On July 12, 2011 your property was inspected. The garage and slab have been removed,
thank you.
Our inspector also noted approximately 20 truckloads of dirt remaining on the property.
According to zoning permit 2010-01206 for a minor land alteration (copy attached), any fill
following the garage demolition must be removed from the property. Additionally, a small pile of
garbage remains on the property which must be removed. Please have the remaining fill and
garbage removed before August 2, 2011.

Our inspector stopped out on June 15 to check the progress on your property. It appeared at that time that progress had
stalled. While we are happy to accommodate extensions due to extenuating circumstances the extended timeline is now
becoming unproductive.
If the soil on site is not in a condition to spread and use it must be removed and new, appropriate material brought in to
resolve the demolition issues.
Please provide me with an update at your convenience.

Staff visited your property on April 12, 2011. During the inspection Staff noted the detached accessory structure
was removed, thank you for complying with the May 2006 Agreement. In order to properly manage the removal
of principal and accessory structures and conduct the required inspections, the City requires a demolition permit.
I have enclosed a demolition permit application. Please complete the enclosed application and submit a check for
$55 for the demolition of the detached accessory structure. This permit should have been received prior to the
removal of the building. However, because this wasn't included with your demolition permit for the principal
structure in 2010 or the zoning permit issued in January of this year the demolition permit requirement may have
been overlooked. For this reason, an after-the-fact fee will not be applied.
Additionally during the inspection it was noted the foundation, piles of dirt, construction debris/miscellaneous
items and an abandoned refrigerator remain on the property. The construction debris, miscellaneous items and
an abandoned refrigerator are a violation of City Code Sections 58-1(a) and 58-3 (copies attached) and must be
removed from the property.
This letter will serve as your notice that the property must be brought into compliance by May 16, 2011.
In order to bring the property into compliance, the piles of dirt must be used on site to complete the demolition of
the garage foundation and the septic tanks (consistent with Zoning Permit 2011-01206) or the piles of dirt
removed; the construction debris, miscellaneous items and abandoned refrigerator must also be removed.
For your convenience, the City will soon be conducting our annual Spring Clean-up. On Saturday, April 30th,
construction materials can be brought to the Orono Public Works building (see attached flyer)for disposal.
Please complete and return the enclosed demolition permit with the$55 fee at your earliest convenience.
Additionally, removal of the foundation, piles of dirt, construction debris, abandoned refrigerator and
miscellaneous items must be completed by Monday, May 16, 2011 to avoid further action by the City.
Please be advised, if you fail to correct the violations this matter will be forwarded to the City Attorney for review
and may result in enforcement actions which may include criminal prosecution.

Sec. 58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris, refuse, litter,
dead trees, or noxious weeds, and to remove all other public health or safety hazards from the property.
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard,
and upon seven days' written notice to the owner, as shown by the records of the office of the county auditor, of
private premises on which such material is found or any conditions in violation of this code section exist, the city
may remove such matter or correct any conditions in violation, and certify the cost of such removals or corrections
as any other special assessment.

Sec. 58-3. Junk cars, furniture, household furnishings and appliances stored on public or private
property.
It is unlawful to park or store any unlicensed, unregistered or inoperable motor vehicle lacking essential
parts, household furnishings or appliances, or parts or components, on any property, public or private, unless
housed within a lawfully erected building. Any violation of this section is declared to be a nuisance; and upon
seven days' written notice to the owner, as shown by the records in the office of the county auditor, of private
premises on which such material is found, the city may remove the vehicle and certify the cost of such removal as
any other special assessment. For the purpose of this section, an inoperable motor vehicle shall be defined as
lacking parts essential to operation, including but not limited to wheels, tires, motor, drive train, battery; or having
two or more flat tires; or having the interior, including the driver's position, used for storage in such a manner that
no person can operate the vehicle.

