Heidi-Thanks for your email and time on the phone just now. As a recap of our conversation I will not be installing or
doing a new driveway as proposed on the survey. With the high cost of having to get a new survey I wanted to add it at
this time for down the road. The driveway will require a separate permit when I'm ready to move forward with that
work. The permit application submitted to both the city and the watershed is for the swimming pool and surrounding
stone patio around the swimming pool only. I appreciate you issuing the erosion control permit this afternoon. Please
let me know if you're able to mail it out or if you'd prefer I pick it up. If you'd be so kind to also email the permit
number to Christine Mattson, I'd appreciate it. Then she'll have what she needs for the city permit.
As for the adjacent lot, I intend to contact a wetland specialist this fall and develop a plan of action over the winter and
this plan can be done next spring. I was told the wetland specialist are extremely busy through the summer months and
typically run 4-6 weeks out for even looking at proposed projects. With looking at options to maintain the existing
failing culvert and look at options of making the pond larger, I was told this will be a larger undertaking and take a lot
more time and money. With this feedback I was told it would be best to start this process this fall when their starting
their planning for next seasons projects. I will keep you posted as this progresses. Thank you.

I apologize in the delay in getting back to you regarding your current MCWD application for a pool and
driveway at the above referenced property. I have been in and out of the office all week,and as you are
aware,we are a little short staffed. I just tried your cell, however,your mailbox is full.
Please be reminded that MCWD has 15 business to review permit applications,while we strive to turn
around applications in a shorter timeline, it often is not possible during the "busy" season. Your
application for erosion control was received on August 7th, 2017. The plans currently show a proposed
pool and new proposed driveway. There is no proposed erosion control downgradient of the proposed
driveway,or indication of what the construction entrance will be one the drive is removed,therefore
the permit application is incomplete.
Additionally, I was onsite last week to check out the vegetation is wetland 1 that was recently
reseeded. The vegetation looks good. Without having an as-built survey, I am unable to determine if
the original contours were restored and if all the fill was removed,currently there are some areas where
gravel is present. As environmental systems take some time to react to changes,this wetland will be a
site that MCWD continues to inspect for functionality. I would also like to discuss what your plan for
removing the fill that was brought into wetland 2. Back in June it was discussed and sent in writing that
you would work with a wetland specialist on a "restoration plan", if the restoration plan was not to be
pursued,then the fill that was brought into wetland 2 would be removed.
Furthermore, impacts that do not qualify as no-loss or exemption criteria within the Wetland
Conservation Act(WCA) would constitute as an impact requiring mitigation/replacement through WCA
in addition to triggering the MCWD wetland protection rule, which would require wetland buffers to be
declared to the property. Both wetland 1 and wetland 2 appear to be within 150'of the proposed pool
and driveway, which I believe will trigger the City requirement of an up to date delineation. Working
with a wetland specialist will provide you a clear path forward on if the sediment removal into wetland 1
was successful and how to appropriately remove (quantity and method)the sediment that was brought
into wetland 2.
I would like to discuss your timeline and plan for addressing the sediment/fill in wetland 2. If you do not
want to pursue working with a wetland specialist, I will call a Technical Evaluation Panel (TEP)to meet
onsite which will include representatives from MCWD,the City,the DNR, and Board of Soil and Water
Resources(BWSR) and possibly the Army Corps. The purpose of the TEP would be to develop an action
plan and then issue a restoration order which is handled through the DNR.

It is my hope that we can have a clear path forward on how to address the unintended impact to
wetland 2 without a formal cease and deist order from the DNR. I will be in the office for the remainder
of the afternoon and all day Monday, please feel to call me directly at the number below.

