There are a number of factors which lead to this request. The first is the placement of the house(see site plan). Originally the house was staked with a portion of the garage in the setback required by the City of Orono. The reason for the location of the house was due to it being the highest point on the land and therefore good drainage for the house,it set back from the road,which is a safety concern as we will have two little children,and the view—the house faces the wetland to the south. Due to the City's setback from the wetland,the house was then moved to the north and west. However,due to the need for the main septic site to be located in the northwest corner of the property and the corresponding setbacks from the property line and house,the house was again moved. Finally,the house and garage were pivoted to the east,to create better access to the house and minimize the impact to the wetland and buffer area. Thus,the fourth and current placement of the house. The driveway was another factor in impacting the wetland. Originally the driveway proceeded due south and then east from the house and veered north just prior to the driveway approach to Old Crystal Bay Road. This would have placed the driveway directly through the center of the wetland,impacting a much greater area. The reasoning for this original placement was the aesthetic value of being able to see the front of the house as one proceeded up the driveway and the house is not visible from the road. This is no longer the case. When we discovered the location of the wetland,we moved the drive to the north,its current location. During this process,consideration was also given to the orientation of the garage. The alternative was to access the garage from the north versus the east. However,to do so added expense to our project in terms of additional brick,windows and an extremely long sidewalk. In addition,all visitors to our home would need to walk from the north side of the garage and around the east and south sides of the garage before they arrive at the front door. This configuration is not only illogical as a house design,but it also . decreases the value and aesthetics of the house. As we proceeded though locating the house and considering a number of alternatives to evade the wetland,it appeared we would need to impact the wetland to achieve a balance between what the land required and our desires for our house and property. Our plan is to fill up to 1,000 square feet of the wetland to provide an elevation suitable for the driveway. Due to our impacting the buffer area as well, we discovered we could create an alternate buffer area. Our original plan was to maintain the land just east of the Type 1 wetland in its natural state and therefore is most suitable to creating an alternate buffer 1 site. Our proposal is to replace the buffer area affected by the driveway to the land located east of the Type 1 wetland. The square footage of buffer we are proposing to affect is a maximum of 4,200 square feet and we will replace no less than 4,200 square feet in the new location(see site plan). Wetland impacts up to 2000 square feet are allowed without demonstration of avoidance and a replacement plan application per WCA Rules. Wetland buffer impacts require a variance or exception from the District wetland protection Rule D. An exception is allowed from District rules for a project which does not meet the rules but the proposal is better then strict compliance with the rules.This is usually applied by doing wetland buffer averaging. Increasing the width of the buffer down gradient of the new impervious surface and creating more square feet of new buffer then the amount of buffer impacted. In reviewing Michelle's plans I offered suggestions of what they could do to possibly qualify for an exception. (Requires Board approval). We discussed creating a larger buffer in the area down gradient from the house and restoring other buffer to natives. Although District rules do not necessarily require full avoidance of wetland and wetland buffer in this case, I pointed out that the orientation of the house wasn't ideal for the layout of the property with respect to wetland protection. Reimbursement of mailing costs 2. Reimbursement of Rule J fees Approval of alternative plan which addresses the following changes: 1. Extra wetland buffer down gradient from the proposed house 2. Vegetative restoration plan for the wetland buffers and existing wetland using Board of Water and Soil Resources seed mixes with an associated implementation plan 3. Submittal of a Declaration for the preservation of the wetland buffer which must be executed and recorded 4. Reimbursement of Rule J fees and mailing costs Background: The applicant is proposing to construct a single family home at the address cited above in the City of Orono. The proposed driveway will impact wetland and wetland buffer.The applicant has requested an exception from the wetland buffer requirement to allow for wetland buffer impacts with additional wetland buffer proposed adjacent to the driveway and Old Crystal Bay Road. Rule B: Erosion control consisting of silt fence and a rock construction entrance has been proposed to meet Rule B requirements Rule D/I: One type 1/3 wetland approximately 2.5 acres in size is located on the subject property. Wetland impacts in the amount of 1,000 square feet are proposed as a result of the driveway location. The impacts qualify for a De minimis Exemption under the Wetland Conservation Act and do no require replacement. Wetland buffer impacts of approximately 4,200 square feet as a result of the proposed driveway location are proposed as part of the project. Additional wetland buffer in the amount of 4, 200 square feet has been proposed to mitigate buffer impacts. Staff does not support the additional buffer as proposed to qualify as an exemption under the criteria of Rule I which states an exception may apply if the proposed plan is better for water resources then strict application of the rule. Wetland buffer impacts could be minimized with a reasonable alternative location of the driveway and additional wetland buffer down gradient from the proposed house and a buffer/wetland revegetation plan which includes establishment of a native plant mix as recommended b the Board of Water and Soil Resources could fit the excestion criteria in Rule I.