1. The structure(s) shall be kept enclosed and/or secured until such time as demolition is
complete.
2. Demolition debris will be kept off adjoining property and/or the public rights-of way unless
specific prior approval is obtained in writing for temporary use thereof.
3. Foundations shall be completely removed from the ground.
4. All demolition debris shall be completely disposed of off site in accordance with all
applicable PCA requirements.
5. Water wells must be abandoned in accordance with State Health Department regulations.
6. Inspection required when all debris has been removed, before backfilling.
7. Within 5 working days of superstructure removal, a final inspection shall be requested. The
site shall be left clean and clear of all debris, with any excavation filled with earth level with
the adjacent ground elevation (except when such excavation is to be used as part of a new
building and such new building is actually under construction).
8. Septic systems must be abandoned per Minnesota Rules Chapter 7080. All septic tanks
must be pumped, crushed and filled with native soils. An inspection is required after the
tanks are pumped and before the tanks are crushed and filled.
9. The undersigned owner shall and hereby does indemnify and hold harmless the City of
Orono, its agents, employees and assigns from and against all claims, damages, losses or
expenses, including attorney fees, against the City, its agents, employees and assigns arising
out of or resulting from the demolition described herein as performed by the property owner,
his employees, agents, subcontractors or assigns.

Thank you for contacting me about the work at 85 Old Crystal Bay Road in Orono (Scott& Michelle Miller parcel). I have
attached three PDF documents containing the photos we have for this property as you requested (4-8-10,8-25-10,and
11-2-10). Back in April,one of our inspectors noticed the stockpiles and stopped and took the 4-8-10 photos. He
stopped back at the site again in the end of August and took the 8-25-10 photos. A letter was mailed to the property
owners on August 26,2010(Permit Needed Letter.pdf,attached) requesting the submittal of a site plan and the
installation of erosion/sediment control.
I received a written request from Scott Miller on 10/14/10 for a site meeting to discuss his driveway realignment
proposal,and we(Scott and I) met on site on 11/2/10(this is where I took the 11-2-10 photos). During this meeting, I
noticed the stockpiles on his property(I actually was not aware of the previous site visits by one of our inspectors until
after this site meeting occurred). I indicated to Scott during our meeting the need for stabilization of the stockpiles,and
that I was going to look into the details regarding his driveway proposal. After the meeting, I brought up this site to our
inspector for Orono,and that is when he told me he had been out there before. I believe there was some
correspondence between our inspector and Scott Miller that led our inspector to believe that the stockpiles were only
going to be there for a very short period of time,which is why the requirements of the first letter sent out were not
fulfilled. That particular inspector no longer works for the District,so unfortunately I cannot confirm exactly what their
correspondence was.
I left voicemails for Scott on 11/15/10 and 11/29/10 to discuss the stockpile situation,and finally got a call back on
12/6/10. Our discussion was pretty much only about the stockpiles(I told him I still had to look into the wetland
delineation and some other things before discussing the driveway realignment). I e-mailed the attached letter(Permit
Needed 12-6-10.pdf)that same day regarding the need for a permit application for the stockpiles.
Like I said on the phone, I have not yet responded to the Millers about their proposed driveway realignment(relating to
WCA and our Waterbody Crossings&Structures Rule), and the permit application for the stockpiles we received last
Monday is incomplete. At this point, I will be drafting a letter that addresses the items missing from the permit
application as well as their proposed driveway realignment. I will make sure to copy you when this is sent out.
I also wanted mention a few other concerns I wanted to discuss with you about this property:
1. The plan set we received on 10/14/10 showing the Miller's rough idea of where they would like their new
driveway to be located also happened to include details on the new house that was built within the last few
years. This plan shows the wetland fill area for the proposed driveway(now their current driveway)as 2000
square feet. The plan set we have in our permit file for the permit we issued for their new house back in 2005
says 1000 square feet of wetland fill for the proposed driveway,and furthermore, under no circumstances
would they be allowed to fill over 1000 square feet of wetland and still qualify for the de minimis exemption
under WCA. I asked Scott about this discrepancy during our site meeting,and he didn't know how much
wetland was filled for their current driveway...can you tell me how much wetland fill was indicated on the city
approved plan for the construction of the new house and current driveway?

2. I believe the wetland buffers that are on this plan set are the City's requirement, not MCWD's, as our permit was
only for Erosion Control with a de minimis exemption (no wetland buffers required). During the site meeting on
11/2/10, it appears that a portion of the wetland buffer had been mowed (11-2-10 photos with the bobcat
visible show the area I'm talking about). As you probably know, it's pretty difficult to figure out exactly where
the wetland boundary and buffers are in the field, but it seems clear to me that at least a portion of the buffer
had been mowed. I also wanted to inquire about how the city would handle a request to impact this buffer area
with the proposed driveway.
As you can see, I currently have many concerns regarding this property. I will make sure to keep you in the loop in my
correspondence with the property owners. Please let me know if you have any questions—I'll be in touch.

