We do not allow temporary structures or seasonal housing. All structures would need to be located in a conforming
location and meet applicable City Code requirements. The property is located in LR-1B zoning district and within the
Shoreland Overlay District. An average lakeshore setback variance, at a minimum, is required in order to place principal
(and accessory) structures on the property.
Pasted below are questions and staff responses (in Red) provided to another individual who inquired about this property
last fall. I thought some of the answers would be helpful to you.
No accessory structures would be allowed on the property when there is no principal residence structure.
1. Can we camp on the lot with a tent trailer or pull trailer? Very limited - see 78-1577(2)
2. Can we camp on the lot with a tent? No If so, how big of a tent can we pitch, and can the tent stay up for
the entire summer? No
3. Can we put a concrete picnic table on the lot? No - if concrete, it will be considered as an accessory
structure without principle structure
4. Can we pull a boat up to the shore? How long can we leave it there for? Only allowed while owner is
present- storage of boat on shore not allowed per 78-1577(4)b.
5. Can we get a buoy? Is that through you or the Lake Minnetonka conservation district? Buoys are under
jurisdiction of LMCD and/or Water Patrol - City will oppose approval
6. Can we put in a permanent dock? No - docks are an accessory structure
7. Can we put in a seasonal dock? One on wheels. No - docks, even on wheels, are an accessory structure.
8. Can we put in a floating dock? No - floating docks are an accessory structure.
9. Can we put out a water trampoline? Not City jurisdiction - See LMCD and Water Patrol
10. Can we put a rope swing into the water? Yes
11. Can we put a swing set on the lot? No - swing set is an accessory structure (private recreational
facility per 78-329)
12. Can we put a TeePee on the lot? No -would be considered as an accessory structure
13. Can we have a firepit on the lot? Recreational bonfires would be allowed per City and Fire Code
requirements but a permanent fire pit would not be allowed.
14. Can we build a tree house? No - considered as an accessory structure
15. Can we anchor a boat on the water in front of the lot? How long can it be there? LMCD jurisdiction -
City will oppose if allowed other than when owner is present
16. Can we drive ATV, Mini bikes, and snowmobiles on the lot? Only to the extent they do not cause a
public nuisance
17. Can we plant a garden on the lot? Yes, but cannot clear-cut the trees or do intensive vegetation
clearing within 75 feet of shore...

18. Can we put in a hand pump well on the lot? Yes, subject to State Well regulations -we don't know
whether this is feasible.
19. Can we have a portable biffy style toilet on the lot? No -would be considered as an accessory structure
and likely prone to vandalism
20. Can we have a canoe, paddle boat or jet skis pulled up on the lot? For how long?No - see Code Section
78-1577(4)b.
21. Can we create any patio or hardscapes on the lot?No If so what materials can we use? NA
22. Can we build a picnic shelter on the lot for the picnic table? No - considered as an accessory structure
23. Can we have permanent bench by the water on the lot? No - considered as an accessory structure
24. Can we fish from the lot? YES
25. Can i park my car on the lot? For how long? Yes, but cannot store it there
26. Can I put gravel down for a parking spot for the car? Yes -within limitations of hardcover ordinance,
and requires a land alteration permit
27. Can I modify the steps into the lake that are existing? Cannot modify or expand - can repair or replace
in-kind only, i.e. same shape, same size, same location.

Subject: Lot on Orchard Beach PI - Can a shed or gazebo be placed on this lot?
I am interested in the lot attached below. I am wondering if a camper can be placed on it for the summer, removed in
the fall. Can a shed or gazebo be built on it?
The listing agent said it is unbuildable but that is the extent of the information he has.
