A RESOLUTION VACATING
CERTAIN DRAINAGE AND UTILITY EASEMENTS
WITHIN THE PLATS OF
CRYSTAL CREEK; MEYER DAIRY ADDITION;
SPRUCE ACRES; ORONO OAKS; AND WOOD END ACRES
IN THE CITY OF ORONO,
HENNEPIN COUNTY, MINNESOTA
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, as part of the MnDOT Highway 12 relocation project, the
Minnesota Department of Transportation (MnDOT) acquired certain residential properties,
portions of which will become owned by the Burlington Northern and Santa Fe Railway
Company(BNSF) for railroad right-of-way purposes; and
WHEREAS, as part of the pending ownership transfer, BNSF has required
MnDOT to have existing drainage and utility easements vacated within the new railroad right-of-
way where they no longer have any public purpose; and
WHEREAS, on March 21, 2007, Lee Williams on behalf of MnDOT (hereinafter
the "petitioner") filed a petition and application with the City of Orono (hereinafter "the City")
requesting the vacation of certain portions of the Drainage Easements and Drainage & Utility
Easements dedicated within Outlot B, CRYSTAL CREEK; within Lots 3, 4, and 7, Block 1,
MEYER DAIRY ADDITION; within Lots 1, 2, and 3, Block 1, SPRUCE ACRES; within Lots
1, 2, 3, 4, 5, and 6, Block 1, ORONO OAKS; and within Lots 1 and 2, Block 1, WOOD END
ACRES; and
WHEREAS, the portions of said Easements to be vacated are formally and
legally described in Exhibit A attached hereto; and
WHEREAS, after due published and posted notice, a public hearing was held by
the Orono City Council on April 9, 2007 regarding said vacations and all interested persons were
given an opportunity to be heard; and

WHEREAS, after due standing and consideration, the City Council of the City of
Orono finds that said vacations as proposed are in keeping with the public interest and in
consideration of the following findings:
1. The portions of dedicated easements to be vacated no longer have a public benefit
• because the public drainage and utility purposes no longer exist; the approved
topographic changes within the railroad corridor have resulted in the obliteration,
removal or relocation of all pre-existing drainageways, wetlands, utility lines, etc. in the
area of the easements to be vacated.
2. The vacation of said easements will not eliminate access to any adjoining or nearby
properties.
3. Utility companies have been notified of the proposed vacations and none have indicated
opposition to the vacations.
4. The City does not intend to use the easements to be vacated for any future public
purpose.
NOW, THEREFORE, BE IT RESOLVED, that the petition of MnDOT is
hereby granted by the Council of the City of Orono and that the portions of easements as legally
described and depicted in Exhibits A and B attached hereto, are hereby vacated.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held on April 9, 2007.

DESCRIPTION FOR VACATION OF PLATTED EASEMENTS IN THE CITY OF
ORONO
That part of the drainage easement over Outlot B, CRYSTAL CREEK, as shown and
dedicated on said plat, which is on file and of record in the office of the County Recorder
in and for Hennepin County, which lies northerly of Line 1 described below:
Line 1. Beginning at Boundary Corner 624 as shown on Minnesota Department of
Transportation Monumentation Plat No. 27-M16 as the same is on file and
of record in the office of the County recorder in and for said county; thence
easterly on an azimuth of 103 degrees 35 minutes 15 seconds for 153.80
feet, along the boundary of said Monumentation Plat, to Boundary Corner
• B23; thence easterly on an azimuth of 90 degrees 49 minutes 00 seconds
for 705.11 feet to Boundary Corner M26 and there terminating;
Also that part of the drainage and utility easements over Lots 3, 4, and 7, Block 1,
MEYER DAIRY ADDITION, and Lots 1, 2, and 3, Block 1, SPRUCE ACRES, as shown
and dedicated on said plats, which are on file and of record in the office of the County
Recorder in and for Hennepin County, which lie northerly of Line 2 described below:
Line 2. Beginning at Boundary Corner M9 as shown on Minnesota Department of
Transportation Monumentation Plat No. 27-M15 as the same is on file and
of record in the office of the County Recorder in and for said county;
thence westerly on an azimuth of 270 degrees 48 minutes 58 seconds for
100 feet to the point of beginning of Line 2 to be described; thence
easterly on an azimuth of 90 degrees 48 minutes 58 seconds for 100 feet
to Boundary Corner M9, thence southeasterly on an azimuth of 133
degre s 22 minutes 13 seconds for 26.62 feet, along the boundary of said
Monu entation Plat, to Boundary Corner M7; thence easterly on an