On February 17, 2010 a demolition permit was issued for the existing principal structure with a final inspection
performed on April 22, 2010 by Lyle Oman. On August 5, 2010 you met with John Smyth our wetland specialist
and myself to discuss your proposal to create a driveway through the wetland with the dirt fill which was deposited
on site. City Code Section 78-966 requires a permit for any deposit of material, grading or filling, and Section 78-
1608 (1)(c) prohibits filling within a wetland. These code sections are attached herein for your reference.

As a land alteration/grading permit has not been issued to the property this material must be removed from the
property by December 20, 2010. As a result of the removal of the pre-existing principal structure and construction
of a new principal structure the detached accessory structure on the property no longer meets the requirements of
City Code 78-1435 (also attached). This accessory structure is no longer in compliance with zoning regulations
and must be removed as soon as possible. According to the attached Agreement for the Removal of Accessory
Structures the City may enter the property, remove the accessory building and assess the costs to do so back to
your property.
Without a permit or a conditional use permit (for fill in excess of 500 cubic yards) you are in violation of City Code
Section 78-966(a)(1). In order for the fill to remain on the property you must complete and submit the after-the-
fact application for filling or grading (attached) and submit a survey meeting the standards in the attached
handout, specifically illustrating pre-and post-fill grades. The amount of fill should be calculated as well.
The removal of the detached accessory building must be completed as well as submittal of the land
alteration application on or before December 20, 2010 to avoid further action by the City. Please be
advised, if you fail to correct the violations this matter will be forwarded to the City Attorney for review and may
result in enforcement actions which may include criminal prosecution.

Sec. 78-1435. Location.
Except as may be specifically provided, no detached garage or other accessory building shall be located nearer to
the front or street lot line than the principal building on that lot. Detached garages or other accessory buildings on
lots which have frontage on a lake may be located between the rear yards of such lots and the principal building
only if setback requirements of section 78-305(b), section 78-330(b) and section 78-350(b) are met. Detached
garages on lots that have frontage on a lake may be located ten feet from the street or rear lot line when doors
face away from the street and an adequate vehicle turnaround is provided on the site. This section shall not apply
to lakeshore lots that are divided by streets or private roads or are corner lots.

Sec. 78-1608. Standards.
The following standards apply to all land within the wetland overlay districts, wetland buffer areas, and to
neighboring lands:
(1) Protection of wetlands and wetland buffer areas.
a. Except as modified or regulated by the standards of this subsection, all requirements of
the underlying zoning district apply.
b. No structures are allowed in the wetland overlay districts, or wetland buffer area except
those allowed as of right or by conditional use permit by sections 78-1606 or 78-1607 of
this article.
c. Activities including, but not limited to, building (other than a boardwalk or dock), paving,
mowing, vegetation removal, filling, dumping, yard waste disposal or fertilizer application
are prohibited, except that certain such activities may be permitted when approved by the
city as a buffer management plan. Invasive non-native vegetation, such as European
buckthorn and noxious weeds, may be removed by obtaining a vegetation removal permit
from the city.
Sec. 78-966. Prohibition.
(a) It is unlawful for any person to perform or have performed the following land alteration activities
without a conditional use permit issued by the council:
(1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt or similar earth
material within the limits of the city.
(2) Fill or reclaim any land by depositing such material or by grading of existing land to
elevate or alter the existing natural grade.
(3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore
of lakeshore property.
(b) All land alterations involving filling and grading shall be performed only with clean fill as defined in
section 78-1. Granting of such permits is subject to other regulations and prohibitions of this Code
and other applicable statutes or ordinances of other governmental bodies.

ZONING PERMIT ESCROW AGREEMENT
Orono Zoning Permit#
AGREEMENT made this day of , 20_, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and ("Owners").
Recitals
1. A building permit application has been filed for a zoning permit for a property located at
the ("Subject Property"), legally described as
Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $ with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with zoning permit # if compliance with the approved zoning permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay
all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

