LA18-000022 WHEREAS,Judson M. Dayton and Shelley Mydra-Dayton,trustees on behalf of The Judson M. For the purpose of the foregoing descriptions, the East line of the aforesaid Government Lot 7 in said Section 9, Township 117, Range 23 West of the 5th Principal Meridian, is assumed to be a due North and South line, Hennepin County, Minnesota, PID: 09-117-23-21-0001 (hereinafter the"Property"); WHEREAS, the Developer requested establishment of a building pad location lakeward of the average lakeshore setback line for proposed Lot 1, and WHEREAS, on March 19, 2018, after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, on March 19, 2018, the Planning Commission recommended approval of the preliminary plat including the building pad location for Lot 1 lakeward of the average lakeshore setback line; and 2 CITY OF ORONO iLOAt RESOLUTION OF THE CITY COUNCIL 1*ILG NO. 6857 .kESHO�� WHEREAS, on April 9, 2018, the City Council reviewed the application and the recommendations of the Planning Commission and City staff; and WHEREAS, the City Council reviewed the proposal at a regular meeting held on April 9, 2018, and hereby made the following findings with regards to this application: FINDINGS OF FACT: 1. This application was reviewed as Zoning File #LA18-000022. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above mentioned meetings, and any and all other materials distributed at these meetings are hereby incorporated by reference. 2. The Property is guided for Low Density Residential in the 2030 Community Management Plan. 3. The Property is located in the LR-1A One Family Lakeshore Residential Zoning District which requires a minimum of 2.0 acres and 200 feet of width; the Property contains 20.58 acres in area and has a defined lot width of over 700 feet at the lakeshore. 4. The Property is located within the Metropolitan Urban Service Area (MUSA). Sewer is available to the Property in Old Crystal Bay Road South. City Code (Sec. 82-224) requires the connection to sewer where available, however the Developer has asked for a waiver of this requirement until such time when the Property is further developed. They have provided acceptable septic system designs for the new Lot 1 as well as a new alternate site for the existing home on Lot 2. The City Council has the authority to deviate from the sewer connection requirement if they determine there are extraordinary conditions. 5. The Developer proposes that both lots be served by private septic systems and private wells for the following reasons: a. Ample Areas for Placement of Septic Sites. Because of the large lot size, the areas available for the placement of septic systems are also large. Nothing must be shoehorned in to fit the lots. b. Sewer Line Length. To connect to the public sewer system lying along Old Crystal Bay Road, would require an extraordinarily long sewer line connection. The connecting line, from Old Crystal Bay Road to the easterly line of the westerly lot would be approximately 1,000 feet. That is an extraordinary distance for a connecting sewer line. Then, after running westerly approximately 1,000 feet, the 3 �*4<f, OAt CITY OF ORONO RESOLUTION OF THE CITY COUNCIL yG NO. 6 8 5 7 kESHOpti connection to each lot would have an additional run of approximately 500 more feet, to reach the existing and planned improvements on the lots. c. Cost. The cost to install a connecting sewer line of the length stated above would be approximately $50,000. To run connecting lines from the common line to the improvements on the two lots would add approximately $42,000 for the main lot, and approximately $32,000 for the westerly lot, for a total cost of about $120,000. d. Environmental Impact. A private sewer line that must be excavated over the distances here in question would have a greater effect on the environment, than would a sewer line of a more typical shorter length. 6. The Property is within Tier 1 and hardcover on each lot is limited to 25% according to the Stormwater Quality Overlay District Map. 7. The Property will be subdivided as a front lot/back lot division resulting in 2 buildable lots and platted private driveway outlot. Both lots conform to the size and width requirements of the City Code for the LR-1A district and back lot subdivisions. 8. Lot 1 will be defined as a back lot meeting the requirements of City Code Sections 78- 1370 and 82-256; the setbacks for rear and side yards on Lot 1 shall be 150% of the LR- 1A setback requirements. 9. Access to the Property is via the existing driveway to be contained within a platted outlot serving both Lots 1 and 2 off of Old Crystal Bay Road South (CSAH 84), a public street. Lot 2 will continue to also maintain a secondary access via the driveway to the south. 10. The Developer has prepared grading plans to manage stormwater on site without negatively impacting adjacent parcels. 