Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 July 24, 2003 Tim Lembke 4445 Forest Lake Lan ing Orono, MN 55364 Re: Potential for Rezo 'ng Properties on Old Crystal Bay Road Dear Mr. Lembke: We are in receipt of yo inquiry regarding the possibility of rezoning your property on Old Crystal Bay Road North, and adjacent properties, from RR-1B: Single Family Rural Residential to I: Industrial. Please be advised that the City of Orono adopted its 2000-2020 Community Management Plan (referred to as the CMP knowing full well the location and general parameters surrounding the new routing of Highway 12. The Council spent considerable time reviewing the potential impacts of the Highway 12 route and ow it might affect the City's ability to maintain a rural character in central Orono. The conclusion reache was that all areas south of the relocated railroad would remain guided and zoned for low-density s ngle family development. While it was anticipated that properties adjacent to or near the corridor ould be affected by the highway noise, it was also anticipated that two factors would help to itigate the noise impacts. One factor, which was also a key factor in the decision to use the B corridor as the location for the new highway, is that the BNRR corridor is an existing transportation corridor that already has impacts, such as noise, on the adjacent properties. Another factor was that the location of the highway,approximately 20 feet below grade, would substantially mi 'gate the noise impacts. The BNRR corridor h s served for many years as the transition point from industrial uses to residential uses. The co 'dor itself has been both a barrier and a buffer between the two uses. If this transition point was to e moved south of the corridor,it would cause three major problems. First, there would no longer e a clear transition point between industrial and residential uses. Second, there would no longer e a buffer between industrial and residential uses. Third, the new area of industrial uses would h ve a substantial negative impact on the existing rural residential uses to the west, south and east. To do so would bring added commercial traffic and activity nearer to existing residential neighborhoods that developed with a reliance that the City would not further encroach on them with non-residential uses. From a staff perspective,I can offer no support for your proposal. It is completely opposite from the direction in which Oroo has been moving for the past 30 years or more, and I would expect little or no public support d no support by the City Council for anything but low-density residential south of the corridor. j The process for your rejuest, should you wish to pursue this further,would first involve a formal application for a Compiiehensive Plan Amendment,involving a public hearing process and reviews by the Planning Commission,Park Commission and City Council.In the highly unlikely event that such an application wase successful, a formal application would have to be submitted by the City to the Metropolitan Council for approval. Your estimation of 6-8 months is optimistic for a proposal with strong City support; for a proposal such as yours, that would have potentially significant impacts on the character of rural Orono and result in the need for new infrastructure,I can give you no realistic timeline. Mr Gaffron, I read in the loll aler complaints omplamts from residents on Old Crystal Bay Road about the railroad moving closer towards them. Obvious complaints would be the noise, vibration, and dust. Under the current plan for the area what is now residential will become undesirable and unsuitable for everyday living. I contacted Cou acilmembers Jim White and Bob Sansevere. Jim mentioned he would bring 4 up with you because it is a timely issue. Bob e-mailed me back promptly, urging me to contact you. The attached map shows my property and areas crosshatched that I would support a rezoning to Industrial. If my map were larger the crosshatch would go further East. I have a rental house on my property and don't feel I could rent it out after the tracks are reh cated. The best use of the property would be Industrial. I know the process of rezoning is a 6-8 month ordeal involving hearings, applications, and$neetings. I appreciate your attention to this timely matter. Th !