1. All surveys shall be certified by a Minnesota Registered Land Surveyor. Civil engineers may certify

"Applicants")and the City of Orono, a Minnesota municipal corporation(hereinafter referred to as
the "City").
WITNESSETH:
WHEREAS, Applicants have made application to the City for demolition of the
principal residence structure on the property located at 85 Old Crystal Bay Road S within the City
of Orono, Hennepin County, State of Minnesota, such property legally described as:
Lot 9, Auditors Subdivision No. 230
(hereinafter referred to as "Subject Property"); and
WHEREAS,the Applicants are the owners of the Subject Property; and
WHEREAS, the Subject Property contains an existing principal residence
structure and a conforming detached garage shown on the survey attached hereto as Exhibit B; and
WHEREAS, the Applicants intend to construct a new principal structure on the
Subject Property; and
WHEREAS, the Applicants are aware that according to Orono Municipal Zoning
Code Section 78-1368, only one principal structure is permitted per lot; and
WHEREAS,the Applicants are aware that according to Orono Municipal Zoning
Code Section 78-1435, once the new principal structure is constructed the existing home and
existing detached garage will be located nearer to the front lot line than the principal structure,
requiring variances; and
WHEREAS, the Applicants intend to, upon completion of the new principal
structure, immediately apply for a conditional use permit and/or variances to allow the existing
structures to remain on the property in a location closer to the front lot line than the new principal
structure.
WHEREAS,the City intends to allow the existing home and accessory structure(s)
to remain on the Subject Property during construction of the new principal residence structure with
the expectation that said existing home and accessory stnicture(s) will become conforming with
the approval of a guest house conditional use permit and/or variance to be closer to the front lot line
than the new principal structure as soon as construction of the new principal residence is
completed.

NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE TO THE
FOLLOWING:
1. Applicants may retain the existing home and the existing accessory structure, subject to the
following conditions:
A) Applicants agree to apply for a land use application pertaining to the existing home
and existing detached garage within 60 days of issuance of a building permit for the
new principal structure;to begin construction on the new residence within 120 days
of the issuance of a building permit; and to complete all exterior work within 1 year
of building permit issuance and interior work within 2 years of building permit
issuance.
B) In the event that any activity described in item A has not been accomplished within
the defined timeframe or the land use application(s) is denied, the Applicants shall
remove the existing home and existing detached garage at the Applicants' expense,
or the Applicants shall apply for an extension of this Agreement.
C) If one of the item A events occurs and the Applicants fail to perform their removal
obligations per item B,the Applicants hereby agree as follows:
1. The City may enter upon the property and remove the existing home and
accessory building(s).
2. The City may assess the costs of removal to the property.
3. This Agreement shall be binding upon current and future owners of Subject Property, and
shall be filed within the chain of title of the Subject Property.
4. Fee owner(s)of the Subject Property, if not the Applicants,consent to the execution of this
Agreement and to its terms, as shown by their signature(s)upon this document.
5. Applicants shall indemnify and hold harmless the City, the City Council, and the agents
and employees of the City from and against all claims, damages, losses or expenses,
including attorney fees, which the City, City Council and agents and employees of the City
may suffer or for which it may be held liable, arising out of or resulting from the assertion
against them of any claims, debts or obligations in consequence of the performance of the
terms of this agreement.

issues, and also communicates our opinions and concerns. We would ask that you read this letter and thoroughly
consider what we are communicating, and then allow us to develop a more reasonable time frame given the
circumstances that exist to deal with these issues. Given the weather conditions, time of year and the circumstances we