11. The Developer has proposed grading on Lot 1 to establish a new engineered grade for building height determination. 12. In considering this application for average lakeshore setback variance, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed subdivision upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The existing Dayton home at 825 Old Crystal Bay Road South (new Lot 2) and the home at 3051 Farview Lane determine the average lakeshore setback line for the home on Lot 4 4LOA CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 6857 -fKESHG0. 1. The Developer has proposed a building envelope area on the plat drawing to reflect their desired encroachment. The home would be permitted as close as 80 feet from the ordinary high water level. The orientation of the Dayton home to the east is facing mostly directly south and east and is such that no views of the lake will be impacted by the location of a home on Lot 1. The home at 3051 Farview Lane has no lake views over this Lot 1 due to the existing trees and topography as well as their own home's orientation to lake which are primarily western views. 13. The Park Fee is determined as 8% of the fair market value of the land being subdivided, but must be between a minimum of $3,250 and a maximum of $5,550 per residential dwelling unit. For the proposed development, the Park Fee would be based only on the new lot. The City will confirm the park dedication required at the time of final plat. The Parks, Trails and Open Space element of the Orono Community Management Plan (CMP) has plans for trails that may specifically require dedication of land from the Property. To accommodate a future trail, a 10' wide trail easement along the Old Crystal Bay Road frontage should be granted as part of the plat as suggested by the Parks Commission. A 33-foot right-of-way dedication to Hennepin County is shown along Old Crystal Bay Road South. 14. The Owners have submitted a Conservation Design Report prepared by Jacobson Environmental which inventories and describes the environmental features of the site, defining what natural values of the site should be preserved or enhanced and how that should occur. 15. According to the Jacobson Report, the Developer will be implementing a 20-foot wide no- cut buffer along all proposed lot lines (10-feet on either side of the interior lot lines within the plat) to preserve the existing trees for screening. Significant trees may only be cut if they are diseased or damaged, and will be replaced at a 2:1 ratio. The Jacobson Report states that reed canary grass was identified within the wetland basins on proposed Lot 2; no management is proposed. CONCLUSIONS, ORDER AND CONDITIONS: NOW, THEREFORE, BE IT RESOLVED, based upon one or more of the above findings, the Orono City Council hereby grants Preliminary Plat Approval to allow the subdivision of the Property into 2 building lots and one outlot, with an established building pad location 80 feet from the ordinary high water level, lakeward of the average lakeshore setback line for Lot 1, as depicted on the preliminary plat drawing and grading plan dated 02/21/18 prepared by Gronberg and Associates, attached as Exhibit A, subject to the following conditions: 5 CITY OF ORONO sLOAr RESOLUTION OF THE CITY COUNCIL y*IL NO. 6857kESHO�-G 1) Approval is subject to Minnehaha Creek Watershed District (hereinafter the "MCWD") approval and permits as required. Final Plat approval shall not be granted until the Developer has provided evidence that all required MCWD permits have been obtained. 2) Approval is subject to Hennepin County approval of the proposed private driveway location, right-of-way dedication, and permits as required. Final Plat approval shall not be granted until the Developer has provided evidence that all required Hennepin County permits have been obtained. 3) The Developer shall address the applicable general engineering comments and/or conditions provided by City Engineer in a memo dated March 15, 2018 attached hereto as Exhibit B with the final development plan submittal. 4) Regardless of timing of construction on Lot 1, the Average Lakeshore Setback for Lot 1 shall be 80 feet from the ordinary high water level. 5) The Property was not assessed for sewer; nor was a sewer stub installed when the sewer was constructed in Old Crystal Bay Road. Connection to City sewer shall be deferred until such time when Lot 1 or Lot 2 is further developed. 6) Development shall adhere to the proposed Jacobson Conservation Design Report. 7) Erosion control shall adhere to "Best Management Practices for Protecting Water Quality in Urban Areas" and to the approved SWPPP. All erosion controls as required by the City and the MCWD shall be in place prior to commencing grading and excavation on the site.All such erosion control measures shall be maintained in working order until the site is vegetated and stabilized. 