As the letter states,we will be processing these new potential violations separate from our erosion control permit#11-308 since it is clear that the impacts were caused by a new project undertaken by the property owners following completion of the construction of the home. It sounds like they're still waiting for their Certificate of Occupancy from you, which I thought might be able to occur since the impacts are not specifically relating to the construction of the home and we were able to verify that the buffer signs were installed correctly, but obviously you would make that call as to when you feel comfortable releasing it. Staff verified that the buffer signs had been installed in accordance with the approved plan, but new potential violations were observed and is described below: • Fill within a wetland o A large area of exposed soil was observed partially in the wetland at the east end of the property and partially in the required wetland buffer area. The area was apparently used for a hockey rink over the winter. It appeared the area had been graded (cut on the upland side and filled on the wetland side), and the grading appears to have resulted in fill within the wetland and buffer area. The site plan included in the declaration that is recorded on the property for the wetlands/ wetland buffers onsite and the presence of original wetland delineation flagging and buffer monuments indicates that the wetland and wetland buffer were impacted by the grading. • Mowing within wetland buffer east of the house o The wetland buffer along the wetland east of the house have been mowed where there should be no disturbance. Please take the following corrective actions immediately: • Install temporary soil stabilization (e.g. erosion control blanket) to the exposed soil area • Install perimeter control along the downgradient edge of the disturbance to prevent additional erosion impacting the wetland • Contact me at 952-641-4504 or cbach@minnehahacreek.org to set up an on-site meeting during the week of June 3-7,2013 to discuss a removal and restoration plan for the wetland & buffer impacts. Restricted activities within the buffer area are described in the declaration that is currently recorded on the property. Because it appears that these impacts were not associated with the work permitted under permit #11-308,these new potential violations will be addressed separately from the permit, and the permit will be closed out. Please contact me as soon as possible to address the situation informally otherwise we will need to initiate formal enforcement action and schedule a hearing with our Board of Managers Executive Committee.
