Box 66 Crystal Bay, In 55323-0066 In the fall of 1965 , I purchased a small hobby farm at 665 Orchard Park Road. Our family horse of 18 years had been a boarder there along with two other horses on the 5 acre tract . It had a small pond on it , about 15 ft across, and we could enjoy the entire 5 acres with a riding path up and around the hill, a beautiful piece of land. Since purchasing it , two new homes have been constructed in the area. Water levels seem to have been re-directed, and the 'pond' kept enlarging.Iiraculously stopping at the fence line of the neighbor lower down. The ground used to appear straight across there but I haven' t checked for ' dredging. ' Now the big new house to the north is finished and up for sale, with the hoses coming out of the newly contoured land and fills and aimed at their man-made 'lake ' --as it was advertized. The new man-made lake ( our pond) is now seven feet deep and has made one-half of our 5 acre land completely inaccesible to us! Many trees have died, our fence posts have caved in, and it is very evident to me that laws have been violated at the expense of our land. The water level of the wetland south of County Road 6 is higher than normal and is not presently draining. The natural drainage route directly to the south runs along Orchard Park Road through a culvert and then east under the road. It appears obvious that fill has been placed within this natural drainage route at 615 and 585 Orchard Park Road. The fill in some sense makes the wetland landlocked, as it must rise several feet further before reaching the overflow point. We believe that the fill placement is in violation of State Law in that it blocks a natural drainage route. These property owners should be informed that the fill material must be removed in the immediate vicinity of the drainage route unless piping is installed. If necessary, we can arrange to have the properties surveyed to verify if the elevations correspond to the topography mapping done for the City on March 27, 1992. Orono staff members and two members from the consultant engineer's office met at your property and reviewed the surrounding watershed to determine what changes have occurred that would restrict drainage from flowing south from your property. It appears that two property owners to the immediate south have been gradually filling in their rear yard. This gradual filling now restricts the natural or historic flow of drainage to the south.placed a natural flow of drainage to the south. The City will be sending a letter to the property owners advising them of this problem and recommending a meeting with staff and the City Engineer. Hopefully, at these meetings we will be able to determine the best means to restore natural drainage and an approximate schedule for remedial land alteration. Some of the options that the City will recommend will be either the installation of an underground drainage tile or a grassed swale. The City normally encourages grassed swales because of the problems with the maintenance of an underground drainage tile. Please advise if you wish to be present at any of the meetings that we schedule with the two land owners. The engineer noted recent filling on your property that has restricted the historic and natural flow of drainage through your property causing major flooding problems for the Pidgeon property to the north. The meetings were informative and all parties were very cooperative. Staff learned a great deal of the history of the neighborhood along with the history of the drainage of the neighborhood provided by senior residents of the area who were visiting the day of our inspection. It appears that an underground tile carrying drainage to the south via the backyards of the properties may have been damaged when the Weestrand driveway was installed. Mr. Lang has volunteered to conduct excavations on his property to determine the location and depth of the draintile. The City Engineer has been asked to get a survey crew out on the site to shoot the elevation of the culvert beneath the Weestrand driveway and the drainage area that drains south from your rear yard. As soon as the information is reviewed, the City will more than likely schedule a meeting of all involved property owners to determine the best way to deal with the drainage problem. Based on discussions with him and upon revie a e corres -ence between yourself and the City of Orono, the following points are noted: It is very probable that activities of adjacent property owners have restricted the drainage between your parcels of property. In an effort to restore the drainage to the previous condition, existing tile line could be re-established. Restoring drain tile to the previous condition is addressed under exemption 3 of the Wetland Conservation Act and would not require a watershed district permit. This exemption states that a replacement plan is not required for `activities necessary to repair and maintain existing public or private drainage systems as long as wetlands that have been in existence for more than 20 years are not drained' (see attached). This letter qualifies as your exemption from the WCA if you proceed with re-establishing existing drain tile. The landowner must also state in writing that