8) The construction limits shall be clearly marked with adequate fencing to prevent any construction damage or disturbance of any trees and vegetation outside of the construction limits area. Developer shall identify trees to be preserved on site, shall mark them on a site plan, and shall take extraordinary measures such as fencing, signage, etc. to ensure they are not disturbed. 9) This approval is based upon the known issues that may affect this project, but this approval does not limit the City from revising or amending these conditions as the review process continues. 10)Upon evidence of resettlement history, the Developer shall cease all activity and contact the City and the State Historical Preservation Office prior to proceeding. 6 Ait.OArp CITY OF ORONO RESOLUTION OF THE CITY COUNCIL y� G1 NO. 6 8 5 7 t., -EsHOiLt 11)Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein. 12)Easements Required. a. Drainage and Utility Easements shall be dedicated to the public on the final plat 10' along all exterior property lines, and 5' either side of interior property lines, except such easements shall be increased to accommodate drainage where required, subject to City staff approval. b. A Drainage and Utility easement shall be dedicated to the public on the plat over the storm water pond area and storm water facilities. c. A Drainage Easement shall be granted over wetlands on the Property. d. A Public Trail Easement shall be dedicated over the easterly 10 feet of the Property, exclusive of any right of way. 13)Development Fees: a. Stormwater and Drainage Trunk Fee: The property will be subject to the 2018 Stormwater and Drainage Trunk Fee of$4,030.00 per acre. For the 2-acre zoning districts, any lot exceeding 2.0 gross acres, including wetland, shall be charged a maximum trunk fee equal to the trunk fee for a 2.0 acre parcel. Therefore $4,030 x 4 [2 lots x 2.0 = 4.0 total acres] = $16,120.00. b. Park Dedication Fee: [$5,550 x 1 new lot] = $5,550. 14)Plans and Specifications. The following plans and specifications shall be submitted for review and approval by the City and other appropriate jurisdictions prior to final plat approval, to ensure that the proposed plat will accomplish the intended purposes: a) Final grading, drainage and erosion control plan showing existing and proposed contours, anticipated building locations, elevations, stormwater facilities and calculations, utilities and erosion control measures to be used during construction. Final Plat Approval will not be granted until the Minnehaha Creek Watershed District has approved the stormwater management plans. b) Final planting plan which shall include final driveway and entry planting plans with tree calculations. c) Final stormwater management plan. 7 -siLOAtp CITY OF ORONO RESOLUTION OF THE CITY COUNCIL y*1\11L- NO. 6857 G'ESHov- d) Final stormwater pollution prevention plan (SWPPP). e) Sufficient detail to meet the recommendations of the City Engineer. 15)Council approval is based on the entire record, above Findings.Any amendments to the plans which are not in conformity with City codes may require further Planning Commission and City Council review. 16)Authorities granted by this resolution run with the Property not with the Owners, but are permissive only and must be exercised by filing a Final Plat application within one year of the date of Council approval, or the preliminary plat approvals will expire on that date (April 9, 2019). If Final Plat approval is not granted by that date, the terms and conditions of this resolution shall be null and void. The City Council at its sole discretion may extend the effective period of the preliminary plat. FINAL SUBMITTALS: Developer shall complete all requirements for Final Plat Approval as follows. The following list of final submittals must be submitted to the Planning Department at least four(4) weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month. These submittals are as follows: 1. Record Plat Drawings. Record plat drawings in the form of two (2) mylar copies (one copy for the City's records and one for filing with Hennepin County) and one (1) copy reduced to 1" = 200'. A digital copy is also required. Drawing to include: a. Lot lines platted per preliminary plat survey/drawing by Gronberg and Associates dated February 21, 2018 attached hereto as Exhibit A, except as modified herein. b. Dedication of"Drainage and Utility Easements" 10' along exterior property lines, 5' along the interior property lines, and over the storm water pond, ditches and facilities. c. Dedication of"Drainage Easements" over the wetlands and drainageways. d. Name of plat. 2. Legal documents