Re: Impacts of MnDOT Acquisitions
Dear Mr. Palm r:
The zoning/planning impacts to your property as a result of the MnDOT temporary easement and
permanent acq isitions appear to be as follows:
1. The pr erty is zoned RR-1B Single Family Rural Residential, requiring a minimum of
2.0 acre dry buildable land. The remaining dry buildable area of the property after excluding
the permanent MnDOT easement is approximately 1.9 acres. This places the property in a
"legal nnconforming" status, due to substandard lot area.

After th easements are acquired, it appears that the existing home will remain conforming
to all re uired structural setbacks, lot coverage limits, etc.
The ramifications of legal nonconforming status are relatively minor; if the house was
comple ly destroyed,a lot area variance would be required in order to rebuild,but a variance
would t have to be obtained to merely construct additions or accessory buildings meeting
all othe standards.
2. The to porary MnDOT easement appears to be within 25' of the north end of the existing
drainfield lines. This causes no direct impact in itself,as long as all land-disturbing activity
stays wi hin the easements.
3. Not dir tly related to the MnDOT acquisition is the fact that the existing drainfield system
is "non compliant" due to lack of separation from seasonal water tables and must be
replace by December 31,2010 per City ordinances. We are in receipt of a testing report and
design r a replacement septic system for the property. Based on relaxation of the City-
require 20'property line setback standard,the report indicates that replacement systems can
be locat d within the area of property remaining after the MnDOT acquisitions.
