Regarding your grading plan survey dated June 18 received for the house on Lot 5, I do have a question regarding contour labeling at the east end of the house.Attached is a group of 4 depictions of Lot 5. These were all scanned as 11x17 and should have matching scales if all 4 sheets are printed at 11x17. Sheet A—Sketch overlay of originally approved 'proposed grades'onto an early version of the building permit survey for Lot 5. Sheet B—As built grading survey just received from you.When overlayed onto Sheet A, confirms that the currently existing graded pad for Lot 5 was graded to extend further eastward than the approved grading plan. Sheet C—Schoborg building permit survey dated May 25 which shows the proposed house and the originally approved grades. This plan works in terms of floor elevations and number of stories. Sheet D—Your grading plan survey dated June 18 which tweaks the driveway layout and adds a retaining wall. East of the house,the background contours appear to include a contour labeled 994 that does not show up on any other sheets, and then labels the contour at the base of the pad slope as 996 rather than the 994 shown on the other sheets. I'm assuming this is incorrect. Please provide a grading plan survey that correctly depicts the background contours. Call me if any of this needs better explanation.Thanks! It seems there is an extraneous contour labeled 994 on your survey that is not on the Schoborg survey dated 5/25/15. It made the calculation process much more understandable. Since your message last week,my client has discussed this project with the owner and with the engineer who will be working with us from here on out, Marty Campion.They decided to lower the basement floor by 0.5 feet and then move the house to the point at which at least 50%of the perimeter is at or above the 997.5 contour(0.5 feet lower than the plan that you analyzed and used the 998 contour,because the basement floor will be 0.5 feet lower). We have revised the survey accordingly.As you will see,the house is moved back by 0.4 feet from the previous revision, and the perimeter of the footprint of the house at or above the 997.5 contour line is 86.3 feet(see the note on the left side of the survey). We put the"new existing grade"(grading plan)contours back on the survey, instead of the current existing grades. From here on out, Marty Campion will be designing the proposed contours on this project. Please review the survey and let me know if there are any other changes that need to be made or obstacles to overcome before the permit can be granted.Thank you for your help. See attached drawing. Square footage has nothing to do with it— it's the percentage of the lowest level's perimeter length that determines whether lowest level is a basement or a story. Based on the survey and house plans, the basement floor elevation is 994.0, main floor is (8.67 + 1.5) = 10.17 feet above that or elevation 1004.17. Critical 6' exposure elevation is therefore 998.17. The total perimeter of the lowest level is 38 + 48 + 12.9 + 2 + 21.5 + 34 +4 + 11.9 (labeled on attached drawing as A thru H) = 172.3' The portion of the perimeter that has exposure of less than 6' is that portion of the perimeter west of points X and Y (I used 998.0 instead of 998.17) calculated as 1 + 2+ 21.5 + 34 + 4 + 11.9 + 7 = 81.4 ' Percentage of perimeter that has exposure less than 6' is 81.4' / 172.3' = 47.2%. In order to get to 50%, need to increase countable perimeter to 86.2'. 86.2—81.4 = 4.8 feet. This can be accomplished simply by moving the house 2.4 feet west, which will add 4.8 feet to the calculable perimeter. It looks like you may be able to do 1 that without encroaching on the side setbacks. Another option would be to reduce the basement ceiling height or lower the'basement floor enough so that the critical 6' exposure elevation is down around 997 or 997.5. Mike Michael P. To date, there has been a significant level of confusion and consternation on the part of all parties involved relative to Orono code requirements. The issues relate directly to: 1) the lack of an overall as-built grading survey for the subdivision; 2) the fact that on at least one lot the `existing grade' information provided for that individual lot does not match the grading plan that was approved during the subdivision platting process; 3) confusion as to how to interpret City codes regarding the measurement of building height and determinations of whether a lowest level is a story and whether an upper floor is a half-story; and 4) the fact that the height and basement vs. story determinations are required by City code to be based on pre-existing grade (for construction on raw unimproved 2 land) or the new existing grade (when new grades are approved via an approved grading plan for a new'subdivision). To clarify for all: Pre-existing grade is the site topography prior to any road construction or site grading to establish drainageways and building pads. New existing grade is the new topography that was approved to be established as part of the subdivision review and approval process, as indicated on the approved grading plan. Current existing grade is the actual topography created on the site by the developer's grading contractor, as it exists today. Issues Encountered to Date - Lot 5, Block 1: Based on the most recent submitted survey work, the current existing grades for Lot 5, Block 1 do not match the approved grading plan, and in fact have extended the created building pad approximately 10-15 feet further eastward than the approved grading plan. The proposed house for Lot 5 is significantly larger than the conceptual footprint on the approved grading plan (2800 s.f. vs. 1800 s.f.); is located much closer to the cul-de-sac than the conceptual house; has a lowest floor half a foot higher than the concept plan; and has a basement ceiling height half a foot higher than the concept plan. Taking into account