A RESOLUTION APPROVING
•
A SUBDIVISION OF A LOT LINE REARRANGEMENT
AND EXTINGUISHMENT OF THE CONDITIONAL USE PERMIT
GRANTED WITH RESOLUTION NO.4836
FILE NO. 13-3640
WH REAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WH REAS, the City Council of Orono (hereinafter "City Council") has adopted
subdivision regulat ons for the orderly, economic and safe development of land within the City;
• and
WHpREAS,James Murphy and Sandra S. Smith, a married couple (hereinafter
the "Applicants") a`e the owners of the property located at 20 Orono Orchard Road N within
the City of Orono(hereinafter"City")and legally described as follows:
Lot 13, Blodk 1, Orono Oaks, Hennepin County, Minnesota (attached) (hereinafter "the
20 Parcel");I and
WHiREAS, the Applicants are also the owners of the property located at 30
Orono Orchard Read N within the City and legally described as follows:
Lot 10, Block 1, Orono Oaks, Hennepin County, Minnesota (hereinafter"the 30 Parcel");
and
WHEREAS, the Applicants have submitted an application for a lot line
rearrangement inv lying the 20 Parcel and the 30 Parcel which would relocate the lot boundary
line between the p perties; and
WH REAS, in July 2002, Resolution No. 4836 was adopted by the City Council
and granted app al to the 30 Parcel for the keeping of 3 horses on the 30 Parcel where
adequate pasture creage to support 3 horses did not exist; and
WH REAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 t. seq. and the City of Orono Zoning and Planning Codes, the Orono
Planning Commis on held a public hearing on the lot line rearrangement on November 18,
2013 at which tim all persons desiring to be heard concerning this application were given the
opportunity to spea thereon; and

WHEREAS, the Orono City Council reviewed the proposed lot line
rearrangement at a regular meeting held on November 25, 2013 and makes the following
findings with regards to the proposed lot line rearrangement
FINDINGS
1. This application was reviewed as Zoning File#13-3640.
2. The 20 Parcel!contains 2.05 total acres of which 0.83 acres is dry buildable land; and the
30 Parcel contains 3.69 total acres of which 3.56 acres is dry buildable land.
3. The 20 Parce�contains a small home and detached garage. This property was recently
connected to ity sewer.
4. The 30 Parcel is served by a private septic system and contains an existing home and a
barn.
5. This applicatin contemplates a lot line rearrangement to move the common lot line
between the 0 Parcel and the 30 Parcel east 98 feet resulting in transferring 0.56 acres
of dry buildabl land and the barn from the 30 Parcel to the 20 Parcel.
6. Following the lot line rearrangement the 20 Parcel will have 1.39 acre in dry buildable
area, and the 30 Parcel will have 3.0 acres in dry buildable area.
7. Resolution No. 4836 granted a CUP to the 30 Parcel to allow the keeping of 3 horses
where there was insufficient dry acreage available for pasture base on City code
requirements.
8. As a result of his application the legal description of the 30 Parcel will be modified. The
30 Parcel wi I no longer meet the conditions outlined within Resolution No. 4836.
Therefore Re olution No. 4836 shall be extinguished.
9. Because this a lot line rearrangement which results in no additional lots, no park fee or
stormwater t nk fee will be required.
10. Dedication of(drainage and utility easements along the new common lot line are to be
granted as shpwn on the survey dated 10/17/13 and revised 10/20/13.

CONCLUSIONS, ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants the lot line
rearrangement of the above referenced properties based on the lot line rearrangement survey
dated 10/17/13 and revised 10/29/13 by Gronberg and Associates, Inc., attached as Exhibit A;
and hereby extinguishes the CUP granted to the 30 Parcel via Resolution No. 4836, subject to
the following conditions:
1. The Applicants shall file the appropriate deeds reflecting the new legal descriptions
(subject to City Attorney approval) with the Hennepin County Recorder's Office and/or
Registrar of Titles Office on or before November 25, 2014, or the approval granted by
this resolution shall expire.
2. The Applicants shall grant drainage and utility easements along the new common lot line
are to be granted as shown on the survey dated 10/17/13 and revised 10/20/13.
