The 2012 Fee Schedule indicates a Connection Fee to Orono of$16,720 due at the time of connection. This is the current cost based on the original 1973 project unit cost. - Additionally,this is a category 3 property under the .. e Cove S&W Agreement between Orono and Long Lake. Because the 1973 sewer system discharges ' . he •ng Lake system, any new connections to it also will be charged a City of Long Lake connection fee of 1900( 112 Fee Schedule) which we collect and pass through to Long Lake. That is detailed in the at ched Code excerpt. In the case of a sewer connection, we would base the required escrow on the bid cost of ma ing the sewer connection. - We can document that this property paid a $425 SAC chane in 1982 when the house was built, at a time when Met Council was collecting SAC on any new home regardle s whether it was being connected to sewer. (a) No owner of a tract of land upon which a dwelling is located, or a tract of land upon which a structure which is required to have an individual sewage treatment system is located, shall sell or transfer to another party said tract of land, unless the following requirements are met: (1) The seller of any property having an individual sewage treatment system shall have a state licensed inspector or designer I complete the Minnesota Pollution Control Agency (MPCA) sewage system compliance inspection form for existing sewage systems in accordance with this article and Minnesota Rules chapter 7080. The exception would be a new septic system installed within the previous five years or a compliance inspection performed by a licensed inspector or designer I within the previous three years. (2) The seller must provide a copy of the completed sewage system disclosure form and the certificate of compliance or notice of non-compliance to any person who signs a purchase agreement. The disclosure form and certificate of compliance or notice of non-compliance inspection form must be provided to the buyer prior to signing the purchase agreement. (3) The licensed inspector or designer I must submit a copy of the certificate of compliance or notice of non-compliance to the city within 30 days of the date of inspection. (4) If the existing system is found to be out of compliance it must be brought into compliance prior to transfer of the property. If the system is not brought into compliance prior to transfer, the seller shall provide the buyer sufficient security in the form of an escrow agreement to assure the installation of a complying ISTS. (5) If the seller fails to provide a certificate of compliance, the seller shall provide the buyer sufficient security in the form of an escrow agreement to assure the installation of a complying ISTS. In 1986 Met Council discontinued requiring SAC charge collection for new home construction when those homes were not being connected to the sewer. In 1989 Met Council offered metro area cities the option of a SAC refund program, in which properties not connected to sewer but which had paid the SAC charge would get a refund. Orono, like many other cities,opted out of this refund program, preferring to keep those SAC credits on file as 'paid in full'for those homes, many of which would eventually have sewer become available. In the past 24 years we have connected many existing homes to the sewer system and those for which a SAC charge was paid between 1973 and 1986 were not required to pay an additional SAC charge. We have continued down this path without any problems. However,today I received information that I hope is incorrect. I was told that a property that paid the SAC charge in 1980 but never connected to the sewer because it wasn't available, and never got a SAC refund, would be subject to the current SAC charge. Apparently there is some sort of"look-back" period of seven years, and this is where my confusion begins. Please confirm for me that existing homes for which we can document a SAC was paid and forwarded to Met Council in the period 1973-1986, and which are just now being provided with sewer, will not be subject to an additional SAC charge.