the wetland was not restored with assistance from a public or private wetland restoration fund, or that the restoration was • done under a contract or easement providing the landowner with the right to drain the restored wetland. Subp. 3. Exemption (3). A replacement plan for wetlands • is not required for: • (3) activities necessary to repair and maintain existing public or private drainage systems as long as wetlands that have been in existence for more than 20 years are not drained. This exemption allows maintenance which fills wetlands that have been in existence for more than 20 years when the wetlands are located within the right-of-way acreage of the ditch or within a one rod width on either side of the top of the ditch, whichever is greater, and the filling is limited to the side sf' casting of spoil materials resulting from the maintenance and �• the spoil deposition area is permanently seeded into grass after maintenance activities are completed. es The owner must provide documentation that the wetlands } which will be partially or completely drained by the maintenance have not existed for more than 20 years. Aerial photographs from two years of normal or wetter than normal water level conditions showing no wetland are one form of acceptable documentation. If aerial photographs are unavailable, a sworn affidavit may be submitted. Otherwise, the landowner must show that the maintenance will not reduce the of wetland from what it was 20 years ago or more. ow This exemption includes lowering the elevation of previously placed tile when made necessary by land subsidence provided the lowering does not drain wetlands. Subp. 4. Exemption (4). A replacement plan for wetlands is not required for: (4) ,activities in a wetland that has received a commenced n drainage determination provided for by the federal Food Security Act of 1985, that was made to the county agricultural stabilization and conservation service office prior to September 19, 1988, and a ruling and any subsequent appeals or reviews have determined that drainage of the wetland had been commenced prior to December 23, 1985. The wetland south of County Road 6 actually falls within the properties of 615, 665 and 745 Orchard Park Road. The water level is now at elevation 982.1 which compares well with the 982.3 elevation recorded on the City's March 27, 1992 aerial photo. The culvert under Orchard Park Road to the east of the wetland is at elevation 987.2 and drains towards the wetland. The culvert under the driveway at 525 Orchard Park Road is at elevation 980.0 and functions as the only overflow route for the wetland, which runs south. The water in the wetland must now rise at least 1.1 feet higher before it flows overland. A feasible solution to lower the water level in the wetland would be to excavate a shallow drainage swale between the wetland and the driveway culvert. The grade on the swale would be a flat 0.3 percent, but should function adequately during most rainfall events. This would require a permit because it would be considered as draining a wetland protected under the Wetland Conservation Act (WCA). If the swale is only"cleaned out"between the wetland and driveway culvert,but the water level is not lowered, a permit may not be necessary. However,this would only allow the wetland to drain down quicker during rainfall events but would maintain the existing water levels. The most practical solution may be to locate any existing draintile line(s) leading from the wetland and hire a plumber to repair/maintain the lines that function to lower the water level. A WCA exemption is offered for maintaining existing tile lines. The tile line could be located more easily if the original landowner is contacted, or possibly the Soil Conservation Service (Ed Musielewicz 757-4221) may have the line shown on an old map. Installing a new draintile line would likely require a WCA permit. Any solution would require that the property owner(s) hire a contractor to perform the work and form an agreement or easement along the alignment which crosses the properties at 615 and 585 Orchard Park Road. Subject: Drainage 665 Orchard Park Road The property owner at 665 Orchard Park Road has contacted the City regarding high water levels in a pond located in the center of this property. These high water levels are restricting the use of the western portion of the property for the grazing of horses. This issue has been an ongoing concern for about the past 10 years. The pond area on this property is currently classified as Type 4 wetland by the Minnehaha Creek Watershed District(MCWD) as shown on the attached map. The 2 foot contour lines on this map correspond very well with the MCWD Wetland designation. These contours show a low drainage swale area through the center of all the properties on the west side of Orchard Park Road. Aerial photos of this area from the years 1955, 1975, 1989, 1994, and 2000 are also attached to provide a historical perspective. Also included is a 1994 report from Pinnacle Engineering on this issue. This engineering firm was retained by the property owner to review this situation. According to then information in the Pinnacle Engineering Report,this property was purchased by the current owners in 1985, and