Item Description: Assessment Hearing for East Long Lake Sanitary Sewer Project
Assessment Hearing
The assessment hearing is the next step in the approval process. A pressure sewer system will be
installed which means all of the property owners will be responsible for the purchase, installation
and maintenance of their own residential grinder pump station. The proposed project assessment
is $12,700 for installation of sewer to the property line for each parcel in the project. This is the
maximum amount that can be assessed. The property owners may also choose to add a $5,000
allowance to their assessment for the purchase and installation of their grinder pump station. For
this option, the City will issue a $5,000 check to the property owner then include this amount in
their assessment. The total assessment, with the grinder pump allowance, would be $17,700.
Assessment Appeals
In order to be eligible to file an assessment appeal, the property owner must submit a written
objection to the assessment either before, or at, the assessment hearing. Submission of a written
objection to the assessment allows the property owner to file a formal assessment appeal within
30 days of the assessment hearing.
Exclusion from Project
City policy allows for property owners with conforming septic systems to request "exclusion"
from the project assessment. Continued use of the septic system is allowed as long as the system
remains conforming to the septic regulations. In the event the system becomes nonconforming to
any future septic regulations, connection to the sewer will be required at that time. Major repairs
or enlargement of the septic system are not allowed and will require connection to sewer.
Payment of a connection fee is required before connection to the sewer can be completed. This
connection fee will be the $12,700 project assessment plus annual cost of living increases. This
connection fee is adjusted annually in the City's fee schedule.

The proposed assessment is based on the project cost divided by eleven units. Only seven units
will be included in the project assessment. Three properties have new conforming septic systems,
and the owners have requested exclusion. The remaining unit, not assessed, is the Summit Beach
Park property. The following property owners have requested, and qualify, for exclusion from
the project. These parcels were not included in the assessment roll.

Award of Contract
The bid opening for this project was held on June 6th. Four bids were received for this project.
The Fox Ridge and East Long Lake projects were bid together. The lowest responsible bidder was
MinnComm Utility Construction Company, Mora Minnesota with a bid of$90,760 for the east
Long Lake portion of the project. A bid tabulation and letter of recommendation, from the City
Engineer, for a contract award to MinnComm Utility Construction Company is attached.
After construction is complete, and final costs are known the actual assessment can still be
adjusted downward, in a revised assessment roll, before submission to Hennepin County in
December. This assessment roll lists an 8% interest rate, past practice has been to lower the
interest rate dependant on the interest rate received on the project bonds. Eight percent is the
maximum interest rate that can be charged. The actual interest rate on recently completed projects
has been 6.25%.
Unless a large number of assessment appeal notices are received, we are recommending Council
approval of the attached resolutions to adopt the assessment roll and award the contract for this
project to MinnComm Utility Construction Company in the amount of$90,760 for the East Long
Lake portion of the project.
