The plan was received 11-4-11. We have the following comments with regards to engineering matters: • This property shows a delineated wetland along the south side of the existing and proposed driveway. • The city wetland maps indicate that this is a Manage 2 wetland. The plan shows the required 25 foot wide buffers area. • It is our understanding that past permits generated the necessary buffers, easements, and agreements for the wetland and the plan is acceptable from an engineering standpoint. • This project will disturb more than 100 CY of material. Sediment and erosion control information meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000 sediment and erosion control financial security should be required of the owner for this permit. The grass species mix will be planted at a rate equivalent to 12 lbs.per acre and consists of: 40%Big Bluestem 30%Indian Grass 15%Little Bluestem 5% Switch Grass 5% Side oats grama 5%Canada wild rye The wildflower species mix will be planted at a rate equivalent to 5 lbs. per acre and consists of: 17%Black-eyed Susan 17%Purple prairie clover 17%hoary vervain 10%common ox-eye 10% stiff goldenrod 8%tall blazing star 6%fragrant giant hyssop 6% leadplant 3%Canada tick trefoil 3%Bush clover 2%Wild bergamot 1%Common milkweed The process used will include tilling the designated areas and removing the old vegetation from the tilled up soil. The soil will be raked to a minimum 3"depth to smooth the ground surface, and the seed will be laid using a broadcast-type spreader. Clean straw will be mulched over the seeded areas at a rate of Y2 ton per acre and anchored. The seeded areas will be protected with a silt fence until the crop is established,and then removed. The proposed driveway triggers the wetland buffer requirements of the City Wetland Code. The wetland located adjacent to the area of disturbance is classified as a Manage 2 wetland and will require a 25 foot buffer to protect the wetland. A wetland buffer is required for the portion of the wetland adjacent to the proposed driveway disturbance (see attachment). It appears that as part of a Minnehaha Creek Watershed District approval of the house construction, buffers were required around all of the wetlands. The landowner is responsible to deal directly with the watershed to ensure they are in compliance with their previous approval. Buffer Vegetation Requirements Most of the buffer is in a natural state (not mowed or turf) and the ordinance only requires that it is preserved. It appears that a small portion of the buffer may contain turf. The portion of the buffer that is turf will need to have the turf removed and be restored to native vegetation. A written description of the proposed native seed mix to be seeded and method of site preparation and seeding should be provided to the City for review and approval. According to the ordinance Div. 3 Sec. 78-1605 (3) the seed mix must contain at least 12 pounds (PLS) per acre of native prairie grass seed and 5 pounds (PLS) per acre of native wildflower seed. The grass mixture must contain a minimum of four species while the wildflower mixture must contain a minimum of five species. Wetland Buffer Markers At the time of construction staking for the grading of the proposed driveway the upslope edge of the wetland buffer shown on the attached exhibit should be staked so it is clear to the City and landowner where the buffer is located. We are working to get this portion on the driveway completed,which will utilize the remaining fill we have on site. Based on the drawing, we will not impact any wetland or buffer areas with this work. Please review this and let us know if there are any concerns. If not,we will have the necessary preparations completed(survey and drawing?,partial delineation of nearby wetland?)and will proceed with the work. We are ready to move ahead with the work and will begin finding a contractor to do this once you give us the preliminary approval. I did not have a file for this property. Based on the submittal it appears that the proposed driveway disturbance will exceed the 5,000 square foot disturbance threshold and will require buffers. Even if were under 5,000 square feet it looks like they will move more than 50 cy of dirt, however no proposed contours so cannot tell this for sure. When we previously met with them they were proposing to cross the wetland and access the property from the southerly curb cut(from existing) Remember? Anyway, I cannot find evidence of their new home (permit issued in May 2006) triggering the wetland buffer requirement- or more specifically don't have evidence that we required them to establish a buffer. I believe this new driveway will do that. Please confirm or deny. I need to get back to them by Monday if possible. Thanks.
