Recently I noted that there is an un-issued land alteration permit in the file for 25 Orono Orchard
Road. On June 16, 4008 a land alteration permit application was submitted with check for $50;
this check has not ben cashed.
The notes in the file indicate that the City Planner spoke with Mr. Benedict and followed up with
a letter dated July 21 2008. The wetland buffer on the property appeared to be in a satisfactory
condition, but the location of the buffer was to be shown on a survey for approval of the permit.
Additionally we reqs,ested that a wetland buffer easement be granted and our standard
protective wetland bu er covenant signed by the property owners.
It appears the City he information requested was not submitted and we believe the land
alteration work was mpleted without issuance of the proper permit. Unfortunately due to the
length of time passed,and lack of detailed information in the file we have chosen to close out the
permit application. Please find enclosed your check (#7227).
Please be advised that City permits are required for any land alteration work regardless of the
scale. In the future please feel free to contact me directly to assist you with questions or
projects that may regiiire permits or approvals from the City.

Re: Land Alteration Permit(Application# 12166)
Dear Mr. Benedict:
As I indicated in our telephone conversation the City's wetland protection regulations require that a wetland
buffer be created in conjunction with a construction or land alterations project when all of these conditions exist:
1. The portion of the property disturbed by construction or land alteration activity drains to the wetland.
2. The amount of grading exceeds 50 cubic yards or involves the disturbance of more than 5,000 square
feet.
3. There is a net inbrease in impervious surfaces that drain to the wetland, new impervious surface is added
closer to the wetland than existing impervious surfaces, or there is a change in drainage patterns that the
City Engineer determines will increase the velocity or rate of runoff to the wetland.
Since you indicated you had restored your wetland I had the City's wetland consultant visit your property to
ensure the wetland buffer area satisfied the City's requirements. His report is attached. The use of buffer
averaging is acceptable.
All that will be required 's a wetland buffer easement and protective covenant. The document is enclosed.You
will need to provide leg 1 descriptions of the wetland and the wetland buffer as well as a survey showing
location of the buffer an that its area is not less than the area of a standard 35 foot wide buffer. There can be no
impervious surface withi the buffer. Once we have this the permit will be issued.

Remarks:
The property currently has one wetland that has a Manage 1 Classification. This classification
requires a 35 foot vegetated buffer and 20 foot setback from the buffer.
Buffer Condition and Requirements
A site evaluation was completed on July 16, 2008 to determine the condition of the vegetation in
the existing upland !buffer. The survey provided does not show a buffer, however it appears that
a buffer was established previously. There are a number of species(black-eyed susan,ect.)
adjacent to the wetland that would typically be found in a native seed mix provided for prairie
development(see attached photos).
The area that appeals to be an established buffer extends around the entire wetland and is
approximately 30 feet between the yard and the wetland on the west side. This needs to be
verified by survey. There is also a buffer that exists between the wetland and Orono Orchard
Road that vanes in vfidth but is as wide as approximately 120 feet in some locations.
Existing Legal NonOonforming Structures and Requirements
There is currently a blacktop driveway located within the required buffer of the wetland. This is
considered a legal nonconforming structure. Due to the buffer being in good shape and being
wider along the road';and as a result providing increased filtration from the impervious surface
the City may want to Consider allowing buffer flexibility. This would allow the property owner to
make up lost buffer Blue to the driveway in the area between the wetland and Orono Orchard
Road,where adequate vegetation already exists.As described below under the Certificate of
Survey Requirements the landowner will need to show how the buffer area is going to be
accomplished on the property.
Certificate of SurveRequirements
To be in compliance With the submittal requirements of the ordinance the Certificate of Survey
needs to be updated to show the buffers.
Buffer width averaginij should be done on the property to make up for the lost buffer. The
applicant will need to have the survey firm provide a plan that shows the total acres of buffer
required by the code and where the buffer is being expanded to make-up for the acres of the
buffer that is lost due to the existing driveway and the slightly narrower buffer that

Restriction and Cpvenant for Wetland and Buffer
Per Section 78-16111 of the wetland ordinance the owner shall record restriction and covenants
over the wetland and buffer with the property chain of title. A form with the language for the
Restriction and Covenants is available from the City.
Recommendations
It is recommended that the application is approved and the survey be updated to show the
buffer.

Natalie White told me that you called with concerns about the work being done at 25 Orono
Orchard Rd. I inspected the site on the 11th and told them that the project may have
required a permit from MCWD, however, now that it was almost complete, I just asked that
they stabilize the soils and restore the buffer area as soon as possible. I did a follow-
up inspection on Friday , and the landscapers were there seeding with a native seed mix, so
I was satisfied. If you have further concerns with this site, please let me know.

Subject: Review Wotland Buffer for Landscaping Project
25 Orono Orchard Road N. (A12166)
The property owner is(proposing a landscaping project along his driveway that will
include importing 200 to 250 cubic yards of fill. Because the project includes about a
dozen boulder outcrop's each 6 to 12 square feet it would trigger the buffer
requirement. When I brought this up to the property owner he indicated he had
restored his wetlando or three years ago; had a permit from MCWD. We don't have
anything in our file on i . It doesn't look much different from any other wetland of this
type to me. Please vis t the site and let me know if what is there would satisfy the
buffer requirements. .
I am enclosing the building permit survey, which shows the wetland as delineated in
2001. I know this is oldler than we would normally accept but would like to avoid
requiring a new delinea ion until I know more about the situation. I am also enclosing
the plans for the project