Chase about an erosion control permit for 820 Old Crystal Bay Rd for the last several weeks. I'll be
honest I'm running out of patience. We talked two weeks ago and he said Permit should be ready last
week and he'd update me mid week. We spoke Wednesday and he said it still wasn't ready but he'd let
me know Thursday or Friday. I didn't hear from him and now the front desk said he's out this
week. Can you please update me on this? It's a basic erosion control permit for a basically flat lot. I'd

Wetland 1 and reseeded this as discussed. Fill was removed from Wetland 2 but no

Hello everyone,
I'd just like to clear up a few things before moving forward, which I will list below:
• We have received the Erosion Control Permit Application for the pool.
• The previous Erosion Control Permit was cancelled for a few reasons:
o The grading work that was on the proposed site plan w/the application
had already taken place and as it turned out, it was in violation of
MCWD and Wetland Conservation Act regulations.
o During our onsite meeting we discussed the next steps and informed
Hans that no MCWD permit would be needed for the removal of

sediment/fill (noted in attached memo)or restoration of the wetland
closest to Old Crystal bay Road South.
• Please see the attached memo that Heidi sent out on 6/19/2017,which outlines
the site visit,the next steps to be taken,and DNR enforcement that will take
place if the restoration does not happen to our satisfaction.
• MCWD will need to revisit the site to ensure that the fill has been removed and
that the wetland vegetation has germinated and is sufficient,which I can do
next week.

Thanks Christine. Chase actually cancelled my watershed permit for the grading work
and him and Heidi just asked me to do the regrading and send photos of that as I've
done. I did what was asked so I assumed this stop work order had been taken care of.
Chase- I just left you a voicemail as well. We need two things.
1.To acknowledge the receipt of the erosion control permit and confirm you have
what's needed to issue the permit.

2.To acknowledge the grading project we discussed on site is closed and no further
information is needed. I've done what we discussed on site and sent prior photos of
the work.

Thank you for dropping off the updated surveys for the proposed pool
project. I wish you would have asked for me when you were here. We
will review the revised plans. Please note we are waiting for the MCWD
to issue an erosion control permit or documentation stating your pool
project does not trigger any of their permitting requirements.
Also, the City has no documentation from the MCWD stating you have
complied with their requirements and have adequately removed fill
from the wetland. The site visit was to give you direction on how to
resolve your violation, but it is not closed. The stop work order is still in
effect.
Continuing to work without proper permits and after a stop work has
been issued will result in this matter being forwarded to the City
Attorney for prosecution and/or issuance of a citation.

Christine -Thank you for your email. I was under the impression that
after Melanie, Laura, Chase and I met at my home and walked the
property we had a game plan. I've done what we discussed and thought
the stop work order was put to bed. Please let me know if I'm missing
anything and what further needs to be done. I apologize for the two
small loads of fill dumped along by gravel turn around. We had a friend
back off the edge of the gravel and get her car hung up on the steep
ledge. As your picture shows the two small loads (4 loads each) 8 yrds
total was dumped along the edge so I could feather out the steep bank
from the gravel to the lawn. Please let me know if I'm mistaken on the
stop work order and if anything further needs to happen. I would like
to bring one more load (4 yrds)to smooth out this transition. I will hold
off on this until I hear how you'd like me to proceed. I will also drop off
two copies of the revised survey tomorrow morning to your
office. Please let me know how to proceed on the dirt. Thanks.
Chase- Please confirm you've received my permit application for an
erosion control permit and let me know if you need anything further.

Summary:
On December 29th, 2016 the City of Orono Staff discovered unintentional and unpermitted filling of
wetlands located at 820 Old Crystal Bay Road South in the City of Orono.
City& MCWD staff met onsite on June 16th to discuss proper mitigation measures to bring the site into
compliance with City, MCWD, and the Wetland Conservation Act(WCA) regulations.
On June 11th, 2011 a Notice of Decision (NOD)for Boundary and Type confirmation was approved
(MCWD W10-19),delineating 3 wetlands on the property. While the NOD expired on June 20th, 2014, it
was used as an indicator for the location of the existing wetlands.
Wetland 1 was identified as a Type 2 Fresh Wet Meadow 3,841 sf in size; Wetland 2 was identified as a
Type 2/4 Fresh Wet Meadow surrounding a Deep Marsh 38,243 sf in size; and Wetland 3 was identified
as a Type 3 Shallow Marsh 3,617 sf within the property boundary.