Dear Ms Curtis;
We have received you letter dated December 1, 2010 and are providing you with this
response to that letter.
There are a few things in your letter that need correction/clarification. It is not correct
that the dirt fill on our property was planned only for the proposed driveway. Much of
the fill was needed to complete filling the hole from the house removal—we had
experienced a lot of settling of the original fill, and we are certain there will be more
settling in the spring. In addition,the plan was to use a majority of the remainder of the
fill to level out the existing grade in our yard which was very rough due to it being a farm
field for many years. Then once that project was completed, we would use whatever fill
was remaining for the driveway project. When we began to distribute the dirt for the
leveling, we found the dirt to be un-usable for that purpose because of the extremely high
clay content—making it impossible to work with for this purpose. Had this plan worked,
the majority of the dirt would have been used in September/October. The plan was then
changed to use this dirt for the leveling of the old building site, the filling of the old
septic site, and the driveway project, for which it would be well suited. We had hired a
contractor to handle the septic removal, which was to be completed in October. It is
currently partially completed, waiting for the contractor to return to complete filling the
hole and leveling. The contractor had originally told us this would be completed in 2
weeks. We have now waited nearly 10 weeks, and have been told(after multiple phone
calls)that it will be"a while"before they can get back to complete it. At that time we
will have the rest of the dirt on the old house site cut down to the amount that will be
needed with the spring settling.
We are currently working with the watershed district to come to an agreement on the
proposed driveway and how it would impact a"wetland". We believe the classification
of the impacted area as a wetland to be questionable, and that it is described as so in the
delineation report that was most recently completed. The watershed district is reviewing
that information and we are in contact with them. It is possible we will take the steps
necessary to change this classification, but we have not yet arrived at that point.
With regard to the dirt fill, in hind site we would not have taken on the amount of fill we
did had we known it would not be suitable for leveling the yard. When the fill became
available,we saw it as an opportunity to help our neighbor and ourselves—they needed
to get rid of the dirt and we needed some. We originally planned to spread the dirt in a
timely fashion,but the dirt was wet when we received it and as you may recall we had
several large rainfalls that prevented us from spreading it until it finally dried. We are
continuing to work to have this resolved. Due to the factors listed, we believe it makes
sense to complete the old house and septic site fill, and then use the remainder of the fill
for the driveway project. Until the wetland issues are resolved, we cannot do a survey
because we do not know the details of the driveway project.
With regard to the old detached garage, our most likely plan has been to remove the
building,but we have also given some consideration to updating it for use as an accessory
building. We are greatly concerned about the reference you have made to City Code 78-
1435. We do not feel this code can or should be applied to this property due to the
limited options we have been presented with regarding the development of the property
as a whole. We also do not see the merit of such a code to begin with, with the possible
exceptions of some specific circumstances that again, should not apply here. The city
should be aware that to date we have worked within the very limiting circumstances of all
the city and wetland codes. Because of the development plan we have had to follow in
consideration of all these codes, we believe a hardship scenario exists that should allow
us to either keep the accessory building intact with a plan to renovate and eventually
expand, or to remove it and eventually replace it with another accessory building. Before
anything is done with the building we will need the assurances from the city that we will
have the option to have an accessory building in that general area of the property. We do
not support the concept of spending money to apply for a potential variance that deals
with a code issue that should not be applied in our situation to begin with. We are willing
to schedule a meeting to work out these details.
We are also concerned about the deadlines you have listed in the letter. We had not been
previously notified of any deadline dates, and we believe that if such a deadline is to be
set it needs to be much more reasonable. We understand the city has provided us with
some extra time to this point. Our timeline and process has been mostly based on
financial feasibility. We are working very hard to restore our business and finances
during a time of extreme economic challenge, and we continue to need the city to
understand this and work with us. We will follow through on what needs to be
accomplished with the property, in cooperation with the city, but it also needs to be a
time frame that is workable for us.
From the beginning of our efforts to develop and improve this property, our experience
has been that you are very oriented towards identifying codes and requirements that
extremely limit our options, and that some of the time it is clear these codes have not
been established to be applied to our circumstances. If we toured the city there is no
doubt we could find many violations of city ordinances that are not being enforced and
no variances to back it up. We would like to have a city representative that will work
with us and for us to come up with a plan that helps us to achieve our goal, which is to
develop this property into an attractive,practical and functional property. Because we
lack in knowledge and understanding of much of the code, we have made decisions along
the way (greatly influenced by the actions of the city)that and have left us in a less than
desirable position. We believe the city should be on board with us, working along side us
to come up with the best solution for the property and advising us in such a manner. We
do not feel the city has provided that type of service. You are very quick to point out
why we can't do what we want to do, but make little effort to come up with other
potential solutions for us. We believe the city officials should work to understand the
needs of the citizens and apply good,practical judgment and advise us in a way that is in
our best interests as well. You are currently much better at looking for city ordinances
that you can enforce to get us to do what you and maybe others in our neighborhood want
us to do, even if it is not in our best interests.
We would like to request that Lyle Oman would be the representative from the city that is
assigned to work with us to come up with the plan to follow to complete the development
of the property. He has demonstrated to us over the years that he can apply a good and
practical approach to what we are trying to accomplish after considering our needs and
circumstances. We believe that before any further actions are taken,we need to have a
plan in place. Once that plan is in place, we will follow the plan.

