A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 78-1434 (1)
FILE NO. 10-3440
WHEREAS, Robert Sansevere and Mary Sansevere, husband and wife
(hereinafter "the applicants") are the owners of the property located at 745 Orchard Park Road,
within the City of Orono (hereinafter the "City") and legally described as follows:
That part of the North 25 acres of the Northeast Quarter of the Northeast Quarter
of Section 31, township 118 North, Range 23 West of the 5th Principal Meridian
lying South of State Highway No. 110, EXCEPT the West 245 feet thereof.
Hennepin County, Minnesota(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1434 subdivision 1 to allow construction
of a 3,000 square foot accessory building on their property where a 1,200 square foot accessory
structure already exists.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 10-3440.
2. The property is located in the RR-1A Rural Residential Zoning District which
requires a minimum lot area of 5.0 acres and a minimum lot width of 300'.
3. The Planning Commission reviewed this application at a public hearing held on
January 19, 2010 and recommended approval of variance based on the following
findings:
a. The property contains 9.45 acres or 411,983 s.f. in area and has 483' in width.

b. The property exceeds 1.99 acres and is not subject to the structural lot
coverage limitation of 15%.
c. The proposed structure complies with all setback requirements.
d. Based on the 9.45 acre area, the property is permitted 6,000 square feet of
accessory structures. Four, 999 square foot buildings (10 feet apart) could
legally be constructed on the property.
e. The 3,000 square foot accessory building is proposed to be used as a riding
arena and will not be used to house animals.
f. Considering aesthetics, the applicants have proposed to construct one
additional building, 3,000 square feet in area, on the property rather than
construct four, 999 square foot buildings.
g. The applicants agree to limit their property to 4,200 square feet of accessory
structures as part of the variance approval.
h. The proposed building is proposed to have a maximum of 12' sidewalls.
i. The applicants agree to the filing of the OAS covenant.
j. The project will trigger the wetland buffer and other requirements of the
City's wetland regulations. With the issuance of a building permit the project
must comply with Sections 78-1600 through 78-1614.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable
hardship or difficulty; is necessary to preserve a substantial property right of the

applicants; and would be in keeping with the spirit and intent of the Zoning Code
and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-1434 Subdivision 1 to allow construction
of an additional 3,000 square foot oversized accessory building on the property where a 1,200
square foot oversized accessory building already exists, subject to the following conditions:
1. Council approval is based on the site plan and building plan submitted by the applicants
and annotated by City staff, attached to this Resolution as Exhibits A & B. Any
amendments to the site plan which are not in conformity with City codes will require
further Planning Commission and City Council review.
2. The 3,000 square foot oversized accessory structure is not to be used to house animals.
3. The exterior finish of the 3,000 square foot oversized accessory structure should match
the existing house and barn on the property.
4. With this variance approval the property shall be limited to 4,200 square feet of total
accessory structures.
5. Compliance with City Code Sections 78-1600 through 78-1614 regarding wetlands is
required with the issuance of a building permit for the oversized accessory structure.
6. ADDITIONAL SURVEYS REQUIRED:
a. Per City Code Section 86-68, a survey or certified letter from a surveyor is
required to be submitted confirming the approved location prior to
commencement of framing; and
b. An as-built grading plan verifying compliance with the building permit,
stormwater management, wetland regulations, grading and drainage plans shall be
submitted prior to the final inspection.
7. The building plans submitted for building permit will be reviewed to ensure compliance
with the City's building height regulation.

8. Authorities granted by this resolution run with the property not with the applicants, but
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
on that date (February, 8, 2011).
9. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
10. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.