all these factors, the proposed house's lower level would just meet the requirements for being a basement based on the 'current existing grade', but it does not quite meet those requirements based on the 'new existing grade' (likely need to slide the house 3' to the west to meet the requirement for lowest level being a basement). An issue here is that the driveway apron in front of the garages is proposed at a slope of 8%-13% and increases to 40% in the northerly 8 feet of the already limited-depth driveway backup apron. This would appear to be less than desirable, although not regulated by City code. Lot 3, Block 1: We have determined that the upper floor for the house proposed for Lot 3, Block 1 is a story, not a half-story. Our analysis was forwarded to the architect last Thursday. Lot 1, Block 1: We have spent a significant amount of time assisting Kelly in resolving the placement of a house on Lot 1, Block 1 in order to make that lower level meet the criteria to be considered as basement. The latest information we reviewed indicated a house plan for which the lowest level was a story by definition. This information was sent to Kelly on May 13. Subdivision As-Built Grading Survey Required. All of the above make it imperative that the City be provided ASAP an as-built grading survey that will identify for the entire subdivision whether the current existing grade matches the new existing grade established in the approved grading plan. Assuming the as-built survey will show that the actual grading does not match the approved grading plan, additional review will be needed to determine whether or not actual site grading changes are necessary. Whether or not the current existing grades match the approved grading plan, we will be using the approved grading plan as the new existing grade for building height and story determinations. Willi has advised that Schoborg Land Services will not have a crew available to complete an as-built grading survey for approximately three weeks. For the time being, we will only accept surveys for individual building permits if they indicate the approved grading plan contours as well as the proposed final contours. Road Construction. I have been advised by Willi that the first lift of asphalt on the road is anticipated to be placed this week. The issues relate directly to: 1) the lack of an overall as-built grading survey for the subdivision; 2) the fact that on at least one lot the 'existing grade' information provided for that individual lot does not match the grading plan that was approved during the subdivision platting process; 3) confusion as to how to interpret City codes regarding the measurement of building height and determinations of whether a lowest level is a story and whether an upper floor is a half-story; and 4) the fact that the height and basement vs. story determinations are required by City code to be based on pre-existing grade (for construction on raw unimproved land) or the new existing grade (when new grades are approved via an approved grading plan for a new subdivision). To clarify for all: Pre-existing grade is the site topography prior to any road construction or site grading to establish drainageways and building pads. New existing grade is the new topography that was approved to be established as part of the subdivision review and approval process, as indicated on the approved grading plan. Current existing grade is the actual topography created on the site by the developer's grading contractor, as it exists today. Issues Encountered to Date - Lot 5, Block 1: Based on the most recent submitted survey work, the current existing grades for Lot 5, Block 1 do not match the approved grading plan, and in fact have extended the created building pad approximately 10-15 feet further eastward than the approved grading plan. The proposed house for Lot 5 is significantly larger than the conceptual footprint on the approved grading plan (2800 s.f. vs. 1800 s.f.); is located much closer to the cul-de-sac than the conceptual house; has a lowest floor half a foot higher than the concept plan; and has a basement ceiling height half a foot higher than the concept plan. Taking into account all these factors, the proposed house's lower level would just meet the requirements for being a basement based on the 'current existing grade', but it does not quite meet those requirements based on the 'new existing grade' (likely need to slide the house 3' to the west to meet the requirement for lowest level being a basement). An issue here is that the driveway apron in front of the garages is proposed at a slope of 8%-13% and increases to 40% in the northerly 2 • 8 feet of the already limited-depth driveway backup apron. This would appear to be less than desirable, although not regulated by City code. Lot 3, Block 1: We have determined that the upper floor for the house proposed for Lot 3, Block 1 is a story, not a half-story. Our analysis was forwarded to the architect last Thursday. Lot 1, Block 1: We have spent a significant amount of time assisting Kelly in resolving the placement of a house on Lot 1, Block 1 in order to make that lower level meet the criteria to be considered as basement. The latest information we reviewed indicated a house plan for which the lowest level was a story by definition. This information was sent to Kelly on May 13. Subdivision As-Built Grading Survey Required. All of the above make it imperative that the City be provided ASAP an as-built grading survey that will identify for the entire subdivision whether the current existing grade matches the new existing grade established in the approved grading plan. Assuming the as-built survey will show that the actual grading does not match the approved grading plan, additional review will be needed to determine whether or not actual site grading changes are necessary. Whether or not the current existing grades match the approved grading