Next Steps:
The fill that was brought into Wetland 1 will be removed,the contours will be restored,and the wetland
will be re-seeded with 34-262 Wet Prairie or 34-271 Wet Meadow seed mix or a similar seed mix
approved in writing by MCWD.
Without knowing the exact wetland boundary,there appears to have been fill brought into the Fresh
Wet Meadow portion of Wetland 2. At an unknown time,there was a culvert installed within the Deep
Marsh portion of Wetland 2,which may or may have not altered the hydrology and affected the wetland
boundary. Hans has expressed interest in excavating portions of wetland 2 and doing vegetation
improvements. MCWD staff suggested that Hans work with a Wetland Specialists to make a plan and
apply for the appropriate WCA/MCWD permits prior to any work commencing within the wetland 2
boundary. In the event that a "wetland restoration plan" is not pursued,then the fill brought within
Wetland 2 will be removed, contours will be restored,and the site will be re-seeded with the same or
similar seed mix as suggested for Wetland 1. Please note that excavation that exceeds the limits of No
Loss/Exemption criteria will be considered an impact and will require a replacement and sequencing
plan.
There were no observed impacts to Wetland 3.
Failure to comply with sediment removal of Wetland 1 and/or the restoration (or sediment removal)of
Wetland 2 shall be documented as WCA violation and will result in a DNR cease and desist order along
with an ordered restoration plan.
No MCWD permit will be required for the sediment removal within wetland 1 as it will not meet the
threshold to trigger the Erosion Control Rule. MCWD staff encourages the use of proper perimeter
control measures to keep sediment from leaving the property.

Thanks Christine. Chase actually cancelled my watershed permit for the grading work and him and Heidi just asked me
to do the regrading and send photos of that as I've done. I did what was asked so I assumed this stop work order had
been taken care of.
Chase- I just left you a voicemail as well. We need two things.
1.To acknowledge the receipt of the erosion control permit and confirm you have what's needed to issue the permit.
2.To acknowledge the grading project we discussed on site is closed and no further information is needed. I've done
what we discussed on site and sent prior photos of the work.

asked for me when you were here. We will review the revised plans. Please note we are waiting for the
MCWD to issue an erosion control permit or documentation stating your pool project does not trigger
any of their permitting requirements.
Also, the City has no documentation from the MCWD stating you have complied with their requirements
and have adequately removed fill from the wetland. The site visit was to give you direction on how to
resolve your violation, but it is not closed. The stop work order is still in effect.

Thank you for the update Chase. I did receive this letter and have removed the fill from Wetland 1 and reseeded this as
discussed. Fill was removed from Wetland 2 but no work has been done as that will be a future work requiring working

forward to it. Also please let me know when you'll be able to issue the erosion control permit for the pool. Is that

Hello everyone,
I'd just like to clear up a few things before moving forward,which I will list below:
• We have received the Erosion Control Permit Application for the pool.
• The previous Erosion Control Permit was cancelled for a few reasons:
o The grading work that was on the proposed site plan w/the application had already taken place and as
it turned out, it was in violation of MCWD and Wetland Conservation Act regulations.
o During our onsite meeting we discussed the next steps and informed Hans that no MCWD permit would
be needed for the removal of sediment/fill (noted in attached memo)or restoration of the wetland
closest to Old Crystal bay Road South.
• Please see the attached memo that Heidi sent out on 6/19/2017,which outlines the site visit,the next steps to
be taken,and DNR enforcement that will take place if the restoration does not happen to our satisfaction.
• MCWD will need to revisit the site to ensure that the fill has been removed and that the wetland vegetation has
germinated and is sufficient,which I can do next week.

Chase—I know we cancelled the erosion control permit we had, but I need you to look at the attached swimming pool
permit and let me know if I need an erosion control permit for this project. Other then digging and installing the
swimming pool there is minimal grading going to be done around the pool as it sits nearly level with the existing
grade. We will be under 50 yards of soil being graded out. If you recall this pool will be located in the existing flat grass
lawn behind my home. Let me know if this triggers an erosion control permit needed from you.