there was a small wet area on the northern portion of the property which is observable on the 1975 and 1989 aerial photos. The 1994 photo appears to show a darker color wet area extending further south on the property, and the 2000 photo shows a ponding area across the entire property. In October, City staff completed a site inspection of this property. The ponding area extends to within about 5 feet of the fence on the south property line. The entire area downstream of the pond is flat soft uneven ground with 5 foot high grass and it is difficult to tell if any grading has recently been completed in this area. The property to the south, 615 Orchard Park Road, did not have any standing water but appears to be poorly drained. I have had a phone conversation with the owner of 615 Orchard Park Road. He purchased his property in 1974 and stated that in the spring and other wet periods the low drainage area in the center of the property is normally underwater. He also provided information on the history of this area that he had obtained from Milton Thurber who had owned 665 Orchard Park Road since at least 1955. In the 1950's,the property owners installed draintile across 665, 615, 585 which outleted into the large wetland on 525 Orchard Park Road. This draintile was installed to drain the existing wet area in the center of the properties so it could be farmed. The older air photos do show that this area was being farmed. However, according to Mr. Thurber the area was always marginal farmland even with the draintile. In the 1994 Pinnacle Report,the opinion is presented that this area previously was (seasonally flooded&wet meadow wetlands) which calls into the doubt how well this draintile system actually did function. In 1987, a new house was built on 525 Orchard Park Road and there has been speculation that the draintile system may have been damaged during the driveway construction. However,we do not have any positive proof that the draintile was damaged at this time. The Pinnacle Report alleges that in 1994 the property owner of 615 Orchard Park Road did work that impacted the drainage in this area. In my recent phone conversation, this property owner stated that he has not done anything impact the drainage in this area. Since this area is all private property, any drainage projects would require easements from the property owners, and this property owner is not interested in granting any easements for a drainage project. Conclusion and Recommendations This area was draintiled in the 1950's,the exact location and type of system installed is unknown along with how good the system actually did function. Common practice at that time was to install short lengths of clay pipe for draintile systems. This system is 50 years now, and the fact that it is not functioning properly anymore is not surprising. There have been differing opinions and allegation presented regarding this situation which does not provide any conclusive proof of exactly what has transpired in this area. This area is all private property with almost all of water draining off private property,with only a very minimal amount of water draining from City or County Roads. The acquisition of easements would be required in order to complete a drainage project and obtaining cooperation from all of the property owners could be difficult. The City's policy for selecting drainage projects over the past several years has been to rank projects in the following priority order. • Projects to prevent flooding of structures. (No buildings are being threatened by the water levels in this area.) • Projects to prevent or correct erosion problems. (There is no existing erosion or the potential for future erosion in this area.) • Projects to correct wet areas with no structure damage or erosion are the lowest priority In addition,the City funded drainage projects selected over the past several years were in high density developed areas with substantial drainage from City streets. This project is in the low density 5 acre zoning area with virtually no public road drainage causing problems. Another consideration is the high value the City places on wetlands and ponds to reduce peak flows and improve water quality, so the completion of a project to drain a wetland and convey stormwater flows downstream faster is not in conformance with Orono's values and policies. The City's long term plan is for more ponding to treat stormwater. Also before the 1950's draintile installation to'allow farming this area was wetlands, and with the draintile failure is reverting back to the previous natural conditions. The staff recommendation is that this drainage issue is a low priority in terms of the City's overall goals and policies for wetland protection, stormwater treatment, drainage goals, and the current drainage situations. (Pinnacle) was recently retained by Ms. Madalen Pidgeon to assess the wetland/drainage issues on her five-acre parcel of land located at 665 Orchard Park Road (Site) in Orono, Hennepin County, Minnesota. Ms. Pidgeon reported and had pictures documenting that her property has become increasingly inundated since she purchased it in 1985. Our scope of work included visiting the Site to document the current conditions,reviewing current