Only the wetland on the property needs to be delineated. We don't require a wetland delineation for a demolition permit. The need for the delineation was identified on the zoning disclosure form,which the owner signed acknowledging the requirement. Let me know if you have any additional questions. I just want to verify their restrictions do not matter and the city code prevails? Do we have to delineate both wetlands or just the wetland on this property? If the city was aware of the wetland on the property at the time of the demo permit,why were the owners not required to delineate the wetland at that time? City maps indicate a wetland in the same general area as you have shown, however this is not reflective of a delineated wetland edge. The actual wetland could be larger or smaller than shown. Unfortunately the code doesn't allow any option but to wait until a wetland delineation can be completed and submitted to the Minnehaha Creek Watershed District(MCWD)for approval. Please note when the home and accessory structure were demolished,the property owner was made aware of a wetland on the property by the City's Zoning Disclosure Form. Attached is a copy of the Zoning Disclosure Form signed by the owners Angela Hay& Norman Hay. When weather conditions allow, please have the wetland delineated, approved by the MCWD and shown on the survey for our permit review to continue.
