We are writing to bring some clarification to some of the issues and events referenced in your letter. With regard to our building permit#P09168,we are providing you with the information we have on file stating that the buffer mitigation that was at one time planned to be required because of our driveway location was found to be unnecessary by the Minnehaha Creek Watershed District (MCWD) prior to the building permit being issued. We have included the drawings you sent to us and labeled them Drawing#1 and Drawing#2. Drawing #1 was the original drawing we submitted while in discussions with the MCWD and city about buffer mitigation due to the driveway location. However,this drawing became irrelevant once the MCWD determined that, as allowed by the De minimus Exemption under the Wetland Conservation Act,we were entitled to fill up to 2000 square feet of wetland with no requirements to mitigate the wetland or associated buffer areas. We had contacted the MCWD offices to inquire about the use of the De minimus Exemption and were told by our technician that this would be looked into. We had previously been scheduled to meet with the MCWD Board of Managers on September 15, 2005 to present our plan for mitigating the buffer. When we arrived for the meeting, we were given an apology and told that we did not need to make a presentation,and that we could proceed with our plan to fill up to 2000 square feet of the impacted wetland area as per our conversations with the District Technician. Please see the attached copy of the letter we received from the MCWD dated September 15, 2005 that confirms this. We then proceeded to have a drawing prepared by our surveyor that would show the plan to fill 2000 square feet of wetland, establish the required 25' buffer,and slightly move the planned driveway so that it would be located in the setback area,which is Drawing#2 and is the final drawing we had submitted for our permit application. However, an error was made on this drawing in that the mitigated buffer area to the east of the wetland was not removed from the drawing by the surveyor, and was overlooked by us(likely because after many delays we were trying to get the building project underway and time had become an issue). This added buffer area clearly was not required as supported by the information we have on file, and therefore we did not proceed with a permit application or any buffer mitigation. And,we have operated in that manner since. We noticed that the letter from the MCWD was not copied to the city and so it is possible you were not contacted by them regarding these changes. RECEIVED APR 4 2013 CITY OF ORONO Based on the information in the above paragraph,we request that the rock and fill placed on the south side of the driveway for the purposes of building a planter,as referenced in your item#4,would be allowed to stay as part of our land alteration permit#2012-01221 With regard to item#2 in your letter,we agree that the work involved in the project covered by permit #2011-01360 has not yet been completed. As per the conversation we had with you late fall of 2012, we will need to have some final grading work done once conditions allow in the spring of 2013 and would then plan to have the driveway blacktopped. We have done the work required for wetland buffer establishment,and will work with the city to get this permit closed out as soon as conditions allow. With regard to item#3 in your letter,we are responding with the following observations and requests; 1) The as-built survey was not required of us when the home was built and we do not feel it should be a requirement to receive the final certificate of occupancy. The items that were communicated to us that needed to be completed to receive the final occupancy have long been completed and a survey was not one of them. We have incurred a lot of cost in providing surveys over the last couple of years and we do not feel it is neither necessary nor fair to require us to provide yet another survey. 2) We will provide an as-built survey for the land alteration permit issued for driveway changes as soon as we are able to get that project completed(see above paragraph). 3) We believe the survey information provided with land alteration permit application#2012-01221 provides adequate information given the scope of this project. To require a full-scale survey for these very minor changes is in no way practical and should not be necessary. You would double the cost of this project by requiring a full-scale survey,which is not justified. We are not impacting wetland or wetland buffer areas,and the original complete survey done with our building permit#P09168(you have on file)provides the current information that you need regarding topography and wetland-related boundaries. What other areas could we be possibly impacting with such minor alterations? We request that you would apply a more practical approach to what you are asking of us. The survey requirements requested are the same as you would require on a full-scale building project. Again,we don't see how that can be justified for such a minor land alteration. Please let us know if you have further questions. Reimbursement of Rule J fees and mailing costs Background: The applicant is proposing to construct a single family home at the address cited above in the City of Orono.The proposed driveway will impact wetland and wetland buffer.The applicant has requested an exception from the wetland buffer requirement to allow for wetland buffer impacts with additional wetland buffer proposed adjacent to the driveway and Old Crystal Bay Road. Rule B: Erosion control consisting of silt fence and a rock construction entrance has been proposed to meet Rule B requirements Rule D/I: One type 1/3 wetland approximately 2.5 acres in size is located on the subject property.Wetland impacts in the amount of 1,000 square feet are proposed as a result of the driveway location. The impacts qualify for a De minimis Exemption under the Wetland Conservation Act and do no require replacement. Wetland buffer impacts of approximately 4,200 square feet as a result of the proposed driveway location are proposed as part of the project.Additional wetland buffer in the amount of 4,200 square feet has been proposed to mitigate buffer impacts. Staff does not support the additional buffer as proposed to qualify as an exemption under the criteria of Rule I which states an exception may apply if the proposed plan is better for water resources then strict application of the rule.Wetland buffer impacts could be minimized with a reasonable alternative location of the driveway and additional wetland buffer down gradient from the proposed house and a buffer/wetland revegetation plan which includes establishment of a native plant mix as recommended by the Board of Water and Soil Resources could fit the exception criteria in Rule I. 77 Attachments: 1. After a cursory review we have determined your application to be incomplete. The survey provided is only a partial survey of the property. Please provide 2 copies of an updated, full size certificate of survey which meets all of the City's survey standards (enclosed). The survey should specifically indicate the location of the delineated wetland, the required wetland buffer area (south of the driveway) and removal of the fill and rock border from the wetland buffer area. All existing buildings, structures, landscaping, retaining walls, delineated wetland edge, 25' wetland buffer and 20' wetland buffer setback must be shown on the survey also. Building permit #P09168 was issued in 2006 for the construction of your new home. Due to the location of the proposed driveway within the wetland and wetland buffer the Minnehaha Creek Watershed District required wetland and wetland buffer area mitigation. Attached is a copy of the approved buffer location and plantings. In November of 2011, a land alteration permit was issued for driveway changes/expansions (permit #2011-01360). The $2,000 permit escrow collected with this permit will be held until an as-built survey is received and approved which reflects compliance with this permit. As a result of the additional driveway installed with this permit, a wetland buffer was required by the City to be planted. A $700 escrow is being held to assure the buffer is planted. To-date the driveway and buffer project does not appear to be completed or finaled by the City. A temporary certificate of occupancy was issued on 12/29/2009 for the new home permit. In order to obtain a final certificate of occupancy the conditions placed on permit #P09168 and subsequent permit#2011-01360 must be submitted or satisfactorily completed, specifically the following: 1. The wetland and wetland buffer mitigation required by permit#P09168, including plantings; 2. The wetland buffer establishment as required by permit 2011-01360; 3. As-built survey meeting Orono's survey requirements which reflects compliance with all permits. 4. Removal of the rock and fill material placed south of the driveway in the area of wetland buffer mitigation as shown on the partial survey dated November 28, 2012. 4 - January 7, 2013 85 Old Crystal Bay Road S Page 2 of 2 The portion of the current land alteration permit relating to improvements on the south side of the driveway will not be approved. See Item #4 above. We will not require any additional escrow funds at this time; however updated escrow agreements will be required. An escrow agreement is attached, combining land alteration permit #2011-01360 and #2012-01221. Also attached is an updated escrow agreement combining the $700 wetland buffer escrow (permit #2011-01360) with the 2006 building permit application (#P09168). The wetland buffer escrow will continue to be held until all the wetland buffer and wetland mitigation plantings are complete.
