September 1, 1994. As delays slowed the completion of the soil testing, you were given an additional two weeks to obtain bids and apply for a permit. We have set several repair deadline which have not been met, nor have you contacted the City to ask for extensions due to unexpected delays. Repair orders were sent to you most recently on June 16, 1994 indicating a pe it was required for a septic system repair for your residence by July 1, 1994. No permit was issued and the notice, which was sent by certified mail, was returned unopened. I contacted yo by telephone on July 13, 1994, and you indicated that Koch's Soil Testing had been retained t do soil testing and septic system design. If future deadlines are not met, the City will initia a legal action. As we discussed on the telephone, the following time line has been established for the required septic system repair. Soil testing and septic system design must be submitted by August 1, 1994 for approval. Once the plan is approved, several bids should be obtained and a permit must be issued to the contractor of your choice by September 1, 1994. If there are an, questions or problems that arise during the repair procedure, please contact me at the City offi es as soon as possible to prevent legal complications. Past inspections have indicated th,t the system is failing and requires replacement. The owner has attempted to eliminate surface discharge by altering the drainage over the drainfield last summer. If the alterations have oeen successful, the system should be functioning adequately at this time. During my insp, tion of the drainfield area, surface discharge was noted emanating from the distribution box in a puddle approximately 8' long and 3' wide. The corrections have not improved the fu ction of the drainfield. As this is the driest time of the year, the drainfield should be dry no w if there is any chance of salvaging the system. As the attempts o salvage the drainfield area have apparently failed, the system will have to be replaced next sunnier as soon as weather conditions allow. Soil borings were performed two years ago by ob Cook which indicated that the existing drainfield does not meet a 3' separation.