Thank you for contacting me about the work at 85 Old Crystal Bay Road in Orono (Scott& Michelle Miller parcel). I have
attached three PDF documents containing the photos we have for this property as you requested (4-8-10, 8-25-10, and
11-2-10). Back in April,one of our inspectors noticed the stockpiles and stopped and took the 4-8-10 photos. He
stopped back at the site again in the end of August and took the 8-25-10 photos. A letter was mailed to the property
owners on August 26, 2010 (Permit Needed Letter.pdf, attached) requesting the submittal of a site plan and the
installation of erosion/sediment control.
I received a written request from Scott Miller on 10/14/10 for a site meeting to discuss his driveway realignment
proposal, and we (Scott and I) met on site on 11/2/10(this is where I took the 11-2-10 photos). During this meeting, I
noticed the stockpiles on his property(I actually was not aware of the previous site visits by one of our inspectors until
after this site meeting occurred). I indicated to Scott during our meeting the need for stabilization of the stockpiles, and
that I was going to look into the details regarding his driveway proposal. After the meeting, I brought up this site to our
inspector for Orono, and that is when he told me he had been out there before. I believe there was some
correspondence between our inspector and Scott Miller that led our inspector to believe that the stockpiles were only
going to be there for a very short period of time,which is why the requirements of the first letter sent out were not
fulfilled. That particular inspector no longer works for the District, so unfortunately I cannot confirm exactly what their
correspondence was.
I left voicemails for Scott on 11/15/10 and 11/29/10 to discuss the stockpile situation, and finally got a call back on
12/6/10. Our discussion was pretty much only about the stockpiles (I told him I still had to look into the wetland
delineation and some other things before discussing the driveway realignment). I e-mailed the attached letter(Permit
Needed 12-6-10.pdf)that same day regarding the need for a permit application for the stockpiles.
Like I said on the phone, I have not yet responded to the Millers about their proposed driveway realignment(relating to
WCA and our Waterbody Crossings&Structures Rule), and the permit application for the stockpiles we received last
Monday is incomplete. At this point, I will be drafting a letter that addresses the items missing from the permit
application as well as their proposed driveway realignment. I will make sure to copy you when this is sent out.
I also wanted mention a few other concerns I wanted to discuss with you about this property:
1. The plan set we received on 10/14/10 showing the Miller's rough idea of where they would like their new
driveway to be located also happened to include details on the new house that was built within the last few
years. This plan shows the wetland fill area for the proposed driveway(now their current driveway) as 2000
square feet. The plan set we have in our permit file for the permit we issued for their new house back in 2005
says 1000 square feet of wetland fill for the proposed driveway, and furthermore, under no circumstances
would they be allowed to fill over 1000 square feet of wetland and still qualify for the de minimis exemption
under WCA. I asked Scott about this discrepancy during our site meeting, and he didn't know how much
wetland was filled for their current driveway...can you tell me how much wetland fill was indicated on the city
approved plan for the construction of the new house and current driveway?

2. I believe the wetland buffers that are on this plan set are the City's requirement, not MCWD's, as our permit was
only for Erosion Control with a de minimis exemption (no wetland buffers required). During the site meeting on
11/2/10, it appears that a portion of the wetland buffer had been mowed (11-2-10 photos with the bobcat
visible show the area I'm talking about). As you probably know, it's pretty difficult to figure out exactly where
the wetland boundary and buffers are in the field, but it seems clear to me that at least a portion of the buffer
had been mowed. I also wanted to inquire about how the city would handle a request to impact this buffer area
with the proposed driveway.
As you can see, I currently have many concerns regarding this property. I will make sure to keep you in the loop in my

RE: Stockpiles on 85 Old Crystal Bay Road, Orono
During routine inspections by the Minnehaha Creek Watershed District(MCWD) staff on 8/25/2010, it was observed
that stockpiles were being stored on your property. Any stockpiling or excavation of more than 50 cubic yards of
material requires an MCWD Erosion Control Permit.
Please submit a plan showing the scope of work planned for your property. Provide the dimensions of the disturbed
areas and a statement of plans for stabilization.
The stockpiles on your property were not contained and require sediment and erosion control measures such as silt
fence in place to ensure that sediments remain on your lot in the event of a large rainfall.
To avoid formal enforcement action from the Minnehaha Creek Watershed District, please implement the above
mentioned corrections by 4:30 PM on Tuesday, August 31, 2010 and submit the site plans and MCWD Erosion
Control Permit application by Tuesday, September 7, 2010. Thank you for your immediate attention to this matter. If