plan, we will be using the approved grading plan as the new existing grade for building height and story determinations. Willi has advised that Schoborg Land Services will not have a crew available to complete an as-built grading survey for approximately three weeks. For the time being, we will only accept surveys for individual building permits if they indicate the approved grading plan contours as well as the proposed final contours. Road Construction. I have been advised by Willi that the first lift of asphalt on the road is anticipated to be placed this week. Once the first lift is installed, we should be in a position to begin issuing building permits. I understand Will Haack has requested a meeting. It is apparent that the actual encountered site grading at this location does not match the approved development grading plan (attached). The actual grading encountered by the surveyor apparently is a result of additional fill and grade elevation above the intended and approved development grading plan. No as-built grading plan for the development has been submitted as of this date to confirm the current actual grades match the approved development grading plan, and the final grading has not been approved. The issue is that the calculations for height and number of stories for all new home construction are intended to be based on the proposed grades shown on the approved development grading plan, not on the higher unapproved grades that apparently exist today. The proposed grades on the approved development grading plan establish the 'new existing grades'for calculation purposes. These concepts were discussed in a meeting on Friday May 8th regarding 2330 Oliver Hill. Please have the survey updated to reflect the approved development grading plan grades as existing grades.The survey should note that the existing grades are per the approved development grading plan dated 3-14-2014 and do not match the current field elevations. Also, In your review sheet, it doesn't say 1/2 of the highest adjacent grade. It just says to subtract the highest adjacent grade. That to me is 8'. Both these equations come out to 28'-11". I don't mean to pick a fight but there is quite a bit of work involved to change the roof pitch/height to make this work. I still don't see how I am doing this wrong according to your wording. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please provide two copies of an updated, full size certificate of survey which meets all of the City's survey standards (enclosed)and addressing the comments below. a. According to our survey requirements, contours must be shown extending 50' past the property boundaries. Please revise survey. b. The survey is showing a 4' sanitary sewer line. Please indicate whether the sewer line has been constructed or is depicting the proposed. If existing, please provide the as-built plan showing the sewer location. c. The building plans show proposed features, retaining walls, etc. that are not shown on the survey. The plans and survey should match. Please modify. d. The Survey does not depict any construction erosion control measures. A silt fence or other appropriate erosion control mechanism should be planned for and must be installed and Inspected by the City prior to any land disturbing activities. The Contractor must provide a minimum 24 hour notice prior to inspection. e. The road, Oliver Hill, has not been approved for construction on Individual lots. Please note we will not issue building permits until the road has passed our engineer's inspection and a wear course is down. 2. Building Height. The building plans reflect a house with a defined height of 31.25'. The plans cannot be approved as submitted. Please modify the building height to be 30 feet or less. Submit two (2) copies of updated buildings plans for our review. The city's definition of building height means the vertical distance between the highest adjoining ground level at the building or ten feet above the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost point on a round or other arch-type roof, or the median height of the highest gable of a pitched or hipped roof. Topographic changes which elevate the adjoining ground level above the existing terrain shall not be considered in determining building height. For a pitched or hipped roof situation, regardless whether the highest living space in a building is a half-story or full story, if the highest living space contains windows (excluding skylights) the upper measuring point for defining building height shall be the median height of the top of the highest window and the highest peak of the roof. The building plans show a future deck. lithe deck is not going to be constructed at this time, it must be removed from the construction plans. (For future reference,please assure the property's allowed 15%structural coverage level will support the additional structural square footage of the proposed deck.) 4. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater.The required escrow amount for this project is$2,500. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$2,500. 5. Sewer Availability Charge(SAC). The 2015 SAC is 2,485. This fee is determined by the Metropolitan Council Environmental Services(MCES),collected by the City and passed on to the MCES. 6. Long Lake Sewer connection. The 2015 Long Lake Sewer Connection fee is$1,900.00 collected by Orono. PLEASE NOTE, NEW 2015 PERMIT REQUIREMENT: Prior to the commencement of any exterior/landscaping improvements,i.e.patios,grading,sidewalks,retaining walls,etc.,a Zoning Permit will be required. Your project may trigger the Minnehaha Creek Watershed District's(MCWD)permitting requirements;please contact the MCWD directly at 952-471-0590 regarding your project. Please note,the City of Orono will not issue a building permit without a copy of MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of their permitting requirements.