On June 27, 2017 the City received a building permit application for a swimming pool. Staff conducted a preliminary
review based on the information provided and recommends the following items be submitted or revised in order for
your application to be considered complete and for the plan review to continue:
1. Pool Plan. Please submit two full-size copies of the proposed pool plans.
2, Site Plan. A site plan was submitted; however it does not meet the City's Site Plan Requirements. Please
1,7 provide two copies of an updated, full-size site plan which meets all of the City's site plan requirements
(enclosed). Please note our engineer has not reviewed the survey, so additional comments may be
forthcoming.
3. Landscape Plan. Prior to the issuance of the pool permit a landscape plan must be submitted showing all the
' proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc. The plan

should include the name of the individual performing the work. Any proposed patios, grading, sidewalks,
retaining walls shown on the landscape plan should also be reflected on the site plan.
4. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is$2,500. The City currently holds$2,500 in conjunction with a previous permit. You
submitted a signed escrow agreement. We have combined the two projects into one escrow agreement. A
copy of the escrow agreement is enclosed for your records.
5. Minnehaha Creek Watershed District (MCWD). Your project may trigger the Minnehaha Creek Watershed
District's (MCWDs) permitting requirements; please contact the MCWD directly at 952-471-0590 regarding
your project. Please note,the City of Orono will not issue a building permit without a copy of the MCWD permit
or documentation stating the proposed project does not trigger any of their permitting requirements.

Erosion control mechanisms must be installed and inspected by the City prior to any land
disturbing activities. The contractor must provide a minimum of a 24 hour notice prior to
inspection.
Erosion control shall be installed and maintained throughout the entire project and must
remain until vegetation has been established.
A haul route shall be submitted to the City Engineer for approval and inspection prior to
commencement of hauling from the site.The property owner shall be responsible for cleaning

This permit is not transferable without District approval, and is valid to the date of expiration. No
activity is authorized beyond the expiration date. If the permittee requires more time to complete
the project, an application for renewal of the permit must be received by the District at least 30
days before expiration.
The applicant is responsible for compliance with all District Rules and for the action of their
representatives, contractors, and employees.
Conditions: Project to be completed as described in plans submitted to the
MCWD office on August 7th, 2017 according to the provisions of this permit.
• Properly install and maintain all required erosion control measures until the
disturbed areas are re-stabilized
• Notify MCWD in writing upon completing installation of perimeter and
sedimentation controls
• When the site is re-stabilized and the MCWD staff has performed a final
inspection, all perimeter control must be removed

Inspection/Analvsis/Monitoring Fees
A site inspection and monitoring by District staff will be performed where the activity involves:
• a commercial/industrial/multi-family residential development
• a single family residential development greater than 5 acres or of any size if within the
Minnehaha Creek subwatershed
• any alteration of a floodplain or wetland
• dredging within the beds, banks or shores of any protected water or wetland
• a violation
• any project which in the judgment of the District staff should be inspected due to project
location, scope, or construction techniques
In these cases, the applicant shall pay to the District a fee equal to the actual costs of field
inspection of the work, including investigation of the area affected by the work, analysis of the
work, and any subsequent monitoring of the work, which in the case of a violation shall be at
least$35.

AGREEMENT made this 227 day of &we-- 20t=1 , by and between the CITY OF ORONO, a
Minnesota municipal corporation ("City") and 4-VA .e� ("Owners").
Recitals
i'
1. A buildinrmit application has been filed forlocated at

2. Owners request the City to review this application which requires City approval and may require consultant
legal and/or engineering review.
3. The City will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the
Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its
cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-
of-pocket costs the City has incurred (including planning, engineering, in excess of$500, or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under
a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City
has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the
provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous
conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work
(including planning, engineering, or legal consultant review) associated with building permit # 2015 -ember if
compliance with the approved building permit is not accomplished. 2-00-0011'1-

017-dpii -3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill
to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the City
within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced pursuant to
#3. The City may draw from the escrow account without further approval of the Owners to reimburse the City for eligible expenses
the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners when
all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement two times
per year to determine whether the requirements of the project have been successfully completed and whether it is
appropriate to return the funds. Owner may also request the release of the funds, and such funds shall be released upon
City Staff receiving the appropriate verification that all requirements of the project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses incurred
by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the subject property
pursuant to Minn. Stat. §§ 415.01 and 366.012.
