I have put much effort into this project and the other project in OLIVER HILL in order to get the best possible information for use by my clients and the City of Orono; however, I am already way over budget and my frustration level is at a maximum. We are very busy -- busier than we have been all year, and this was the busiest year post-recession. I do not have the extra time to make any more revisions for this project. That said, I respectfully refuse to submit another revision to the survey with the contour you are requesting. Moreover, I don't have the detailed contour information from the grading plan, only the 2 foot contour lines that the engineer shared with me. I do not have the capability to precisely calculate the contours to a tenth. Please consider using the sketch that Mike has completed. I can provide nothing better than that. In order for the lowest level to qualify as a basement at least 50% of the perimeter must be at the 1002.8' elevation or lower. If the lowest level can't meet the basement definition, the house will be a 3-story home where 2 % stories are allowed by code. As I've calculated it currently it doesn't appear to meet the 50%. A basement shall be considered as a story for purposes of determining the number of stories in a building, when the finished surface of the floor above the basement is more than six feet above the existing ground level for more than 50 percent of the basement's perimeter. The perimeter of the basement does not include portions of the house or garage that do not have a lower level but are merely"unexcavated". Artificially raising the grade adjacent to the foundation of a structure (by filling or by a combination of filling and retaining walls) above the surrounding natural terrain shall not be allowed as a method for converting a defined story to a defined basement, regardless of any other benefits to the property of such action. Finished grade that increases more than one foot from existing ground level shall be considered as artificially raising the grade. However, artificially raising the grade when such action merely restores a previously excavated site to its original natural grade may used as a method for converting a defined story to a defined basement. Building height means the vertical distance between the highest adjoining ground level at the building or ten feet above the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost point on a round or other arch-type roof, or the median height of the highest gable of a pitched or hipped roof. Topographic changes which elevate the adjoining ground level above the existing terrain shall not be considered in determining building height. For a pitched or hipped roof situation, regardless whether the highest living space in a building is a half-story or full story, if the highest living space contains windows (excluding skylights)the upper measuring point for defining building height shall be the median height of the top of the highest window and the highest peak of the roof. Half story means the uppermost floor of a building in which (i)the intersection of the exterior wall and the roof is not more than three feet above the floor elevation, and (ii) not more than 60 percent of the floor area within the exterior walls of the uppermost floor exceeds five feet in height as measured from the floor to the rafters. In order for the lowest level to qualify as a basement at least 50% of the perimeter must be at the 1002.8' elevation or lower. If the lowest level can't meet the basement definition, the house will be a 3-story home where 2 1/2 stories are allowed by code. As I've calculated it currently it doesn't appear to meet the 50%. However, artificially raising the grade when such action merely restores a previously excavated site to its original natural grade may used as a method for converting a defined story to a defined basement. Building height means the vertical distance between the highest adjoining ground level at the building or ten feet above the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost point on a round or other arch-type roof, or the median height of the highest gable of a pitched or hipped roof. Topographic changes which elevate the adjoining ground level above the existing terrain shall not be considered in determining building height. For a pitched or hipped roof situation, regardless whether the highest living space in a building is a half-story or full story, if the highest living space contains windows (excluding skylights)the upper measuring point for defining building height shall be the median height of the top of the highest window and the highest peak of the roof. Half story means the uppermost floor of a building in which (i)the intersection of the exterior wall and the roof is not more than three feet above the floor elevation, and (ii) not more than 60 percent of the floor area within the exterior walls of the uppermost floor exceeds five feet in height as measured from the floor to the rafters. A copy of the plan is attached along with a sketch showing its location on the lot. As you can see, there is livable space under the garage, in order to allow the garage perimeter to be included in the basement area calculation. Please review the house location on the sketch and let me know where you would calculate the 50% contour line. It is difficult for me to anticipate how you would draw that line, since the house is not parallel with the contours in the area of the garage. there is a very light grey dashed line splitting the house. Above that line, the perimeter is 100.66 1 feet and below what line the perimeter is 110.00 feet. We were initially hoping for the 50% line to be around 1004, but it looks more likely that it would be around 1003.5. Please let me know what you think. If the approximated 1003.5 contour ends up being the one you use, then the proposed floor elevations would be as follows: Main Floor=1009.5 Top of Foundation=1007.9 Garage Floor=1007.3 Basement=999.1 In that scenario, the lowest floor is 0.7 feet below what is called for on the grading plan, so the contractor would need to verify that with Marty Campion and on site before building the house. Please note for all future projects where this elevation and calculation are critical,you should show the actual elevation contour(or spot elevations at the home's perimeter)on the survey and perimeter calculation at the time of permit submittal. Also, we have recently changed our survey requirements, copy attached. One of the new requirements is to show the point or spot where the top of the foundation elevation reference elevation point is being measured from; we expect this to be consistent with the measurement on the foundation as-built. Please show the measurement point on the survey. Another new requirement is the need for a landscape plan at the time of building permit submittal. The survey must show all proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc. We need the final landscape plan to be submitted and approved before we will issue the building permit. Recitals 1. Construction of the new residence located at 2350 Oliver Hill the ("Subject Property"), legally described as Lot 1. Block 1, Oliver Hill in Orono, Hennepin County Minnesota, is the subject of building permit application number 2015-01046 has been completed. 2. Winter conditions currently prohibit completion of exterior improvements,final grading,and vegetation establishment. An as-built survey cannot be accurately conducted at this time. 3. Owners request the City issue a temporary certificate of occupancy("TCO")to the Owners so that the Owners may occupy the new residence. 4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of exterior improvements, continuation of erosion control and submittal of an as-built survey to the City. NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,the Owners shall deposit$10,000 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to the City for all out-of-pocket costs the City has incurred(including planning,engineering, in excess of$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with building permit#2015- 01046 if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement two times per year to determine whether the requirements of the project have been successfully completed and whether it is appropriate to return the funds. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject property pursuant to Minn.