required: 8 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL yF G NO. 6857 t�kFSH0SLfc' a. Title opinion addressed to the City or a title insurance policy in favor of the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. b. The Developer must provide certified copies of all recorded easements currently affecting the Property. c. Signed Trail Easement over the easterly 10 feet of the Property. d. Signed Developers Agreement and Letter of Credit for construction of improvements. The City Engineer shall establish the amount to be provided in the Letter of Credit. e. A Drainage and Utility Easement shall be granted over the entirety of Outlot A. f. Access easements shall be provided over Outlot A for proposed Lots 1 and 2; a Maintenance Agreement for the driveway improvement should also be prepared by the Developer. g. Signed Tree Preservation Easement/Covenants. h. Signed Covenant to Protect Drainfield Sites. 3. Financial Guarantee. The Developer shall submit a final plat review escrow in the amount of$2,500.00 with the final plat application. Additionally, the Development Agreement shall include a financial guarantee by the Developer to ensure the completion of site improvements. The City Engineer shall complete an estimate of improvement costs, including but not limited to storm sewers, landscaping, grading, erosion control, utilities, driveways and stormwater management facility construction, and the applicant shall provide to the City a financial guarantee of 150% of the improvement costs. 4. Plat approval fees to be paid: Total due: $22,170 a. Final plat fee: $500.00. b. Park Dedication Fee: $5,550. c. We offer the following observations, comments, and recommendations for your consideration: 1. Per City Code,this location is designated for connection to City sanitary sewer when developed. However,the applicant has submitted an application for waiver of sanitary sewer connection due to perceived hardships. We have discussed this requirement and application for waiver with the City Engineer and defer to the City regarding sanitary service for this plat. 2. Perimeter erosion control measures(siltfence,rock entrance,etc.)should be indicated on the plan. If septic sites are allowed,protection fencing should also be installed around sites. Measures should be installed by the Contractor and inspected by the City prior to any other work. Contractor must provide minimum 24 hour notice prior to inspection. 3. Retaining walls 4' or greater in height must be designed by a licensed Professional Engineer. Tiered walls less than double the height of the lower wall apart will be considered one wall. Wall plans should be submitted for review and approval prior to construction. 4. It is unclear what is proposed for common driveway. If the driveway for Lot 2 is connected directly to Lot l's driveway instead of the common driveway in Oudot A, an easement for the shared portion will be necessary. 5. A Final Landscape Plan should be submitted with the Final Plans. The Plan should include the following: a. Types and locations of proposed restoration. b. De-compaction of existing soils under removed impervious surfaces with 12"ripping depth prior to placement of topsoil. c. Trees to be removed. d. Trees to be preserved. e. Additional trees to be planted. 6. A Flowage and Conservation easement will be required over all wetlands. 7. Drainage and Utility Easements should be provided as follows: a. Over all stormwater management facilities used to meet regulatory requirements. b. All swales and storm sewer providing drainage for multiple properties. c. 5' along all side lot lines, unless adjacent to Development boundary. d. 10' along all front lot lines, rear lot lines, and adjacent to Development boundary. 8. The applicant may be required to obtain Minnehaha Creek Watershed District(MCWD) approval and permitting. A copy of any approvals or permits required should be submitted prior to Final Plat approval. 10. If more than 1 acre is disturbed,the applicant will be required to obtain a General Construction Permit(NPDES)to discharge stormwater associated with construction activity. If required, a copy of the permit should be submitted prior to any land disturbing activity, and Final Plans should include a Stormwater Pollution Prevention Plan. 11. If the applicant is required to install stormwater management facilities on site to meet MCWD or NPDES requirements, a Maintenance Agreement should be submitted for all stormwater management structures and facilities and be recorded with the County. The agreement should define maintenance responsibilities following completion of project, specify types and frequencies of inspection and maintenance activities, designate who will conduct inspection and maintenance activities, and outline reporting requirements. 12.
