HomeMy WebLinkAbout#6157-Prelim amend for MUSA-2012 - --(]i gv O O CITY of ORONO `` gid, A, RESOLUTION OF THE CITY COUNCIL v$Alqr' ',' •C� `l "i�1i f i i NO. 6 1 5 7 liktsHDg' A RESOLUTION GRANTING PRELIMINARY APPROVAL OF AMENDMENT#1 OF THE ORONO 2008-2030 COMMUNITY MANAGEMENT PLAN: 20 ORONO ORCHARD ROAD NORTH-MUSA FILE NO. 12-3566 WHEREAS, the City of Orono (hereinafter "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, in September 2010 the Orono City Council adopted the 2008-2030 Orono Community Management Plan (hereinafter "CMP" or "the Comprehensive Plan") to provide for the orderly development of the City, in compliance with the Metropolitan Land Planning Act of 1976 and Minnesota Statutes Chapters 462 and 473; and EREAS, an integral element of the 2008-2030 CMP is the Comprehensive Sewer Policy Pl , which identifies certain areas of the City as being within the Metropolitan Urban Service rea(MUSA) in which connections to the metropolitan sanitary sewer system are allowed; and REAS, the property at 20 Orono Orchard Road North within the City of Orono contains la single family residence structure constructed in the 1950s or earlier and is approximately 20 acres in area, of which approximately 1.25 acres is wetland. The property is zoned RR-1B ural Residential, 2-acre minimum lot size and currently has a failing non- conforming sept c system; and NTIIEREAS, the property is located along Orono Orchard Road approximately 700 feet from *he existing Orono municipal sewer system that serves the Orono Orchards neighborhood. The property is not currently within the Metropolitan Urban Service Area (MUSA), but iso directly across the Luce Line Trail from the Orono Orchards neighborhood which is within the MUSA; and WHEREAS, the property does not have available area for septic system replacement ore pansion; and HEREAS, the property owner has formally requested that the property be incorporated int the MUSA to allow for future connection to the municipal sewer system; and Page] of 2 1 .;?. 0 O 0 CITY of ORONO *7 A+ RESOLUTION OF THE CITY COUNCIL 1$4 ALI\thd,, , ,„ 6 1 5 7 ____// ____ ,,, REAS, MetropolitanCouncil staff have advised the City that this property can be added to t e MUSA through a minor amendment to the CMP. The amendment is exempt from the 60-day c mment period by adjacent jurisdictions because it is less than 40 acres in area, it does not change any Metropolitan Growth Forecasts, and is further from adjacent jurisdictions than the City's s dard notification distance; and Wil EREAS, the property does meet the exceptions established by Metropolitan Council so that th property will not be counted against Orono's density calculations, because it was 1) developed prior to 1985; 2) has a failing septic system; and 3) there are no alternative locations on the property where a replacement septic system would be feasible; and WHEREAS, in light of the above noted facts the Orono Planning Commission pursuant to published and written notice held a public hearing on July 16, 2012 and on a vote of 6-0 recommended'Ithat the property at 20 Orono Orchard Road North be added to the MUSA. NOW, THEREFORE, BE IT RESOLVED that the Orono City Council conditionally approves an amendment of the 2008-2030 Community Management Plan to include 20 Oron Orchard Road North in the Metropolitan Urban Service Area subject to Metropolitan Co cil review and approval, and directs City staff to prepare such an amendment and submit it to th Metropolitan Council for review and approval.
