He feels that no further plans are needed. However, regarding the elevation of the invert of the culvert that will be placed under the driveway, he notes that no outlet invert elevation was given for the culvert that is east of your property and under the Luce Line Trail. His comment was that if the outlet invert of that Luce Line culvert is at 952,0 feet or higher, then the proposed driveway culvert invert elevation of 951.5 feet is acceptable. However, if the Luce Line culvert invert is lower than elevation 952.0 feet, then your driveway culvert should be lowered to elevation 951.0 feet or to whatever elevation will yield a driveway culvert invert approximately 6 to 12 inches below the Luce Line culvert invert. Your excavator can verify these elevations when he is setting that culvert. Based on the drawings submitted previously, I am estimating your fill required at approximately 750 cubic yards, hence this project qualifies for the lesser grading permit fee of $50.50. Russ Widmer of Widmer Brothers, Inc. was also present. Our discussion on the site was involving the potential location of a driveway to provide access to the building site on the property. Although we were not able to verify the exact location of the northerly lot line extending eastward from the cul-de-sac, it is my opinion that the wetlands, as they exist now, are greater in area than the drainage easement shown on the plat of Orono Oaks. In fact, I believe it is likely that in order to provide a driveway to the building site, you will have to cross over or encroach within 26' of some portion of existing wetlands, requiring a variance from the City Ordinances regarding wetlands. As an alternative, you might be able to avoid the wetlands by obtaining driveway easement from a neighboring property owner. However, since no neighboring property owner is obliged to grant you an easement, it is my opinion that the City would have to grant you a variance to cross the wetland or to encroach within 26' of the wetland with a driveway. I would suggest that if you purchase the property, you should have the boudaries surveyed and have the wetland boundary re-defined and additional topography around the wetland defined, so that the extent of variances necessary can be adeqately addressed. can be of further help. Last year we had ten vehicles go off the driveway into the ditch. We have had vehicles go off the driveway every year for 11 years. Several of these vehicles suffered expensive damage and the only thing that kept three of the vehicles from rolling over completely was a medium sized elm tree. This elm tree died from Dutch elm and has now been removed. I want to bring in soil and create a four foot shoulder on both sides of the driveway. The area will be the 220 feet in length and four feet wide on each side. The driveway is currently 10 feet wide so it will extend 9 feet from the centerline of the driveway. The total width of the driveway (travel way and driveway bank)will be 18 feet(except for the area where it is currently wider than 18 feet and no fill will be added to this area). The driveway runs primarily north and south. The fill area will start 12 feet south of the culvert at south end of driveway and go 220 feet north on both sides. The amount of fill to be brought in will be approximately 75 cubic yards on the east side of the driveway and 40 cubic yards on the west side of the driveway. A total of 115 cubic yards. My erosion control plan is to install a silt fence on the east side of driveway running the entire length (220 feet) of the fill area. I will also install a silt fence on the south end of the west side fill area near the culvert. The soil will have a minimum of six inches of top soil on the top and be seeded with grass seed. The area is currently covered with buckthorn that I have been trying to control, so it will probably fill in with buckthorn by summer. The culvert is currently a 20 inch diameter culvert. I plan to extend it with a 20 inch culvert at the same elevation 6 feet on both sides. He felt that better than a site inspection in the snow, the best way to allow you to proceed with the permit this Fall is for you to address the following: 1. Provide a detailed written description of the plan or a scale drawing. The submitted drawing is not to scale. 2. You should specify the amount of soil you are bringing in. 3. You should specify the type, diameter and length of the culvert you are going to use to replace the existing. 4. You should specify how far from the existing center line of the driveway the fill will be placed (this includes the travel way and the driveway bank). 5. You should specify your erosion control plan (i.e. silt fence placement, etc) The drawing you provided makes it look like you intend to triple the originally planned width (12 ft) of the driveway to —36 ft. I believe what you told me is that you really just want to take the existing 8 ft to 12'as was initially proposed, correct? Please clarify. If you can provide a detailed enough plan of what you want to do we can then be reasonably assured that the project will not interfere with the wetlands and therefore not trigger a delineation and possible wetlands permit. However with the current sketched plan and the wetlands so close we cannot be sure. If your plan simply improves the driveway to the previously permitted 12 ft travelway and the culvert's diameter, and elevations remain the same then it is likely we can issue the permit. Attached you will find an email from the MCWD and a few different versions of the property survey/site plan. There is a large pile of dirt on the property partially blocking the driveway access to the Eriksson property which also makes it difficult to clear snow. Based on the MCWD's recommendation for a wetland delineation I feel like I'm at a standstill with regard to issuance of the permit. I suppose we could just proceed without it but since they've actually made a recommendation on the matter I feel we should follow it. Chris Eriksson has asked what can be done in the meantime since a delineation cannot be performed yet this year. He has already paid for the dirt, and wants to solve the safety issue with his narrow driveway before winter (or more winter) comes. I suggested the property owner would meet with the city engineer on site to see if there are any options for him yet this fall... He can meet this afternoon if one of you are available.