and historic aerial photographs at the City of Orono, and compiling our findings in this letter report. Site Observation Pinnacle visited the Site on July 10, 2003 to document the current Site conditions. The Site visit revealed that there is currently a Circular 39, Type 4, deep marsh wetland at the Site that extends to the north and south, beyond the Site boundaries. The northern portion of the wetland is circular-shaped and is inundated with approximately 5-10 feet of open water. Numerous dead trees were observed in this portion of the basin, indicating a significant rise in the water levels that subsequently drowned these trees out. As the wetland proceeds south, it narrows down to a linear area of open water that stops at the Pidgeon's south property line, where there is a distinct vegetative and hydrologic change. The wetland type changes from an open water, Type 4 deep marsh basin to a Type 2, wet meadow wetland that is vegetated with reed canary grass and has minimal standing water. No natural topographic changes were observed at the property line that would cause this obvious change in wetland types. It appears that something at the south property line is blocking the natural outlet, impeding the water from following its natural course to the south into a separate wetland basin. Minneapolis, Minnesota Rochester, Minnesota La Crosse, Wisconsin • Aerial Photograph Review Pinnacle reviewed aerial photographs and a wetland inventory of the Site at the City of Orono on July 10, 2003 for the years 1955, 1970, and 1994. The 1955 photo did not have a wetland inventory overlay; however, it appeared that the area of concern was wetland at that time. The majority of the northern portion of the basin appeared to be dominated with emergent vegetation, such as cattail, with minimal open water. The open water/emergent vegetation barely extended south onto the Pidgeon property with the remaining southern portions appearing to be a grassed swale that served as the wetland's natural outlet. Being completely vegetated with emergent vegetation indicates shallower water conditions then what are currently at the Site. The 1970 photo was similar to the 1955 photo and depicted the northern portion of the basin as being dominated by emergent vegetation with a grassed swale to the south. The 1994 photo also depicted a bulb-shaped wetland but revealed higher water conditions than the two earlier photos, as evidenced by the absence of emergent vegetation. A dark colored object was observed in the wetland at the south property line that could possibly be fill material that is blocking the natural outlet, in turn, flooding the Pidgeon property. The city's wetland inventory classified this wetland as a 1.9-acre, Circular 39 Type 4 wetland with peaty muck soils. Background Information In discussions with Ms. Pidgeon, she stated that she purchased the property in 1985. At that time, the northern portion of the wetland barely extended onto her property and there was a small open water area approximately 15 feet across with the remaining area to the south being dry and functional land that she could easily traverse to get to access the western portion of the property. During the fall of 1994, her neighbors, immediately adjacent to the south, reportedly had a large tent and backhoe down in the wetland area near the south property boundary and possibly placed fill material/construction debris there. This appears to be blocking the outlet, flooding the Pidgeon property. In addition, a second neighbor located southwest of the Site built a driveway in 1987 that bi-sects the southern portion of the wetland/swale that may also impede the natural southern surface water flow of the wetland. In the correspondence supplied by Ms. Pidgeon, it was reported that the culverts under this driveway are set at an elevation of 980.0 feet mean sea level (MSL), which is approximately two feet lower than the wetland elevation of 982.1; however, the water seems to be blocked at the south property boundary and does not appear to be reaching these culverts. Conclusions In conclusion, it is Pinnacle's opinion that the majority of the current wetland area at the Site was historically a Circular 39, Type 1 or 2 wetland swale (seasonally flooded & wet meadow wetlands, respectively) that has had its natural outlet blocked at the Sites south property line, and possibly further south at the driveway that bi-sects the wetland, which has, in turn. flooded the Pidgeon property and changed the wetland type to a Circular 3Q Type 4, deep marsh wetland. It is also possible that there was historically a drain tilc line that helped drain this wetland that has since been rendered inoperable. Correspondence i supplied by Ms. Pidgeon indicates that the City of Orono, the Minnehaha Creek Watershed District, and Bonestroo Rosene Anderlink and Associates all visited the Site during the mid 1990's, agreed that there is a drainage issue here, even recommended that a swale be constructed, but nothing has been done to resolve the problem and the Pidgeon's property has continued to be flooded. Pinnacle recommends lowering the current water level to convert the wetland back to its original condition of a Type 1 or 2 swale. Sincerely, PINNACLE ENGINEERING,INC.
